and an exception granted for the actual width of 40 inches.

STAFF REPORT
A complaint was received from Mr. Robert Neves, 3771
Aspen Drive, San Bernardino, to the effect that the sidewalk on
the west side of "E" Street, north of Second Street, had a 36-
inch clear width, in lieu of the 48-inch clear width required
for handicap access.
An investigation was conducted in response to this
complaint. The report of this investigation, dated 4-5-95 , was
presented to the Handicap Accessibility Appeals Board for review
and a recommendation, since the Mayor and Council have juris-
diction over public rights-of-way.
At their meeting of 4-12-95 , the Board unanimously
approved the form motion to recommend that the Mayor and Council
make a finding that provision of the standard 48-inch width
would constitute an unreasonable hardship, and that an exception
be granted for the actual width of 40 inches.
We recommend that the recommendation by the Handicap
Accessibility Appeals Board be accepted.

BASIS OF COMPLAINT: The recently installed street lights, as a
part of the Main Street improvements, reduced the clear
sidewalk width from 48 inches to 36 inches.
DISCUSSION: "E" Street was improved as a part of the Central
City Redevelopment Project in the late 1960 ' s. Street lights
were installed by this project.
The original street lights were recently replaced with new
street lights in accordance with the Main Street theme. The
minimum clear distance is about 40 inches.
There are four (4) street lights within this section of "E"
Street. Three (3) are set back from the curb, and the fourth
is located at the normal distance from the curb face.
Section 3324 of the Uniform Building Code states that walks and
sidewalks shall be a minimum of 48 inches in width. However,
an exception is allowed, as set forth in the CalACS Accessi-
bility Standards Interpretive Manual, dated October, 1993 , to
reduce the clear sidewalk width to 36 inches. This exception
is allowed when, because of right-of-way restrictions, natural
barriers, or other existing conditions, the enforcing agency
determines that compliance with the 48-inch clear width would
create an unreasonable hardship.
Attached, for reference, is a copy of Figure No. 33-3 , from
CalACS Accessibility Standards Interpretive Manual, depicting
sidewalk obstructions. This figure shows a minimum sidewalk
width of 48-inches, with a minimum clear distance to an ob-
struction (such as a street light pole) of 36 inches.

FINDINGS: Additional right-of-way would need to be acquired
from the Carousel Mall parking lot in order to comply with the
48-inch standard width. The existing concrete block retaining
wall would have to be removed and reconstructed, at the
location of the four (4) street lights.
The preliminary estimate of cost for removing and reconstruct-
ing the concrete block retaining wall, and modifying the irri-
gation and landscaping at four locations, is $25 , 000 . In
addition, three of the existing Main Street street lighting
standards would have to be relocated, at an estimated cost of
$6 , 000 .
Access is presently provided by this public sidewalk, since it
is in excess of the 36-inch minimum width. Widening the side-
walk at these four (4) street lights would only provide the
standard width sidewalk.
No funds are available for this widening, and would have to be
transferred from another budgeted project. Provision of a 48-
inch minimum clear width sidewalk would, therefore, create an
unreasonable hardship.
RECOMMENDATIONS: Appeals on accessibility for public
facilities are heard by the Mayor and Council. This item is
being presented to the Handicap Accessibility Appeals Board for
review and a recommendation to the Mayor and Council.
The following motion is offered for your consideration:
MOTION: That the Handicap Accessibility Appeals Board
recommend to the Mayor and Council that an exception, to the
minimum width of 48-inches for a public sidewalk, at the
four (4) street lights on the west side of "E" Street, north
of Second Street, be granted to reduce the minimum width and
obstructions to 36 inches, since widening the public side-
walk to provide a minimum clear width of 48 inches would
constitute an unreasonable hardship.
