STAFF REPORT
BACKGROUND
On August 18, 1995 subsequent to an inspection, the owner of record,Norma Gifford, was issued
a Notice and Order (attachment A) for violations on the subject property. At that time the
dwelling and garage were found to be open and unsecured with evidence of unauthorized entry.
The owner's agent took action to board and secure the property.
On January 23, 1996, in response to a complaint from police dispatch, a reinspection of the
property found that the boards had been removed and signs of continuing unauthorized entry
were present. The owner's agent, Earl Capel, was notified that the building again required
boarding, but failed to respond. On February 3, 1996 the buildings were secured by a contractor
hired by the City.
On March 7, 1996, a hearing was held before the Board of Building Commissioners. The Board
confirmed the costs incurred by the City for the board-up and issued Order No. 3231 (attachment
C) requiring the owner to correct all violations within 90 days
On April 12, 1996 an appeal of BBC Order No.3231 was filed by Helen C. Kern/Modes.
ANALYSIS
The appellant states that they were not given adequate notice to secure the structure before the
City's action, and therefore should not be charged for these costs. The San Bernardino Municipal
Code, Section 15.28.140, gives the Building Official summary power to secure from entry any
open and vacant structure determined to pose a hazard to the public. In such cases, the Building
Official is required to give notice immediately following the action. In this case we attempted
to work with the owner's agent in the hope that they would maintain the property
in a secure manner. When they became unresponsive following repeated break-ins, the
Department took action to secure the structures. This action was based on reports and visual
evidence that unauthorized entry by adolescents was occurring.
STAFF RECOMMENDATION
That the Mayor and Common Council uphold Order No. 3231 of the Board of Building
Commissioners and deny the appeal.

Dear Norma Gifford:
An inspection of the above referenced property in accordance with the San Bernardino Municipal
Code, Section 15.25.040, was conducted on August 9, 1995 in conjunction with the City's
Rental Housing Inspection Program. You are hereby notified that the following violations of
the San Bernardino Municipal Code (SBMC) exist on this property. Due to the existence of
these violations, the Building Official has determined that the property/structure(s) are
Substandard pursuant to the Uniform Housing Code.
Exterior
1. Lack of Required Landscaping, or Unmaintained Landscaping.(SBMC 15.24.040A1,
15.24.050A1). Regular irrigation and maintainance required in all yards.
2. Weeds and/or Overgrown Vegetation.(SBMC 15.24.040A3, 15.24.050A3). Removal of
weeds, cutting of grass, and trimming of all overgrown trees and shrubs required on
property.
3. Accumulation of Trash and Debris in Yards.(SBMC 15.24.040A4, 15.24.050A4).
Wood, paper, plastic, and broken concrete.

at south side of property.

6. * General Dilapidation or Improper Maintenance. (SBMC 15.04.020, UHC 1001(b)13).
House and garage are in serious deterioration, due to neglect.
7.* Substandard or Hazardous Plumbing.(SBMC 15.04.020, UHC 1001(f)) Vent above
cleanout at exterior back of house needs replacing. Vent is currently missing.
8. * Deteriorated or Inadequate Foundation.(SBMC 15.04.020, UHC 1001(c)1). Foundation
showing signs of cracking and deterioration.
9. * Deteriorated or Defective Structural Elements.(SBMC 15.04.020, UHC 1001(c)2 thru
9).
A. Deteriorated porch at south side of house is in a state of partial collapse.
B. Roof system is deteriorated and failing in several locations at house and garage.
The roofs are overstressed and sagging, and the rafter tails and roof sheathing are
deteriorated at the eaves.

12.* Construction Without Required Permits or Inspections.(SBMC 15.04.020, UAC 301(a)
and 305). Porch cover off south side of house (4ft. x 15ft.).
A Special Investigation must be obtained and completed prior to submitting an application
for a building permit for an unpermitted structure. A Special Investigation can be
obtained by submitting an application and the appropriate fee at the Planning and
Building Services Department counter on the 3rd Floor of City Hall, located at 300 North
'D' Street.
13. Public Nuisance.(SBMC 8.30.010). This property is a visual blight in the community.
14. Dangerous Building-Attractive Nuisance. Abandoned and/or unsecured structure which
constitutes an attractive nuisance to children, or a harbor for vagrants or criminal
activity. The building must be secured. On a temporary basis, the building may be
boarded to FHA standards.(SBMC 15.28.010, UCADB 302.12 and 302,18). House is
partially secure, but is required to be completely secured. Garage to be completely
secured from entry.
15.* Electricity and gas utility companies have been notified to disconnect at this address.
A permit and inspections are necessary before utilities will be released. This process is
necessary to insure safe operation and compliance with state and local codes.
The above listed violations must be corrected within 10 days (i.e. by August 28, 1995). Failure
to make the necessary corrections will result in the City initiating abatement proceedings to
I correct the violations. If the City is forced to proceed with abatement proceedings, the owner
of record shall incur all City costs associated with the abatement. Such costs may include,
I but are not necessarily limited to contractor costs, staff and administrative costs, mailing and
photographic costs, hearing costs, et cetera. Such costs become the personal obligation of the
property owner, and if not paid may result in a lien being placed against the property. In
addition, a Notice of Pendency will be recorded with the County Recorder's Office.
By acting immediately to correct the above listed violations, these costs may be avoided. If you
object to the determination of this notice regarding the listed violations, you may file a written
appeal with the City Clerk within 30 days from the date of this notice. Such written appeal
should include 1) the specific action appealed, 2) the specific grounds for appeal, and 3) the
relief or action sought. Appeals will be heard by the Board of Building Commissioners at a
public hearing.

THIS NOTICE is hereby served to you as owner or interest holder of the above referenced
property. An inspection of this property on August 9, 1995 revealed conditions which presented
a hazard to the health and safety of the public. In order to protect the public, the Building
Official has taken summary action to abate the hazardous conditions on the property. The
hazardous conditions which required abatement and the actions taken are as follows:
1. Dangerous Building-Attractive Nuisance. Abandoned and/or unsecured structure which
constitutes an attractive nuisance to children, or a harbor for vagrants or criminal
activity. The building must be secured. On a temporary basis, the building may be
boarded to FHA standards. The owner must obtain all necessary permits and rehabilitate
the structure, or demolish within 6 months. Failure to rehabilitate or demolish within
6 months will result in action by the City to abate the abandoned building as a public
nuisance. (SBMC 15.28.010, UCADB 302.12 and 302.18)
Summary action has been taken at the house and garage to board and secure these
structures from entry as ordered by the City.

A hearing in regards to this abatement action has been scheduled for THURSDAY. March
7, 1996 at 9:00 A.M. before the Board of Building Commissioners, at 300 North "D" Street,
City Council Chambers, San Bernardino, California, 92418. Evidence will be presented by
staff at this hearing pertinent to the summary action and the costs of abatement incurred by the
City. You may be, but need not be, represented by legal counsel. You may present any relevant
evidence or have witnesses testify at this hearing to challenge the abatement.
A "Notice of Pendency/Notice of Substandard or Dangerous Building" has been filed with
the County Recorder to give public notice of the action taken by the City. A processing fee is
automatically assessed at the time of recordation.
The direct costs incurred by the City for this abatement action are attached for your review. If
the abatement action and costs are upheld by the Board of Building Commissioners, the City will
place an assessment lien on the above referenced property for all costs incurred. To avoid the
placement of a lien, the incurred costs must be paid to the City Clerk's Office at 300 North
D Street, Second Floor, San Bernardino, California, 92418, within 15 days from the date
of the Board of Building Commissioners ruling.

If you disagree with the decision of the Board, you may appeal your case before the Mayor and
Common Council. Your appeal must be submitted in writing to the City Clerk within 15 days

and the relief or action sought from the Mayor and Common Council.

3 NOW THEREFORE, IT IS ORDERED BY THE BOARD OF BUILDING
4 COMMISSIONERS OF THE CITY OF SAN BERNARDINO AS FOLLOWS :
5 SECTION 1 - FINDINGS :
6 Based upon the evidence submitted, the Board finds that the
7 violations noted in the Notice of Hearing do in fact exist on the
8 Pro_erty loca::ed at 2414 N. Sierra Way, San Bernardino, California
9 and is being maintained in violation of SSMC, and therefore
10 constitutes a public nuisance .
11 SECTION 2 - ORDER:

14 with the following requirements : that the property owner *correct
15 all violations under permit as stated in the Notice of Hearing

18 15 . 28 . 010 , UCADB 302 , 12 & 18 (structures boarded beyond six
19 months) , and; that the property owner shall obtain permits to
20 rehabilitate or demolish the boarded structures within thirty (30)
21 days, and complete rehabilitation or demolition within ninety (90)
22 days, and that this matter be set for rehearing before the Board
23 if compliance is not obtained within ninety (90) ' days from the
24 date of this order. The property owner shall meet all applicable
25 codes adopted by the City of San Bernardino.

3 SECTION 3 - AUTHORIZATION TO ABATE:
4 Upon the property owner of record' s failure to comply with the
5 order of the Board of Building Commissioners' , the City may
6 proceed to initiate abatement action by obtaining an
7 Inspection/Abatement warrant to abate violations noted.
8 SECTION 4 - CONFIRMATION OF INCURRED COSTS :
9 The Board determined that the City4 was required to initiate
10 abatement proceedings and incur costs in the amount of $2783 . 90 .
11 These costs and any future additional abatements shall be the
12 personal obligation of the owner and, if unpaid, shall be recorded
13 as a special assessment on the county tax record.
14 SECTION 5 - RIGHT TO APPEAL:
15 Any person aggrieved by this order, may appeal to the Mayor and
16 Common Council by filing a written statement with the City Clerk.
17 The statement must include the order appealed, the specific
18 grounds of the appeal, and the relief or action sought . This
19 written appeal must be received within fifteen (15) days from the
20 date of this notice dated March 29, 1996 .

A hearing was held on 3/7/96 regarding the above property. The previous notice had
given us six months to repair or demolish the property in question. Mr Earl Capel
(receiver) appeared on my behalf as I was required to work. He was asking for an
additional 90 days over and above the six months. He also questioned the boarding of the
house when it fact it was already boarded at our expense. He explained the this property
had been tied up in litigation that had involved a very lengthy civil suit that had tied our
hands from entering the property. My children and I had to stand back and watch it being
destroyed little by little. On one occasion I called the police as a prior tenant was
removing the washer , dryer, alarm system, etc. and because I could not show proof of
ownership, the officer could do nothing. The no good kids of this area continued to
destroy and since then little by little continue to trash the property. An 8 hours notice was
posted to secure the back window, a board had been removed , Mr Capel replaced the
board and called the abatement office and told them that it was secured as myself and
children do work and 8 hours is hardly fair notice. My daughter, son inlaw and I arrived
at the house on that Sunday A.M to work on the yard and found that all the board had
been removed and reboarded by the city Saturday A.M. To board the way they did it
every window in the house had to be broken, and there was glass everywhere. As to who
broke all the window I do not know, but my sons did the boarding the way they did so all
the windows would not have to be broken. I realize that this property is an eyesore,
however all I have tried to do is probate my father-inlaws will as was his wish. Since both
of his sons have died during this litigation. My son had loaned his father$10,000 and he
was to be paid back out of the sale of the property.
I believe an eight hour notice is most unfair. The cost involved in re-boarding the house
and then give a 90 day notice to demolish is most unfair to the tune of$2783.90. I would
like this looked at very closely. I have lived here since 1953, my husband was born and
raised here and our six children were born here and are tax paying citizens of this country
They are entitled to a fair shake fair shake.
I have attached a list of cost which do not included those paid by Great Western Title.
