Description) Finance: Council Notes: �3 L?( 75-0262 Anenrin Item Nn �7 I CITY OF SAN BER►NARDINO - REQUEST FOR COUNCIL ACTION STAFF REPORT A letter has been received from Pastor Mitchell Harris , of Mt. Rose Ministries, requesting authorization to encroach into the street right-of-way with a mansard type roof. This mansard will be constructed as a part of their proposed renovation of the existing building at 1457 Mt. Vernon Avenue. A copy of this letter is attached for reference. There is an existing canopy along most of the Mt. Vernon Avenue frontage. This canopy extends a distance of 4 feet from the building and is at a height of 8 ' - 6" above the sidewalk. It is planned to add a mansard roof to this canopy, and to extend it along the Magnolia Avenue frontage. Authorization for a private facility to encroach into a street right-of-way is normally granted by a standard form License Agreement. This Agreement will provide, in general , that the mansard roof can encroach into the street right-of-way for Mt. Vernon Avenue and Magnolia Avenue, and that the City reserves the right to terminate the permission by giving 30 days written notice. All construction will be done in accordance with all applicable City codes. A provision is included in the standard form agreement that the Licensee will furnish the City with a certificate of insurance in the amount of $1 , 000 , 000 . An administrative fee of $500 is normally paid by the applicant to cover the City ' s processing costs. After reviewing this application for encroachment, we have concluded that it will not adversely affect the public ' s use of the street rights-of-way. Our Church, which is located in an area that has created a great "thirst" for a more modern, contemporary look, is a prime target for such renovations. As a new ministry in the westside redevelopment district, we are seeking an opportunity to add a fresh design that will Visually enhance our surroundings. Due to an existing potential limitation, We are humbly asking for an encroachment permit, to utilize an existing overhang, which projects over City owned property. Your approval will allow us to quickly move forward with the building upgrade, which will certainly, uplift the spirit of our congregation.
