STAFF REPORT
California's Tire Recycling Act provides funds to cities whose activities promote and
encourage the proper recycling or disposal of waste tires. These activities must result in
a reduction of the number of waste tires that are disposed of at landfills, or that are
illegally dumped or stockpiled. Current state law includes a requirement to register tire
stockpiles over 500 tires, payment of a $0.25 per tire disposal fee by the consumer to the
tire dealer for proper disposal, and a manifest system that tracks waste tires from the point
of generation to the point of recycling or ultimate disposal.
The City of San Bernardino has previously taken several steps to address the local
problems resulting from waste tires. These include:
1. Development of Commercial Tire Racks: The City received funds from a
previous tire grant (TR-93-0016-36) in the amount of $37,280.00 to develop a
commercial tire recycling rack. This rack is designed to allow small tire shops to
have access to a proper disposal system. The City purchased 68 tire racks through
this grant and is currently marketing this program.
2. Adoption of Used Tire Management Ordinance: The City adopted a Used Tire
Ordinance (MC-946; July 20, 1995) which implements a system of reporting that
complements and reinforces the state's laws. This system is designed to prevent
"leakage" of waste tires by requiring additional verification by sellers of new and
used tires of proper tire disposal.
3. Tracking and Monitoring System for Illegal Tire Dumping and Illegal Tire
Stockpiles: The Public Services Department, in cooperation with Code
Enforcement, has developed a monitoring program which systematically monitors
illegal tire dumping and stock piling. This system includes a process whereby
illegal tire stockpiles of 500 or more tires are reported to the California Integrated
Waste Management Board's, Tire Enforcement Branch for potential prosecution
under state laws. Staff has identified over 35,000 tires illegally stockpiled or
dumped within the City during a period from October through February. The
State has initiated enforcement action against an illegal stockpile of 10,000 tires,
and is working with staff on additional sites.
4. Additional Program Development: Staff is currently examining existing state
and City laws for possible amendment to strengthen the ability of the City to take
enforcement actions against illegal tire dumping and stock piling.
This grant will provide additional funds to the City to expand it's Waste Tire Management
and Enforcement Program. At the time of the preparation of this staff report, staff was
continuing to work out details of the actual grant program, including costs. Staff will be
available to provide a detailed presentation at the Council meeting, if requested, regarding
the proposed grant program.
This grant requires a 25% match from the City; this match will be included in the Refuse
Division's 1996 - 1997 budget. Deadline for submission of this grant application is April
1, 1996. If successful, this program would commence in July 1996.
Staff recommends adoption of the attached resolution authorizing submission of the Tire
Recycling Program Grant Application.
