Closed Session Report City Attorney Saenz reported the following actions: Under Agenda Item IA, existing litigation: In the matter of City San Bernardino v. U. S. Bankruptcy Court, Case No. 6:12- .Y .f P y bk-28006 MJ, the Council authorized that a letter be sent to SANBAG with respect to it's policy regarding Measure I Funds by consensus vote; In the matter of City of San Bernardino v. Mary Olea, et al. — San Bernardino Superior Court, Case No. CIVDS1515039, the Council authorized the City to enter into an Indemnity Agreement with the Title Insurance Company involved in receivership proceeding by vote of 7-0; In the matter of People of the State of California, et al. v. Lucille's Collective, et al— San Bernardino Superior Court, Case No. CIVDS 1505409, the Council gave a directive with respect to outside counsel retainer fees by vote of 7-0; Under Agenda Item 1B, anticipated litigation, significant exposure to litigation: In the matter City v. He stated that the court received objections to the revised Disclosure Statement and there would be a hearing with respect to the adequacy of the revised Disclosure Statement and status with regard to litigation on Wednesday, December 23, 2015, at 1:30 p.m. in Judge Jury's courtroom at the Riverside Bankruptcy Court. 4E. Council Member Valdivia made a motion to strike out Item No. 6, the Housing Assistance of$1,500.00 per month. The motion died for lack of a second. Brandon Mims, Deputy Director of Housing, indicated that this item was before Council because the City had additional Emergency Shelter Grant funding. He stated that Catholic Charities, Time for Change Foundation, and Central City Lutheran Mission were the three agencies which submitted proposals this round. Mr. Mims advised the City Council that Emergency Shelters were different than what the City was doing with the Access Center. He indicated that Emergency Shelters typically have their own operational plans and these proposals which were submitted are essentially for the agency's operations. Mr. Mims explained the different options for funding. She indicated that she was reviewing the final draft and had sent the auditors a few changes. She also stated that FY 2013/2014 would be complete by the end of the 2015 calendar year. Public Comments: Scott Olson, San Bernardino Motion: To continue to fund the operations of the San Bernardino Employment and Training Agency (SBETA) using City funds for three (3) months. Brandon Mims Deputy Director of Housin g, indicated that this program was largely due to correcting Code deficiencies which the business owner would have to do. Mayor and Common Council of the City of San Bernardino Page 12 Printed 111312015 Joint Regular Meeting Minutes December 21, 2015 Bill Manis, Deputy City Manager, explained that a former HUD employee was going to come in and assist in tightening up the City's housing program in regards to the allocation of funds. Council Member Valdivia made a motion to award $74,000.00 to the Norse Corporation for Improvements to Jovi's Diner. The motion was seconded by Council Member Nickel. No vote was taken. Council Member Valdivia made a substitute motion rejecting all bids, start the process over, and bring back at a later date. The motion was seconded by Council Member Nickel. She stated that they needed a building to showcase the Talent Show and asked the Mayor and City Council to assist them in locating a building. Jim Mulvihill, San Bernardino, wanted to alert the public that the comment period for the scoping session of the North-South project, otherwise, known as So Cal Pipeline, had been extended to January 18, 2016. He stated that the issue he had with it, was that the consultants who sent out the announcement had a return address of North-South Project in care of Ecology and Environment, Inc., San Francisco. He stated that written comments that were submitted during the Public Scoping meetings held on October 27, 28, and 29 in San Bernardino, Hesperia, and Moreno Valley had been misplaced, therefore, if individuals previously submitted written comments, they would have to resubmit. He stated that all comments previously received would be posted on the project website at the California Public Utilities Commission. Mayor and Common Council of the City of San Bernardino Page 13 Printed 111312015 Joint Regular Meeting Minutes December 21, 2015 Betty Jean Long, San Bernardino, asked that the public remember the homeless this holiday season. She stated that bags filled with toiletries, instant coffee, granola bars, bottled water, food gift cards, and bandages would be helpful to those people who are living on the streets. James Penman, San Bernardino, spoke about a quote from City Manager, Allen Parker which he read in the San Bernardino Sun Newspaper. He told the Mayor and City Council that they came through like champs at one of the worst times of our City's histories on December 2, 2015. He stated that the Mayor and City Council made all of those people watching television proud to be from San Bernardino. He said that the Police Department was great, as well as the Swat Team, and the Fire Department's response was fantastic. He stated that in the 26 years that he was City Attorney, no Mayor, City Council, or Police Chief that he had ever worked with could have done a better job than they did. Rory Murray, San Bernardino, said he wanted to echo Mr. Penman's comments. He stated that the Candlelight Vigil on December 3, 2015 inspired him to write his song, "We will Rise" and thanked the Mayor and City Council for receiving it so well at the last City Council meeting of December 7, 2015. He announced that the song had been recorded and produced by Dennis Hackett and was available to listen to and download at cdbaby.com. He also wanted to thank Mr. Hackett, his son James, Gina, and all of the singers and musicians that performed on the song. Penny Li, Cultural and Art Limited Company, China, said she traveled to San Bernardino to introduce herself and her company to the Mayor and City Council. She r said she hoped to engage the City with cultural projects in the future. She indicated that Mr. Keith McCarter had provided all of the documentation concerning the proposal for the Sister City Program with China to allow international exchange participants to volunteer in the City for the purpose of sharing their language and culture. She asked that the Mayor and City Council support the New International Business Expo project for the purpose of building strong business relationships between the small businesses here in America and China. Jay Lindberg, San Bernardino, spoke about how effective the FBI investigation was going to be in the December 2, 2015 shooting. He spoke about people that were investigating terrorist organizations in this Country and that nothing could be found as far as assessments were concerned. He stated that the City and the State needed to kick the FBI to the curb on this investigation. Laurie Stalnaker, San Bernardino, thanked the Mayor and City Council for their patience and efforts in assisting in the battle with the Workforce Investment Boards and SBETA. She stated that she was a long time member of the SBETA Board and stated that SBETA did a wonderful job. She spoke about the statewide Workforce Investment Board panel meeting held on Friday, December 18, 2015 and also spoke about the audits. She said that she was confident that the Workforce Investment Board was going to follow through. Q Mayor and Common Council of the City of San Bernardino Page 14 Printed 11132015 Joint Regular Meeting Minutes December 21, 2015 Karmel Roe, San Bernardino, wanted to thank Council Member Nickel for listening to his constituents. She stated that she believed the City wasted a lot of money on consulting services. She said that she served the City documentation regarding violation of the Brown Act and wanted the City Council to reconsider paying the $229,000 to Allen Parker. She asked that the City Council make better choices in 2016. Shirley Harlan, San Bernardino, read a letter she wrote about City Manager, Allen Parker leaving the City and stated that it was not in the City's best interest to let experienced staff leave. Jim Smith, San Bernardino, complimented the Mayor and City Council on how they handled the terrorist situation and thanked them for their leadership. 9. Items to be Referred to Council Committees Council Member Nickel requested an update on the status of the City's storm drain program and preparation for major weather events. Council Member Johnson said he would like to see a defined procedure on when items from the City Council come back with some kind of status report. 10. Announcements from Mayor, Common Council and Executive Staff The Mayor read a letter from an unanimous senior citizen from Illinois regarding the December 2, 2015 shooting incident. This individual made a contribution of$20.00 on behalf of friends in Illinois. She also sent accolades to the Police Department. 11. Adjournment The meeting adjourned at 8:07 p.m. The next joint regular meeting of the Mayor and Common Council and the Mayor and Common Council Acting as the Successor Agency to the Redevelopment Agency is scheduled for 2:00 p.m., Monday, January 4, 2016.
