Synopsis of Previous Council action:
2/05/ 96 -- The City Administrator was directed to establish
guidelines for the deferment of development impact
fees .
1/16/ 96 -- Housing Committee requested the City Administrator' s
Office prepare a report relative to the request of
Michael John Enterprises, for a deferment of the
development impact fees.
Recommended motion:
That the guidelines in Attachment A relative to the deferment of
development impact fees be adopted; and that the City Attorney
be directed to amend the applicable ordinances and resolutions
to implement this action.

STAFF REPORT
At the Council Meeting of February 5, 1996„ the Council directed
staff to develop guidelines for the deferment of certain
development impact fees. The fees recommended for deferment were:
-Sewer Line Construction Fee
-Storm Drain Construction Fee
-Traffic Systems Fee
•Verdemont Infrastructure Fee
-Park Development Fee
Attachment A contains the proposed guidelines which have been
developed. These guidelines have been reviewed by the Director of
Public Works, Director of Planning/Building and the City Attorney's
Office and are recommended for adoption.

CITY OF SAN BERNARDINO
GUIDELINES FOR DEFERMENT
OF DEVELOPMENT IMPACT FEES
The following guidelines have been established by the City of San
Bernardino for the deferred payment of development impact fees:
1. The only development impact fees which shall be deferred
are the Sewer Line Construction Fee; Storm Drain
Construction fee; Traffic Systems fee; Verdemont
Infrastructure Fee; Park Development Fee.
2 . New single family construction projects only will be
eligible for participation in this program.
3 . Prior to the issuance of the building and other permits
required for new development, the amount of the
development impact fees for the project will be
determined by the City. All required fees other than
fees listed in #1, will be paid prior to the issuance of
the permits.
4 . The payment of the development impact fees may be
deferred until prior to the release of utilities, prior
to the close of escrow on the sale of the property, or
eighteen (18) months from the issuance of building
permits, whichever occurs first. If the deferred payment
of development fees is preferred, the developer shall
sign a statement acknowledging the amount of the total
impact fees to be paid and committing to pay all impact
fees within the established time frame. The City shall
record such an agreement as a lien on the parcel.
5. The program will terminate one 'year from the date of
Mayor and Council approval unless otherwise extended by
this body.
6. An administrative fee will be established to cover the
City's costs in administering this program.
7 . The amount of the deferred fees paid to the City will be
the amount due at the time the fees are actually paid.
8 . Under all circumstances, the required development impact
fees shall be paid prior to the release of utilities,
prior to the close of escrow for the sale of the property
or eighteen (18) months from the issuance of building
permits, whichever occurs first,. There shall be no
provision made for any extension of the impact fees
beyond this time. Failure to comply with these guidelines
will be grounds for prohibiting the developer from future
participation in this program.
