Description) Finance: Council Notes: 75-0262 Agenda Item No. CITY OF SAN BERNARDINO - REQUEST FOR COUNCIL ACTION STAFF REPORT Four (4) surplus parcels were acquired by the State of California in 1950 , in connection with construction of the Fifth Street overpass with Santa Fe Railway tracks . The State and City entered into a Lease Agreement to provide that the City would provide landscape maintenance services for these parcels - The Santa Fe Railway has agreed to purchase the parcel north of Fifth Street, and west of Route I--215 Freeway, to accommodate their planned expansion of their intermodal yard. A right-of-entry was approved at the Council meeting of 2-20-95 , to allow Santa Fe to proceed with their expansion while the terms of the acquisition were being finalized with the State of California. The State has requested that the City execute a quitclaim deed for this parcel , in order to avoid any possible cloud on the title An addendum to the original Lease Agreement will also be needed, to delete this one parcel from the areas being maintained by the City. We recommend that the quitclaim deed and Addendum to the Lease Agreement be approved. WITNESSETH WHEREAS, Lessor and Lessee did on the 4th day of May, 1950, enter into that certain Lease Agreement covering property in the City of San Bernardino, corner of 5th Street and I-215, County of San Bernardino, State of California. WHEREAS, it is mutually desired and agreed to change the following of said Lease: I. The lease is hereby modified that the City shall be relinquished from maintaining the area described on the attached EXHIBIT "A" as a park. All other terms and conditions remain unchanged. IN WITNESS WHEREOF, the parties hereto have executed this Lease Addendum the day and year first above written.
