Recommended motion:
That the request by Mr. Joe Lacko of Gifford Industrial Park,
Ltd. , by letter dated 2-7-96 , for the $13 , 375 Storm Drain Con-
struction Fee, for construction of a parking lot on Parcels No. 4
& 5 of Parcel Map No. 7405 for the U. S. Posal Encoding Facility,
be denied.

STAFF REPORT
A letter dated 2-7-95 was submitted from Joe Lacko of
Gifford Industrial Park, Ltd. , requesting that the $13 , 275 Storm
Drain Construction Fee be waived. These fees are a requirement
of the parking lot constructed to serve the U.S . Postal Encoding
Center on Parcels No. 4 & 5 of Parcel Map No. 7405 .
Our Storm Drain Master Plan shows a 42-inch storm drain
in Central Avenue. A condition of approval was imposed on
Parcel Map No. 7405 that the master plan storm drain be con-
structed to East Twin Creek. In view of the considerable cost
for construction of this storm drain, an alternate condition was
imposed to allow construction of a retention basin on a portion
of Parcel No. 1 to reduce the storm water runoff to the same or
lesser degree than before development.
Mr. Lacko states in his letter that the cost for con-
structing this retention basin was $250 , 000 , plus annual main-
tenance of the landscaping, taxes and insurance premiums. The
request by Mr. Lacko is that the cost for constructing the
retention basin offset the $13 ,375 in Storm drain Construction
Fees .
We are not aware of any legislative authority to waive
this fee. Therefore, we are unable to recommend approval of
this request.
A copy of the letter from Mr. Lacko is attached for
reference.

Re: Gifford Industrial Park
Dear Roger,
I hereby make the request for a credit to Gifford Industrial Park for providing public
drainage facilities. The credit is based on the fact that we have had to dedicate and
build onsite storm drain facilities that receive storm water off of public streets into a
private facility.
We recognize our obligation under the current City Ordinance to pay for storm drain
mitigation fees in the current amount of $13,375.00 for the parking lot installed at the
new Postal Encoding Facility. It is appropriate, however, for the City to give an offset
for our private system that was required in lieu of a public system. Our cost of land and
development expense for our onsite private facility is in excess of $250,000.00, plus
annual maintenance, taxes and insurance cost.
I hereby request that the Mayor and City Council approve our request to offset the
$13,375.00 due for the Post Office parking area as a credit against our above referenced
expense for onsite facilities.
