Synopsis of Previous Council action:

02/05/96 --- Resolution of Intention No. 96-28 was adopted, which sets a
public hearing date of 03/04/96 for the proposed vacation of
the 8.00 foot walkway running Northwesterly between Sierra Way, and__ _.

Recommended motion:
1. That the hearing be closed and the Findings of Fact as set forth in the Staff
Report from Roger G. Hardgrave, Director of Public Works/City Engineer as to
why the 8.00 foot walkway running Northwesterly between Sierra Way and
Genevieve Lane is no longer necessary for street purposes, be adopted.
2. Adopt Resolution.

CITY OF SAN BERNARDINO - REQUEST FOR COUNCIL ACTION
STAFF REPORT
A request and petition was received in October, 1995, from approximately 19 of the 37
homeowners and residents living in Tract No. 3410, to vacate an 8 foot by 108 foot
pedestrian walkway. The walkway runs Northwesterly from Sierra Way to Genevieve Lane
(North of 44th Street) . The vacation of the walkway was initiated by the City.
Authorization to Proceed was given on 11/06/95, and Plan No. 9383 was approved.
In December, 1995, a second petition was submitted which contained the signatures of
all but 7 of the remaining homeowners: 5 of these homes are vacant and/or for sale,
and the remaining two homeowners are undecided.
Public utility companies were notified of the proposed vacation on 12/12/95, with a
reply due by 01/12/96. There were no requests for the reservation of easements.
City Departments were not notified as no city services or utilities were affected by
the closure of the walkway.
On 01/18/96, a Notice of Exemption was filed for the proposed vacation, and a finding
of consistency with the General Plan was made.
On 02/05/96, Resolution of Intention No. 96-28 was adopted, setting a public hearing
date of 03/04/96. On 02/15/96, the Resolution of Intention was pub-
lished in a local newspaper, and Notices were posted in the area proposed for vaca-
tion, and all property owners adjacent to the proposed vacation were notified of said
hearing on 02/15/96.
There appears to be no further necessity for that 8.00 foot by 108 foot walkway
running Northwesterly from Sierra Way to Genevieve Lane, either for present or future
street purposes. Staff recommends the vacation on the basis of the following Findings
of Fact:
1. The above 8 foot by 108 foot walkway has been determined by the Department of
Public Works to be of no further necessity to the general public:
a) Notice of Exemption was filed, and a finding of consistency with the General
Plan was made.
2. The adjoining property owners have requested the proceedings. As this is a City
initiated vacation, the normal street vacation filing fees have been waived.
3. All of the concerned Utility Companies were notified of the proposal and all have
had the opportunity to respond. No reservations of easements were requested.
Staff therefore recommends the adoption of the Resolution Ordering Vacation.
