Synopsis of Previous Council action:
01/23/95 --- Authorization to proceed was given, and Plan No. 9235 was approved.
02/21/95 --- Notice of Exemption filed and a finding of consistency with the
General Plan was made.
04/03/95 --- Resolution of Intention No. 95-93 was adopted, which sets a
public hearing date of 05/01/95 for the proposed vacation of
that 20.00 foot alley between Sonora Drive and Palmyra Drive and
between Ralston Avenue and 40th Street, per attached Plan No. 9235.

3ecommended motion:
1. That the hearing be closed and the Findings of Fact as set forth in the Staff
Report from Roger G. Hardgrave, Director of Public Works/City Engineer as to
why that certain 20.00 foot alley between Sonora Drive and Palmyra Drive and
between Ralston Avenue and 40th Street, is no longer necessary for street
purposes, be adopted.
AND
2. Adopt Resolution.

STAFF REPORT
Staff received a request from Harry Gerken, one of the adjoining property owners, to
vacate the generally Northeasterly/Southwesterly alley lying between Palmyra Drive and
Sonora Drive and between Ralston Avenue and 40th Street (it actually ends in Sonora
Drive where it curves around to the East - see attached plan) . 100% of the adjoining
property owners and apartment tenants have requested the vacation of the alley.
On 01-23-95, authorization was give to proceed with the proposed vacation, and Plan
No. 9235 was approved.
Utility companies and City departments were notified of the proposed vacation on
12/12/94, with a reply due by 01/12/95. General Telephone requested the reservation
of an easement for their existing facilities within the alley.
The petitioners for the vacation are proposing to install gates at both entrances into
the alley. Access has been retained, through specific easements for refuse services
and for the Fire Department. The Refuse Department will be provided with a key to
operate the gates and a knox box will be provided for the Fire Department. An
easement for emergency and service vehicles will be reserved for the City. Access for
all adjoining property owners will be reserved through an access/egress easement.
All costs for the installation of the gates, key provisions, the entire alley vacation
process are paid by the petitioner. There is no expense to the City for this process
or the resulting work being done by the petitioner.
On 03/14/95, a Notice of Exemption was filed for the proposed vacation, and a finding
of consistency with the General Plan was made.
On 04/03/95, Resolution of Intention No. 95-93 was adopted, reserving the easements
delineated above. That resolution sets a public hearing date of 05/01/95. On
04/13/95, the Resolution of Intention was published in a local newspaper, Notices were
posted in the area proposed for vacation, and all property owners adjacent to the
proposed vacation were notified of said hearing by mail .
There appears to be no further necessity for that certain 20.00 foot alley lying
generally Northeasterly/Southwesterly between Sonora Drive and Palmyra Drive and
between Ralston Avenue and 40th Street, either for present or future street purpos-
es. Staff recommends the vacation on the basis of the following Findings of Fact:
1. The above alley has been determined by the Department of Public Works to be of no
further necessity to the general public:
a) Notice of Exemption was filed, and a finding of consistency with the General
Plan was made.
2. The adjoining property owners have requested the proceedings and the required
$1000.00 fee has been paid.
3. All of the concerned City Departments and Utility Companies were notified of the
proposal and all have had the opportunity to respond. Easements for the City,
GTE, service and emergency vehicles, and for all adjoining property owners have
been reserved over the entire area proposed for vacation, and the same has been
provided for in the Resolution of Intention.
Staff therefore recommends the adoption of the Resolution Ordering Vacation.
