STAFF REPORT
The California Oil Recycling Enhancement Act provides funding, through
Opportunity and Block grants, to local governments for specified activities that
discourage the illegal disposal of used lubricating oil. The California Integrated
Waste Management Board administers the program which is funded by a $.04
surcharge on all quarts of oil sold, transferred, or imported into California.
In June 1995, the City received Used Oil Opportunity Grant (UOG2-94-130-36)
in the amount of $136,468.00. This grant provided funds to conduct the second
and third years of the school education program. This program includes classroom
presentations, promotional materials and a school district-wide poster contest, as
well as provide funding for the purchase of 3,000 curbside oil containers.
One of the educational items funded in this grant is a coloring book featuring the
Used Oil Recycling and Education Program's mascot, "Oil Can Bernie." In order
to involve the local community in the development of this item, staff developed
and conducted a contest which targeted Graphic and Fine Art Programs at the
California State University, San Bernardino and San Bernardino Valley College.
The award for this contest was a one-time scholarship in the amount of $500.00.
Only one entry was received as a result of this contest; however, staff reviewed
and determined that this entry was exceptional. The winning entry was submitted
by Deborah Mount, a student at San Bernardino Valley College. Samples of the
final coloring book artwork and artwork release form are included in the
attachment.
Staff is presenting this to Council, since the concept of awarding a scholarship was
not included in the original grant application. Funds in the amount of$500.00 for
this one-time scholarship award are included in the grant; the grant manager for
the California Integrated Waste Management Board has approved this change.
Staff recommends that Council adopt the attached resolution.

Thank you for your formal request to change an aspect of San Bernardino's School
Coloring Book contest. I have no problems with changing the scope of the
program to include art submitted by students at CSU, San Bernardino. The city
has had prior success with similar projects and I trust this project will be equally
successful.

Artwork Release Form
hereby execute this release with the City of San
Bernardino. I have been informed and understand that my artwork is being reproduced for the
promotion of the Used Oil Recycling Program.
I agree that said artwork is my own, original work and has not been copyrighted. I hereby grant
and relinquish to the City of San Bernardino, and its designees, all rights to the use of said
artwork for the promotion of the Used Oil Recycling Program.
I also grant to the City of San Bernardino the right to distribute said artwork, either alone, or
as part of the Used Oil Program. This includes the right to use said artwork for promotion or
publicizing of these uses.
For release of said artwork, I have or will receive a $500.00 scholarship, payable by the City
of San Bernardino from funds received from the California Integrated Waste Management Board
Used Oil Grant Number UBG2-94-130-36. I will not, nor do I expect to, receive any additional
compensation, royalties or other payments for the use of said artwork.
I also agree that the City of San Bernardino shall retain any and all proceeds generated by the
use of said artwork.
I expressly release the City of San Bernardino and its officers, employees and agents from any
and all claims, known or unknown, arising out of, or in any way connected with, the above uses
and representations.
Furthermore, I indemnify and hold harmless the City of San Bernardino, their employees, and
agents from all liability, damage and/or loss arising out of, or caused by, publication of the
above mentioned artwork.
I have read through the foregoing and understand the terms and conditions contained herein.
