Because of recent case law, a determination has been made by Agency Counsel that set-aside funds cannot be used to pay for operation costs. This determination was made after the Request for Proposals (RFP) was released; two (2) service providers, The Salvation Army and Option House, Inc., were selected and contracts released for signature. Because an appropriate alternative funding source needs to be identified and the City has reached its fifteen percent (15%) limit with respect to CDBG financed public services activities, it is necessary to transfer fiinds between CDBG funded projects in order to accomplish the desired objective of meeting existing funding commitments. CDBG FUNDING SUBSTITUTION The Housing Division has been allocated $20,000 in CDBG funds for a Transitional Case Manager Public Service Project. These funds were to provide homeless families residing in a transitional housing project created under the HOME Investment Partnership Act Program, with case managers to provide families with support service plans as a component of their self- sufficiency programs. The Transitional Housing project was created under the HOME Investment Partnership Act (HOME). CDBG funds were identified for the case manager aspect of this project because HOME funds were not available at the time the project was being implemented. Given the fact that the HSUPP commitment cannot be funded from the Low- and Moderate- Income Housing Set-Aside funds, it is necessary to proceed with the following actions: 1. Create a Homeless Shelter Utility Payments Program by transferring $20,000 in CDBG funds from the Housing Division's Transitional Case Manager Project to the Homeless Shelter Utility Payments Program Project. ------------------------------------------------------------------------------------------------------------------ BJL.MI,:pa,,v:hsupp.cdc COMMISSION MEETING AGENDA MEETING DATE: 05/01/95 Agenda Item Number: I STAFF REPORT HSUPP PROGRAM April 12, 1995 Page - 2 - ------------------------------------------------------------------------------------------------------------------ 2. Allocate $14,000 from the $20,000 to the Salvation Army and the remaining $6,000 to Option House, Inc., to operate the HSUPP Project. These actions will provide the necessary vehicle to fund the Homeless Shelter Utilities Payment Program to meet current obiligations.
