2 ORDINANCE OF THE CITY OF SAN BERNARDINO ADDING CHAPTER 2. 80
TO THE SAN BERNARDINO MUNICIPAL CODE TO PROVIDE FOR NOTICE TO THE
3 MAYOR PRO TEMPORE OF THE ABSENCE OF THE MAYOR.
4 THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO
DO ORDAIN AS FOLLOWS:

6 SECTION 1. Chapter 2. 80 is added to the San Bernardino
7 Municipal Code to read as follows:
8 "Chapter 2. 80
9 Absence of Mayor
10 2. 80. 010 Findings.
11 The Mayor and Common Council hereby find and declare that
12 in order to adequately fulfill the duties imposed by Section 36
13 of the Charter of the City of San Bernardino, and in order to
14 provide for the ability of the City to immediately respond in
15 case of public emergency, and in order to provide for ease of
16 communications between those responsible for the welfare of the
17 people of the City of San Bernardino, it is necessary to provide
18 that the Mayor shall notify the Mayor Pro Tempore in case of
19 absence from the City.
20 2. 80.020 Notice.
21 If at any time the Mayor anticipates that an absence from
22 the City shall exceed twenty-four hours, the Mayor shall notify
23 the selected Mayor Pro Tempore, in writing, in advance , of such
24 absence. If there is no such Mayor Pro Tempore yet selected , the
25 Mayor shall notify the City Clerk . Such notice shall contain the
26 following information:
27 1. Mayor 's destination;

1 2. Date and time of departure;
2 3. Anticipated date and time of return; and
3 4. Telephone number or numbers where the
4 Mayo-. can be reached .
5 2 . 80. 030 Effect on charter responsibilities .
6 The twenty-four hour provision in Section 2. 80. 020 shall
7 not be deemed to be an attempt to limit the Charter
8 responsibilities of the Common Council or the Mayor Pro Tempore
9 in an absence of the Mayor for a shorter duration."
10 I HEREBY CERTIFY that the foregoing ordinance was duly
11 adopted by the Mayor and Common Council of the City of San
12 Bernardino at a meeting thereof, held on

recommended acceptance of the policy proposed wy
the Acting Citv Administrator. ( Copy was attached )
2 . Hazardous ?paste Management Plan - After in
extremely thorough briefing by Mr. Stuart Long
from the =�unzy, the Committee recommended that
w�
the City avail itself of the County services and
duplicate the outstanding program already avail-
able to the citizens of San Bernardino at no
additional cost . Presently, a portion of the
refuse "tipping fee" is used to fund this
i department and they are willing to cooperate
fully with whatever scheduling the City desires
to provide a service to our citizens . Regarding
the City Yard hazardous waste facility for in-
house use , cur plan and facility will be com-
pleted by early August . The Committee was
elated ever the very positive progress made
in the hazardous waste arena .

. 3 . Hearing to Discuss Title 24 of the Cali-
fornia Administrative Code as it Relates to
the Implementation of Building Permit Fee
Increases - Ralph H. Prince - The Committee
listened to Mr. Prince ' s presentation and
recommended that no action be taken. Mr.
Prince requested the Committee ' s indulgence
in pursuing the matter. The Committee ad-
vised Mr. Prince that they would be willing
to receive any new information in writing .
4 . Pending Items - The Committee , at = e
request of the Acting City Administrator,
reviewed these items ; deleted Item 1, Under-
grounding by Edison, and Item 3 , Closed
Session Policies . Item 9 regarding tempor-
ary signs was returned to the regular agenda.
Council Member Minor made a motion, seconded by
Council Member Maudsley and unanimously carried, that the
minutes of the Legislative Review Committee meeting of May
19 , 1988 , be received and filed.
CCUNCIL MEMBER POPE-LUDLAM EXCUSED
Council Member Pope-Ludlam left the Council Meeting.
ABSENCE OF 14AYOR AND MAYOR PRO TEMPORE -
ADOPTION OF POLICY
In a memorandum dated May _0 , 1988 , Deputy City

convenience -:he elected officials . when an absence is
beyond three hours automobile drive , additional
information , such as estimated time of departure and
return and destination will be provided. In the event of
an emergency any: absence of elected officials , the chain
of command , as Set- forth in the City Emergency Plan , will
be utilized.
Council Member Minor made a motion, seconded by
Council Member Maudsley and unanimously carried, to adopt
the Policy Rel=ative to Absence of Mayor and Mayor Pro
Tempore .
COUNCIL MEMBER POPE-LUDLAM RETURNED
Council Member Pope-Ludlam returned to the Council
Meeting and took her place at the Council Table .
PERSONNEL COMMITTEE REPORT - MAY 19 , 1988 -
COUNCIL MEMBER REILLY
Council Member Reilly, Chairman of the Council
Personnel Committee, gave the report of the Council
Personnel Committee Meeting held on May 19 , 1988 . The
following items were discussed: ( 48 )
1 . Definition of Part-Time/Temporary Employees
by Civil Service - Continued. Item was referred ;
to the Civil Service Board recommending that Civil
Service Pule 502a be amended to include the in-
formation *_hat , based on a PERS letter, Extra
Board employees are not limited by the 1000 hour
maximum time rule, but rather by a two-year max-
imum. PERS has approved their exclusion from the
system removing the 1000 hour limitation. This
item will be presented to the full Council on
June 20 , 1988 ; if approved, the ordinance should
pass July 18 , 1988 , and implementation will be
effective August 20 , 1988 .
2 Unit Change Police Lieutenants - The Committee
recommended acceptance of lieutenants into the
Management Unit after receiving an opinion from
the City Attorney' s Office stating that they
could belong to both the POA and the Management
Unit at the same time. (Attachment )
3 . Request to Increase Hourly Wages of Recre-
ation Division Part-Time Salaries - Parks , Rec-
