HomeMy WebLinkAbout2016-025 I RESOLUTION NO. 2016-25 2 RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO ACTING AS THE SUCCESSOR AGENCY TO THE REDEVELOPMENT 3 AGENCY OF THE CITY OF SAN BERNARDINO APPROVING THE RECOGNIZED OBLIGATION PAYMENT SCHEDULE 16-17 A and B FOR THE PERIOD OF JULY 2016 4 THROUGH JUNE 2017 AND APPROVING CERTAIN RELATED ACTIONS. 5 WHEREAS, pursuant to Health and Safety Code (the "HSC") § 34172 (a)(1), the 6 Redevelopment Agency of the City of San Bernardino was dissolved on February 1, 2012; and 7 WHEREAS, consistent with the provisions of the HSC, the Mayor and Common Council 8 previously elected to serve in the capacity of the Successor Agency to the Redevelopment Agency 9 10 of the City of San Bernardino (the "Successor Agency"); and WHEREAS, the Oversight Board for the Successor Agency ("Oversight Board") has been 11 established pursuant to HSC § 34179 to assist in the wind-down of the dissolved redevelopment 12 13 agency; and WHEREAS, per HSC § 34177 (o) (1), the Successor Agency is required to prepare a 14 Recognized Obligation Payment Schedule (the "ROPS") before each twelve-month fiscal year 15 16 period commencing with the period from July 1, 2016 through June 30, 2017; and WHEREAS, pursuant to HSC § 34180 (g), Oversight Board approval is required for the 17 establishment of each ROPS; and 18 WHEREAS, pursuant to HSC § 34177 (o) (1), an Oversight Board-approved ROPS 16-17 19 A and B for the period of July 2016 through June 2017 must be submitted to the State Department 20 of Finance (the "DOF") and to the County Auditor-Controller not later than February 1, 2016 (the 21 "Submission Deadline"); and 22 WHEREAS, on February 1, 2016, the Oversight Board approved ROPS 16-17 A and B, 23 which was filed with DOF before the Submission Deadline; and 24 WHEREAS,pursuant to HSC § 34177,the Successor Agency is legally required to continue 25 to make payments due for enforceable obligations; and 26 27 28 1 I WHEREAS, the Successor Agency's and the Oversight Board's approval of the 2 establishment of ROPS 16-17 A and B will ensure that the Successor Agency has the authority to 3 continue to pay its enforceable obligations; and 4 WHEREAS, it is proposed that the Successor Agency approve the establishment of its 5 ROPS 16-17 A and B, which is attached hereto as Exhibit"A"; and 6 WHEREAS, this resolution has been reviewed with respect to applicability of the 7 California Environmental Quality Act ("CEQA"), the State CEQA Guidelines (California Code of 8 Regulations, Title 14, §§ 15000 et seq., hereafter the "Guidelines"), and the City's environmental 9 guidelines; and 10 WHEREAS, this resolution is not a "project" for purposes of CEQA, as that term is 11 defined by Guidelines § 15378, because this resolution is an organizational or administrative 12 activity that will not result in a direct or indirect physical change in the environment, per § 13 15378(b)(5) of the Guidelines; and 14 WHEREAS, all of the prerequisites with respect to the approval of this resolution have 15 been met. 16 NOW, THEREFORE, BE IT RESOLVED BY THE SUCCESSOR AGENCY TO THE 17 REDEVELOPMENT AGENCY OF THE CITY OF SAN BERNARDINO, AS FOLLOWS: 18 Section 1. The foregoing recitals are true and correct and are a substantive part of this 19 resolution. 20 Section 2. The Successor Agency's ROPS 16-17 A and B for the period of July 2016 21 through June 2017, which is attached hereto as Exhibit "A", are hereby approved and adopted, 22 inclusive of each enforceable obligation. 23 Section 3. The City Manager, as the Successor Agency's Executive Director or 24 designee, is hereby authorized to: i) post that ROPS 16-17 A and B on the City's website, ii) 25 transmit the ROPS 16-17 A and B to the State Department of Finance and the County Auditor- 26 Controller for their review within the timeframe and in the manner prescribed by the HSC; and iii) 27 make ministerial revisions to ROPS 16-17 A and B, which may include, but are not limited to 28 restating the information included within ROPS 16-17 A and B in any format that may be requested 2 I by the State Department of Finance and take such other actions and execute such other documents as 2 are necessary to effectuate the intent of this resolution, and to implement ROPS 16-17 A and B on 3 behalf of the Successor Agency, including authorizing and causing such payments.. 4 Section 4. This resolution is not a "project" for purposes of CEQA, as that term is 5 defined by' Guidelines § 15378, because this resolution is an organizational or administrative 6 activity that will not result in a direct or indirect physical change in the environment, per § 7 15378(b)(5) of the Guidelines. 8 Section 5.
