The proposed purchase is for header cut and cold planing services
to be utilized in conjunction with Public Services/Street
Department asphalt resurfacing.
Header cut and cold planing (asphalt milling) is a mechanized
method for milling existing asphalt surfaces adjacent to gutters at
the beginning and ending points of asphalt resurfacing. Milling
provides improved roadway riding qualities and improves the bond of
existing surfaces and enables street sweepers to effectively clean
gutters following resurfacing. In consideration of milling cost,
only arterial roadways are included in this process. Residential
roadways are not milled.
At the request of the department, appropriate specifications were
prepared, published and furnished to area suppliers. Bids were
publicly opened and declared on October 5, 1993 . The following is
a summary of bids received.

Nineteen (19) vendors supplying this service were solicited. The
City received four (4) responses. One was a no bid and three (3)
were valid bids. The planing (grinding) of asphalt concrete
surfaces shall occur on streets in all wards.
Specifications as bid have been reviewed with the Public Services
Director who concurs that the bid of Pavement Recycling Systems
meets specifications and requirements. It is therefore recommended
that the bid be accepted for contract. The funding is in the
1993/1994 budget.

2 RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING THE
EXECUTION OF AN AGREEMENT BETWEEN THE CITY OF SAN BERNARDINO AND
3 PAVEMENT RECYCLING SERVICES RELATING TO HEADER CUT AND COLD
PLANING SERVICES FOR STREET RESURFACING PURPOSES.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF
5 SAN BERNARDINO A FOLLOWS:
6 SECTION 1. The Mayor is hereby authorized and directed to
7 execute, on behalf of said City, an agreement between the City of
8 San Bernardino and Pavement Recycling Services, relating to Header
9 cut and Cold Planing Services for street resurfacing purposes, for
10 the total amount of $29 , 227 .43 . A copy of said agreement is
11 attached hereto and in corporated herein as Exhibit "A" .
12 SECTION 2 . The authorization to execute the above
13 referenced Agreement is rescinded if the parties to the Agreement
14 fail to execute it within sixty (60) days of the passage of this
15 Resolution.

AGREEMENT
THIS AGREEMENT is entered into between E 2

"CONTRACTOR") and the CITY OF SAN
BERNARD1INO ('CITY")....
WITNESSETH:
A. WHEREAS, CITY has need for header cut and cold planning
services within the CITY and,
B. WHEREAS, CONTRACTOR is competent, experienced and able
to perform said services: and,
C. WHEREAS, CONTRACTOR has provided the lowest responsible
bid for the providing of such services;
NOW THEREFORE, the parties hereto agree as follows:
1. CONTRACTOR shall furnish header cut & cold planning
services to CITY in accordance with Bid Specifications F-94-09.
2 . Over the term of this Agreement, CONTRACTOR shall be paid
for such services an amount in accordance with Bid Specification
F-94-09 Bidder's Proposal and Statement.
3. CONTRACTOR shall provide the Public Services/Street
Department with a monthly invoice in arrears and shall be provided
payment within thirty (30) days therefrom. CITY retains the right
to challenge all or any part of an invoice.
4. The term of this Agreement shall be one (1) year from the
date first above shown.
S. CONTRACTOR agrees to defend, indemnify, save and hold
CITY, its officer, agents and employees harmless form any claims or
suits that may be brought by third persons on account of personal
injury, death or damage to property or a property or business or

personal interest, arising from any negligent act or omission by
contractor while performing services under this Agreement.
6. While not restricting or limiting the foregoing, during
the term of this Agreement, contractor shall maintain in effect
policies of comprehensive public, general and automobile liability
insurance, in the amount of $1, 000, 000. 00 combined single limit,
and statutory worker's compensation coverage, and shall file copies
of said policies with the CITY'S Risk Manager prior to undertaking
any work under this Agreement.
7. CONTRACTOR shall perform work tasks as directed by the
Public Services/Street Department, but for all intents and purposes
contractor shall be an independent contractor and not an agent or
employee of the CITY.
8. In the performance of this Agreement and in the hiring and
recruitment of employees, contractor shall not discriminate on the
basis of race, creed, color, religion, sex, physical handicap,
ethnic background or country of origin.
9. Any notice to be given pursuant to this Agreement shall be
deposited with the United States Postal Service, postage prepaid
and addressed as follows:

OF SAN BERNARDINO FOR UNCOLLECTED BUSINESS REGISTRATION FEES.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
4 CITY OF SAN BERNARDINO AS FOLLOWS:
5 SECTION 1. The City of San Bernardino, pursuant to its
6 authority under San Bernardino Municipal Code Chapter
7 5. 04 . 076 does hereby impose liens on the real property
8 described as Exhibit "A" , attached hereto and incorporated
9 herein by reference, for uncollected business registration
10 fees and all future fees and penalties.
11 Due notice was given to the person or persons having an
12 interest in said property and a hearing was held by the Mayor
13 and Common Council to hear protests and to assess the fees
14 imposed on said property.
15 SECTION 2 . The matter having now come before the Mayor
16 and Common Council for confirmation of the imposition of the
17 liens imposed, the following fees are found to have been
18 uncollectible after proper notification to the
19 property/business owner pursuant to proceedings under said
20 provisions of the San Bernardino Municipal Code. The
21 statements of fees on file with the City Clerk are hereby
22 confirmed and adopted as special assessments against the
23 properties listed on Exhibit "A" hereto.

3 SECTION 3 . The City Clerk is hereby directed to file a
4 certified copy of this resolution with the Auditor of the
5 County of San Bernardino, State of California, directing the
6 said sum be entered as lien charges against said property as
7 it appears on the current assessment rolls, to be collected
8 at the same time and in the same manner, subject to the same
9 penalties and interest upon delinquencies, as the general
10 taxes for the City of San Bernardino are collected. The City
11 Clerk shall present for recording appropriate notices of the
12 imposition of these liens with the County Recorder.
