Synopsis of Previous Council action:

STAFF REPORT
This Request for Council Action and accompanying Resolution are to amend the
legal description of the Grant Deed executed by the Mayor and City Clerk on March
22, 1995, selling the property known as 1350 South "E" Street to the San Bernar-
dino Valley Municipal Water District, and to rescind Resolution No. 95-72.
In 1955, the City of Riverside sold a portion of the property to the State of
California for the I-215 Freeway. On November 17, 1959, the City of Riverside
sold the remaining property to the City of San Bernardino. Finally, in January,
1970, the State of California condemned an extra portion of the property in
question.
Both Real Property Staff and staff from the San Bernardino Valley Municipal Water
District reviewed the previous Grant Deed. It was not until review of the Grant
Deed by the Title Officer for First American Title Insurance Company that it was
discovered that the area condemned in 1970 had not been excepted from the legal
description. The Grant Deed has now been amended to except the condemned area.
URGENCY
The Board of Directors for the San Bernardino Valley Municipal Water District has
already authorized consultants to develop plans to construct additional office
and shop facilities on the land and has requested that the Resolution authorizing
and directing the Mayor and City Clerk to execute the newly amended deed be
adopted April 17, 1995, in order to avoid delaying their building schedule.
