HomeMy WebLinkAbout2016-063 I RESOLUTION NO. 2016-63 2 3 RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF 4 SAN BERNARDINO ACTING AS THE SUCCESSOR HOUSING AGENCY TO THE REDEVELOPMENT AGENCY OF THE CITY OF SAN BERNARDINO APPROVING 5 THE ACCEPTANCE OF CERTAIN REAL PROPERTY ASSETS TRANSFERRED FROM THE SUCCESSOR AGENCY OF THE REDEVELOPMENT AGENCY OF THE CITY OF 6 SAN BERNARDINO PURSUANT TO CALIFORNIA HEALTH AND SAFETY CODE § 34176 AND APPROVING CERTAIN RELATED ACTIONS 7 8 WHEREAS, pursuant to Health and Safety Code (the "HSC") § 34172 (a) (1), the 9 Redevelopment Agency of the City of San Bernardino was dissolved February 1, 2012; and 10 WHEREAS, consistent with the provisions of the HSC, on January 9, 2012 the Mayor and 11 Common Council of the City of San Bernardino elected to serve in the capacity of the Successor 12 Agency to the Redevelopment Agency of the City of San Bernardino (the "Successor Agency"); and 13 WHEREAS, the Oversight Board to the Successor Agency (the "Oversight Board") has 14 been established pursuant to HSC § 34179 to assist in the wind-down of the dissolved 15 redevelopment agency; and 16 WHEREAS, consistent with the provisions of the HSC, the Mayor and Common Council 17 of the City of San Bernardino previously elected to serve in the capacity of the Successor Housing 18 Agency to the Redevelopment Agency of the City of San Bernardino (the "Successor Housing 19 Agency") for the purpose of retaining the low- and moderate-income housing fund (the "LMIHF") 20 assets and functions previously performed by the former redevelopment agency (the "Former 21 RDA"), inclusive of all rights, powers, duties, obligations and housing assets related thereto, with 22 certain exceptions; and 23 WHEREAS, unlike the Successor Agency, which is a separate legal entity under the HSC, 24 the Successor Housing Agency is not a separate legal entity and its title denotes only functional 25 responsibilities that are to be carried out by the City of San Bernardino; and 26 WHEREAS, consistent with HSC § 34176, on February 16, 2016, the Successor Agency 27 adopted its Resolution Nos. 2016-22 and 2016-23, which enabled the Successor Agency to recover 28 certain real property assets from Affordable Housing Solutions of San Bernardino, Inc. and the San 1 1 Bernardino Economic Development Corporation that are assets of the Former RDA's LMIHF") 2 (collectively, the "LMIHF Assets"); and 3 WHEREAS, a schedule more particularly describing the 131 parcels of real property that 4 constitute the LMIHF Assets is included as Exhibit"A"to this Resolution; and 5 WHEREAS, per HSC § 34176 (e), the Successor Agency is now required to transfer the 6 LMIHF Assets to the Successor Housing Agency in accordance with the procedures prescribed 7 therefor by the HSC, which includes a review by the Oversight Board and the California 8 Department of Finance (the "DOF"); and 9 WHEREAS, pursuant to HSC § 34176 (a) (2), the Successor Housing Agency is also 10 required to submit a Housing Asset Transfer (the "HAT") form to the DOF that lists all of the 11 housing assets, as more specifically defined in HSC § 34176 (e), to be retained by the Successor 12 Housing Agency; and 13 WHEREAS, on August 1, 2012, the Successor Housing Agency administratively submitted 14 its initial HAT to DOF for its review and conducted periodic telephone and e-mail communications 15 with DOF staff with respect to the HAT, inclusive of providing requested back-up documentation; 16 and 17 WHEREAS, subsequent to DOF's reviews, DOF issued its determination letters dated 18 August 31, 2012 and March 21, 2014 with respect to the initial HAT (the "DOF HAT Letters"); and 19 WHEREAS, as a follow-up to the DOF HAT Letters, the Successor Agency has prepared 20 an amended HAT (the "Amended HAT"), which is also consistent with the schedule of LMIHF 21 Assets as described within Exhibit"A"to this Resolution; and 22 WHEREAS, the Amended HAT will be submitted to DOF together with the Oversight 23 Board's resolution approving the transfer of the LMIHF Assets from the Successor Agency to the 24 Successor Housing Agency; and 25 WHEREAS, consistent with the foregoing, this Resolution approves the Successor 26 Housing Agency's acceptance of the transfer of the LMIHF Assets from the Successor Agency, 27 which in order to be effective will require separate later approvals by the Oversight Board and DOF; 28 and 2 I WHEREAS, the form of quitclaim deed to cause the transfer of the affected real property 2 assets is included within Exhibit"B" attached hereto, which also includes a form of the certificate of 3 acceptance; and 4 WHEREAS, this Resolution has been reviewed with respect to applicability of the 5 California Environmental Quality Act (the "CEQA"), the State CEQA Guidelines (California Code 6 of Regulations, Title 14, §§ 15000 et seq., hereafter the "Guidelines"), and the City's environmental 7 guidelines; and 8 WHEREAS, this Resolution is not a "project" for purposes of CEQA, as that term is 9 defined by Guidelines § 15378, because this Resolution is an organizational or administrative 10 activity that will not result in a direct or indirect physical change in the environment, per § 15378 11 (b) (5) of the Guidelines; and 12 WHEREAS, all of the prerequisites with respect to the approval of this Resolution have 13 been met. 14 NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON 15 COUNCIL OF THE CITY OF SAN BERNARDINO ACTING AS THE SUCCESSOR 16 HOUSING AGENCY OF THE REDEVELOPMENT AGENCY OF THE CITY OF SAN 17 BERNARDINO, AS FOLLOWS: 18 Section 1. The foregoing recitals are true and correct and are a substantive part of this 19 Resolution. 20 Section 2. The Successor Housing Agency's acceptance of the transfer of the LMIHF 21 Assets from the Successor Agency to the Redevelopment Agency of the City of San Bernardino, as 22 more particularly described within Exhibit"A" attached hereto, is approved. 23 Section 3. The City Manager is authorized and directed to execute the certificates of 24 acceptance required to permit the transfer to the Successor Housing Agency of the LMIHF Assets 25 pursuant to quitclaim deeds, as more particularly described within Exhibit `B" attached hereto, and 26 is authorized to take such actions and execute such documents as are necessary to effectuate the 27 intent of this Resolution. 28 3 I Section 4. This Resolution is not a "project" for purposes of CEQA, as that term is 2 defined by Guidelines § 15378, because this Resolution is an organizational or administrative 3 activity that will not result in a direct or indirect physical change in the environment, per § 15378(b) 4 (5) of the Guidelines. 5 Section 5.
