Synopsis of Previous Council Action:

` Recommended Motion:
Motion 11 That the Director of Personnel be instructed to amend Resolution No.6413 to place the position of City Attorney
in Range 4564;and,
Motion#2 That the City Attorney be placed in Range 4564,Step Three,effective December 4, 1995;and,
Motion#3 That the previously accrued benefits of the City Attorney remain intact and that future benefits continue to accrue
in the same manner as with other management employees;and,
Motion#4 That in lieu of a car,the City Attorney be paid a car allowance in the sum of$7,500 annually,payable bi-monthly.

STAFF REPORT
The current salary for the City Attorney was approved by the Council over five years ago
on July 2, 1990, by Resolution No. 90-261. Since that time most other City employees,including
management employees, have received salary adjustments. By way of comparison, on January
23, 1995, the City Administrator received a salary raise to $117,084 annually, with the ability to
receive two additional 5% raises. In addition, the City Administrator was granted an annual
payment to the deferred compensation fund of $7,500.00, in lieu of a car or a car allowance.
Even the Assistant City Administrator is at $95,904 a year which is higher than the City Attorney.
Presently the two Senior Assistant City Attorneys are paid more than is the City Attorney.
In addition, the City Attorney's salary lags far behind that paid to city attorneys in surrounding
and comparable communities (see attached survey conducted on November 15 and 16, 1995
relating to cities used in the last two management salary surveys. Also attached are the pertinent
pages of the previous salary surveys.). It is requested that the compensation of the City Attorney
be established at an annual rate of$97,836, which is 5% above that of his senior assistants, plus
be provided an annual car allowance of$7,500, payable semi-monthly, in lieu of a car.
