SDE\dm'actfomi 0 STAFF REPORT Currently the San Bernardino Municipal Code (§ 2.56.171) only authorizes mail ballot elections for special elections to fill vacancies on the Council. The City Clerk has advised that such elections would save the City significant time, resources and cost. She has also indicated that in mail ballot elections safeguards would be in place to protect against fraud. This proposed ordinance would authorize the use of mail ballots in any special election. 1 ORDINANCE NO. 2 AN ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING SAN BERNARDINO MUNICIPAL CODE § 2.56.171 RELATING TO SPECIAL ELECTIONS 3 BEING CONDUCTED BY ALL MAIL BALLOT 4 THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO ORDAIN AS FOLLOWS: 5 6 SECTION 1. Section 2.56.171 of the San Bernardino Municipal Code is hereby 7 amended to read as follows: 8 "2.56.171. Special Elections; alternate procedure 9 As an alternative to the procedure outlined in Section 2.56.170, 1 o the Mayor and Common Council may call a special election to be held 11 on a Tuesday, within the time limits set by Section 2.56.170 to be 12 conducted wholly by mail ballots.
