STAFF REPORT
BACKGROUND
On December 5, 1995, the Neighborhood Services Team received a complaint from the Police
Department alleging numerous code violations, drug trafficking and prostitution at the Lone Star
Motel located at 1670 North Mt. Vernon. A warrant was obtained and a joint inspection was
conducted by the Fire Department, Planning and Building Services Department, and the City
Attorney's Office on December 7, 1995. On the same date, an Evacuation Order was issued
by the Fire Marshall due to numerous fire and life safety violations. The property owner,
Suryakant Patel was present and was notified. Due to the owner's failure to comply with the
order, the City had the building vacated, boarded and secured on December 8, 1996.
On December 21, 1996, the City Attorney's Office obtained a Preliminary Injunction in the San
Bernardino Superior Court preventing reoccupancy of the building due to the existing code
violations, as well as drug and prostitution activity. A permanent injunction preventing
reoccupancy for at least one year was granted by the court on January 8, 1996.
On February 1, 1996, a hearing before the Board of Building Commissioners was held regarding
the costs of abatement incurred by the City in abating the nuisance existing on the property. A
Notice of Hearing (Attachment A) was posted on the property, and a copy was sent by certified
mail to the owner and all interest holders. The copy sent to the owner was returned unclaimed
(Attachment B). The owner did not appear at the hearing, and the Board confirmed the costs
of abatement.
Anal
In his appeal, the owner claims that he was not notified of the hearing before the Board of
Building Commissioners, and therefore requests that the council waive the incurred costs. The
owner was notified via certified mail as required by the SBMC 15.04.020, UHC 1101(d). This
constitutes legal service of the Notice of Hearing, regardless of the fact that the owner failed to
claim his mail. Therefore, the action of the Board of Building Commissioners is valid.
STAFF RECOMMENDATION
That the Mayor and Common Council uphold Order No. 3156 of the Board of Building
Commissioners and deny the appeal.

In reguards to the hearing before the Board of Building Commissioners on February
01,1996. I was not aware, nor was I notified in any manner of the meeting that was
scheduled on that date and time, as I would have had Mr. Les Holmes, my agent to be
present and represent me in reguards to this matter, had I been notified of the hearing.
Mr. Les Holmes has had the property fenced, and posted the property with signs stating as
follows: NO TRESPASSING OR LOITERING ALLOWED ON THE PREMISSES. S B M
C 9.52.070 P C 602. Mr. Les Holmes has also notified the San Bernardino Police
Department with a Letter dated 01-22-96 authoriziation the San Bernardino Police Dept. to
act under PROVISIONS of the CALIFORNIA PENAL CODE and SAN BERNARDINO
CITY MUNICIPAL CODE. See attached hereto and labeled exhibit A.
Mr. Les Holmes is in the process of reaching a settlement with the Insurance Co. within
the next 30 to 45 days. Within a reasonable period of time after the settlement, it is my
intent to obtain a demo permit to have complete demolition of the buildings.
Under the circumstances, as stated above, I ask and pray to the Board of Building
Commissioners that you reconsider and waive the $2,104.44. My INTENT IS TO
COMPLY AND RESOLVE THIS MATTER AS SOON AS POSSIBLE.

THIS NOTICE is hereby served to you as owner or interest holder of the above referenced
property. An inspection was made by the Neighborhood Services Team of this property on
December 7, 1995 & January 5 1996, revealed conditions which presented a hazard to the
health and safety of the public. In order to protect the public, the Building Official took
summary action to abate the hazardous conditions on December 8,1995 & January 6, 1996.
The hazardous conditions which required abatement and the actions taken are as follows:
1. SBMC 15.28.010, Uniform Code for the Abatement of Dangerous Buildings
(UCADB), Section 302.12 and 302.18 - Dangerous Building. The structure(s) were
found to be vacant and unsecured.
Action Taken: To prevent vandalism and unauthorized entry, structure(s) have been
secured to FHA Board-Up Standards.

In addition, the owner(s) shall keep the structure(s) secured from unauthorized entry. Submit the
necessary plans for the rehabilitation of the structures to the Planning and Building Services
Department counter on the 3rd floor of City Hall, located at 300 N. "D" Street. Obtain all
necessary permits for the rehabilitation of the structure(s) and obtain a Certificate of Occupancy
prior to re-occupying any of the motel units, or demolish the same. Due to the fact that a
Preliminary/Permanent Injunction has been filed on the property By the San Bernardino Superior
Court in case No. SCV 26006. The Honorable Joseph E. Johnston, Judge of the San Bernardino
Superior Court ordered the property closed for a period of one (1) year on January 8,1996. At
which time the City may take action to correct any/all of the outstanding violations.
A hearing in regards to this abatement action has been scheduled for THURSDAY.
February 1, 1996 AT 9:00 A.M. before the Board of Building Commissioners, at 300 North
"D" Street, City Council Chambers, San Bernardino, California, 92418. Evidence will be
presented by staff at this hearing pertinent to the summary action and the costs of abatement
incurred by the City. You may be, but need not be, represented by legal counsel. You may
present any relevant evidence or have witnesses testify at this hearing to challenge the abatement.
A "Notice of Pendency/Notice of Substandard or Dangerous Building" has been filed with
the County Recorder to give public notice of the action taken by the City. A processing fee is
automatically assessed at the time of recordation.
The direct costs incurred by the City for this abatement action are attached for your review. If
the abatement action and costs are upheld by the Board of Building Commissioners, the City will
place an assessment lien on the above referenced property for all costs incurred. To avoid the
placement of a lien, the incurred costs must be paid to the City Clerk's Office at 300 North
D Street, Second Floor, San Bernardino, California, 92418, within 15 days from the date
of the Board of Building Commissioners ruling.
If you disagree with the decision of the Board, you may appeal your case before the Mayor and
Common Council. Your appeal must be submitted in writing to the City Clerk within 15 days
of the Board's ruling. A fee of$75.00 must accompany your appeal. Your written appeal must
include the case number, property location, the specific items appealed and grounds therefore,
and the relief or action sought from the Mayor and Common Council.

4 WHEREAS, pursuant to the San Bernardino Municipal Code, Title
5 15, Chapter 15 .28, the Building Official has posted a property
6 located at 1670 Mt. Vernon Ave. , San Bernardino, California, with
7 a "Notice and Order" and has notified the person (s) having an
8 interest in said property that the said building or premises
9 constituted a public nuisance;
10 WHEREAS, pursuant to San Bernardino Municipal Code, the
11 Building Official has served a "Notice of Hearing" before the

SECTION 1 . Based upon the evidence that was submitted, it

was found and determined that the building and or premises located

at 1670 Mt. Vernon Ave. , San Bernardino, California constituted a

public nuisance.

SECTION 2 . The Board of Building Commissioners' accepted

staff' s recommendations . The property owner (s) are hereby

directed to comply with the following requirements : that the
11
property owner (s) failure to comply with the order of the Fire
12
Marshal to secure the buildings within the time frame specified,
13
the property owner (s) shall incur all current and future costs of

abatement in the form of a lien or personal obligation, which if

not paid, shall be recorded with the County Tax Assessor as a
16
17 special assessment on the property tax records . The property
owner (s) shall meet all applicable codes adopted by the City of
18
San Bernardino.

SECTION 3 . Upon the property owner (s) of record failure to
20
21 comply with this order, the City shall initiate action to abate
the nuisance and violations noted.

SECTION 4 . It was determined that the City was required to
23
initiate abatement proceedings upon which the City incurred costs
24
in the amount of $2104 .44 . These costs and future related
25
abatement costs shall be the personal obligation of the property
26
owner and shall be placed as a lien on the above property.

SECTION 5 . Any person aggrieved by this order, may appeal to

the Mayor and Common Council by filing a written statement with

the City Clerk. The statement must include the order appeal, the

specific grounds of your appeal, and the relief or action sought .

This appeal must be received within fifteen (15) days from the
8
date of this notice dated February 14, 1996 .
