A 21-day public review period was afforded from August 24 , 1995 , to September 21 , 1995 . No comments were received. This Program has been prepared in compliance with the California Environmental Quality Act(CEQA) and the State and City CEQA Guidelines. CEQA, PRC Section 21081.6, requires adoption of a monitoring and reporting program for those measures or conditions imposed on a project to mitigate or avoid adverse effects on the environment. The law states that the monitoring or reporting program shall be designed to ensure compliance during project implementation. This Mitigation Monitoring and Reporting Program contains the following elements: 1. The mitigation measures are recorded with the action and procedure necessary to ensure compliance. The Program lists the mitigation measures contained with the Initial Study for three issues. 2. A procedure for compliance and verification has been outlined for each mandatory mitigation action. This procedure designates who will take the action, what action will be taken and when, and to whom and when compliance will be reported. 3. The Program contains a separate Mitigation Monitoring and Compliance Record for each action. On each of these record sheets, the pertinent actions and dates will be logged, and copies of permits, correspondence or other data relevant to verifying mitigation implementation will be attached. Copies of the records will be retained by the City of San Bernardino as part of its project files. 4. The Program has been designed to be flexible. As monitoring progresses, changes to compliance procedures may be necessary based upon recommendations by those responsible for the Program. If changes are made, new monitoring compliance procedures and records will be developed and incorporated into the Program. The individual measures and the accompanying monitoring/reporting actions follow. They are numbered in the same sequence as presented in the Initial Study. 221.01/MMRPROG.018/January 18, 1996 1 LILBURN CORPORATIION MITIGATION MEASURE 2a. Prior to grading, the Project Engineer shall demonstrate to the City Engineer the actions that will be taken to comply with SCAQMD Rule 402, which requires that there be no I dust impacts offsite sufficient to cause a nuisance, and SCAQMD Rule 403, which restricts visible emissions from construction. Specific measures will include moistening soil prior to grading, daily watering of exposed surfaces or treating with soil conditioner to stabilize the soil; washing truck tires and covering loads of dirt transported offsite; cessation of grading during periods of high winds (over 25 mile per hour) and paving, coating or seeding graded areas at the earliest possible time after soil disturbance. IMPLEMENTATION AND VERIFICATION The Project Engineer shall provide the City Engineer with a copy of a fugitive dust control plan for review and concurrence. The Project Engineer shall implement this plan to prevent nuisance to adjacent residences. Inspectors shall verify the plan is being implemented during random field inspections and place notes in the project file following inspections regarding findings. COMPLIANCE RECORD WHEN REQUIRED: The Plan shall be submitted and reviewed for approval prior to initiating construction activities. The project activities shall be conducted in accordance with the Streambed Alteration Agreement for Notification 5-346-95. The measures contained in the agreement provide protection of water quality and replacement of riparian habitat. IMPLEMENTATION AND VERIFICATION The Project Engineer shall notify all construction personnel of the requirements of the Agreement in writing and through a pre-construction orientation on the project site. The Project Engineer shall inspect the site periodically to determine compliance with the requirements of the Agreement. A copy of the Agreement and the Inspection reports shall be kept in the project file. COMPLIANCE RECORD WHEN REQUIRED: The Agreement shall be placed in the project file upon signature of the City and CDFDG. Inspection reports shall be placed in the file as inspections are completed. Construction activities are limited to a period from 7:00 a.m. to 5:00 p.m. and to week days only. Residents shall be notified by certified mail or other verifiable method (i.e., door to door) of the intended construction schedule and given the telephone number for complaints regarding noise levels. A log of all such complaints shall be kept by the Project Engineer. The log shall record the disposition of each complaint, whether or not it was investigated and if any changes to the construction activities were made. IMPLEMENTATION AND VERIFICATION The Project Engineer shall provide a Noise Management Plan to the City Engineer for review and approval. It shall include notification of residents within 200 feet of the project site. A copy of the Plan shall be retained in the project file. A list of all noise complaints and the disposition of the compliant shall be placed in the project file. COMPLIANCE RECORD WHEN REQUIRED: The Plan shall be completed, approved and filed prior to initiating construction activities. Notes contained in the log shall be place in the project file prior to final inspection.
