CITY OF SAN BERNARDINO - REQUEST FOR COUNCIL ACTION
STAFF REPORT
Section 8.24.190 of the San Bernardino Municipal Code states that it is unlawful for any person,
firm or corporation to collect refuse within the City of San Bernardino without having first
secured the necessary permits or contract agreements. Certain exceptions are allowed,
specifically, any refuse business that has been collecting accounts served since August 28, 1967
may continue to serve those accounts.
In late 1994, the City began negotiating with the four private refuse haulers operating within the
City in order to implement the appropriate franchise agreements. In May 1995, the City entered
into franchise agreements with two of the four private haulers, Jack's Disposal Inc. and Curran's
Disposal. The City continued to negotiate agreements with the other two haulers, Browning
Ferris Industries (BFI) aka Loma Linda Disposal, and Cal's Disposal.
On May 16, 1996 BFI advised the City via letter, that BFI did not wish to enter into a franchise
agreement, and requested that the City serve BFI with a five year notice to terminate operations
within the City. At the end of this period, all residential and commercial accounts will transfer
to City service.
Staff recommends adoption of the attached resolution providing five year notice to terminate to
BFI.

Dear Mr.Howell:
BFI appreciates the opportunity to enter into an agreement with the City of San Bernardino for residential
and commercial refuse service. Unfortunately,the$21,000 in accrued franchise fees were never passed onto
our customers. For BFI to absorb this amount over an eight year period,it would not make business sense
considering the small amount of customers we have.
It is our intent for the City of San Bernardino to serve BFI a five year notice. BFI will abide by that notice
and all commercial and residential refuse accounts will revert to city service upon expiration.
Should you reconsider the accrued franchise fee issue,BFI would be willing to enter into a mutually agreed
upon contract and pay current franchise fees.
