Description) Assessment District No. 947 (Central City Parking District) Finance: Council Notes: a&lq S q/i, o?oR o. 7 /sl91G (07-15-96) Agenda Item No. Q & A T/3 CITY OF SAN BERNARDINO - REQUEST FOR COUNCIL ACTION STAFF REPORT The Central City Parking district was formed in 1977 to provide for the acquisition and improvement of the three downtown City Parking Lots #1, #2 and #3 and to provide for the ongoing maintenance, operation and security of the three lots. The Redevelopment Agency sold bonds in the amount of $1,950,000 to provide funds for the acquisition and improvement of the three lots, with a twenty-five year payback. The District leases the lots from EDA for the amount of the annual debt service on the bonds. Upon payoff of the bonds, title for the three lots will transfer to the City. The final bond payment is scheduled to be made in FY 2001/02. In 1979, it was determined that additional parking facilities were needed. The funds for the expansion were loaned to the District from the City's General Fund in the amount of $812,763.45 with a 28 year payback. The lease payment (bond debt service) along with the maintenance, operation and security costs and administrative costs comprise Assessment Roll No. 1. Credits are given for 75% of the area tax generated along with payments from EDA of the last assessment of those parcels acquired by EDA within the district. These credits are applied to the assessment amount as a whole. Property owners are also given individual credits for 75% of the area tax generated by their property along with a $60 credit for each parking space provided on their respective parcels. The total assessment amount also includes an annual amount of$8,100. This amount was paid to the Masonic Lodge for lease of their property to provide additional parking in the district. Once the lease terminated, it was determined that this amount would be continued to be assessed as payment towards the City's loan. Assessment Roll No.2 is a fixed total assessment to provide for payback of the City loan. Additional revenues generated to pay back the loan are comprised of the $8,100 stated above, and from leases of the parking spaces within any of the City lots for private use. The attached summary shows the total assessment amounts for Roll 1 (Acquisition & Improvements and Maintenance, Operation and Security) and Roll 2 (Expansion of Facilities). The assessment rolls were approved by the Parking Place Commission at their May 16, 1996 meeting. Assessments are apportioned based upon a rate which is determined by the assessed value of each parcel within the district( land only). Credits are then applied to each parcel (Roll No. 1 Only) to determine the assessment amounts. No credits are applied to Roll No. 2. Out of the 109 assessments within the district, 67 of these are increasing from last year's assessment. Overall, there is an increase if $3,292 for the total assessment amount. This is primarily due to an increase in the scheduled bond payment amount and a decrease of credits over last year. As required by law, a public meeting and public hearing must be held before any new or increased assessments can be levied. All property owners with increased assessments were given mailed notice of the Public Meeting and Public Hearing. On July 1, 1996, a Public Meeting was held to receive comments and answer questions relative to the proposed assessment roll and protests carried over to the July 15, 1996 Public Hearing. We recommend that the Public Hearing be closed and that protests, if any, be overruled and that the 1996/97 Assessment Rolls (Roll 1 and Roll 2 ) be confirmed. Bonds were sold to fund the acquisition and improvement costs. Bond payments, along with the maintenance and administrative costs, less contributions made by the City and payments made by EDA for parcels acquired in the district comprise your annual assessment for Assessment Roll No. 1. In 1979, additional funds were needed to expand portions of Lots #2 and #3. These funds were loaned to the District by the City, and is paid back as Assessment Roll No. 2. The assessment amounts are apportioned to the various parcels in the district based on the assessed value of the parcel (land only). Certain parcels are given credit for a portion of the area tax generated by that parcel, along with credit for any parking spaces on that parcel. Credits are not given for parking spaces leased out of Parking Lots 1, 2 or 3. Any credits given are reapportioned as a cost to the district. Your annual assessment will vary from year to year, based upon all of these factors. The total amount for Roll 1 increased from 5151,553 last year, to 5154,545 this year due to an increase in the bond payment (as stated in repayment schedule) and a decrease in contributions. The total of Roll 2 is the same each year, $30,300. After the close of the hearing, the City Council will take action on the proposed assessment rolls. Written protests on the increase from any property owner liable to be assessed for the maintenance costs, must be filed with the City Clerk at the above address, prior to 10:00 AM on July 15, 1996. Protests must contain a description of the property, sufficient to identify such property. In the event that protests are made by owners representing more than 50% of the total sum of assessment amounts within the district, the Council may overrule such protests by a 415ths affirmative vote of the members of the Council present and voting. I very much oppose a raise in Assessment on ray Property,Nr . 0134-121-20 on "E" Street . When I was Vice-Chairperson of Mainstreet Project, Mr . Sam Henley,was appointed the Business Recruitment Chairman for Mainstreet Project to bring Business down to "E" Street-He resi_gned,because absolutely nothing was done . I inherited his position and formed a dynamic Committee of Developers , q Realestate and Businesspeople to get the project going. We intended to build aBuilding for 3 or 4 Stores on our Property. I already had a Mens ,Ladies, Shoe or Jewelry Store tenants committed. I worked hard to get other Stores on "E" Street , sueh as international Restaurants, Sports and Yardage Stores ,who gave me verbal committments!to come to "E" Street, if I _could send them an official plan,whic-h I asked for but rnever got . In fact my committee and I were very much discouraged from doing anything as we are nothing more than a Bread and Buttertown,that could not afford to support a Mainstreet project - I and - e were told. I called the '! National Mainstreet Protect Association in Sacramento. They very much disagreed, as they felt that San Bernardino was much better off than other cities in California who were very successful .We lost our tennants for our Store,when they came to visit "E" Street and did not like what they saw. I have lost the expected income for my retirement,that we had planned. I had nothing but expenses as I said for up-keep and Taxes of $ 2 .959 . 55 annually.
