This addendum evidences a major change in the nature of the project from the originally approved 318 multi-family units to 42 single family units, pursuant to Tentative Tract No. 15642, approved by the Planning Commission on 05-16-95. By execution of the Second Addendum, both the RDA and City agreed to undertake certain actions to facilitate development of the 42 single family units. One action was to provide CFB with financial assistance for the cost of the new Pine Avenue infrastructure, in the amount of $1, 133,000, from any source the City deems appropriate. Section 4.4.2 of the Second Addendum states that the City will obtain adequate interim financing and will cause to be formed an assessment district to finance the cost for new Pine Avenue. CFB agreed to join and use its best efforts to cause the owners of the other two parcels, that will be traversed by new Pine Avenue, to consent to be included in the district. The three parcels are shown on the attached map, along with the proposed district boundary. On 8-7-95, authorization was given to initiate the formation of the assessment district, and the selection of Brown, Diven and Hentschke for Legal Consultant and GFB - Friedrich and Associates for Assessment Engineer were also confirmed at that meeting. The City Administrator was directed to pursue other means of financing and bring back a report on 08-21-95. The item was continued to the September 5, 1995 Council Meeting. Also at that meeting a resolution authorizing execution of agreements with GFB - Friedrich for Assessment Engineering services, and an agreement with Brown, Diven and Hentschke for legal consulting services was adopted. The petition for the formation of the Assessment District represent 100% of the property owners to be assessed. A copy of the petition is on file in the office of the City Clerk. The petitioners have paid the required $24,000 to cover the cost of the proceedings in the event the district is not formed due to their actions. Presently, there are four parcels that will be within the district. Two of these are presently being developed into 42 single family lots. The remaining two parcels will be developed sometime in the future. The total assessment amount for each single family lot within the present development is proposed to be $12,282 plus interest. The assessments will be paid off when each single family lot is sold. The remaining two parcels, which are not presently slated for immediate development, will have a total assessment amount of $436,818 and $340,850 respectively, plus interest. These amounts will be assessed over a 25 year span. When developed, these parcels will yield a total of 50 single family lots, based on present general plan designations, and the proposed monthly assessments will be approximately $80, or $960 per year per single family lot. The funding source for the construction costs will be through a combination of a loan from EDA (approximately 46%) , the Sewer Line Construction Fund (245) (approximately 27%) and the Sewer Line Maintenance Fund (132)(approximately 27%) . Resolution Making Findings on Petition - Formally accepts petition for formation of the assessment district. 2. Resolution Making Appointments - Formal appointment of City Engineer as Superintendent of Streets for the purpose of the assessment district. 3. Resolution Adopting Boundary Map - Approves map setting forth the boundaries of the Assessment District. 4. Resolution of Intention - Formal declaration of City's Intent as to the formation of the Assessment District. S. Resolution Passing on Report and Setting Public Meeting and Public Hearing - Approval of the Engineer's Report and setting of dates for Public Meeting and hearing relative to the formation of the Assessment District.
