The Executive Director was also authorized to submit the FYI 994-1995 CDBG Statement of Objectives and Projected Use of Funds to the U.S. Department of Housing and Urban Development (HUD). The final statement was approved by HUD in June 1994. As a part of the approval, HUD requires a series of public hearings on CDBG Program activities during each program year cycle. Also, a commitment to hold a public hearing on the Grantee Performance Report for FYI 994-1995 was included in the Citizen Participation Plan, contained in the 1995-1999 Consolidated Plan and approved by the Common Council on May 15, 1995. ANALYSIS The purpose of the public hearing on the Grantee Performance Report (GPR) is to review the use of CDBG funds during the 1994-1995 program year. The GPR, a document required annually by HUD, is intended to serve several functions. The GPR is a consolidation of several reports previously required by HUD and serves as an annual activity report. The GPR is effectively, a summary of all activities funded at least in part, by CDBG monies and a financial statement on the level of expenditure that occurred between July 1, 1994 and June 30, 1995. The GPR provides information on public service, rehabilitation and capital improvement projects. The report contains nine(9)parts: Section I, City Identification Information; Section II, list the capital improvement and other non-housing and non-public service projects; Section III, is the list of public service projects; Section IV notes the single-family and multi-family rehabilitation projects; Section V, is a summary of the CDBG expenditures; Section VI and VIII are not applicable to the City; Section VII provides additional information on the rehabilitation activities; Section IX notes the mid-year reallocation results. An important point to note about the GPR is that the report reflects expenditures which have occurred within a specified time period and not what has actually been expended to date. Therefore, some projects and activities not noted as fully expended during the reporting period may in fact be complete at this time. In fact, the majority of the public service and capital improvement projects are complete. DEFERRED PAYMENT HOME IMPROVEMENT LOAN This program is designed to provide property improvement/rehabilitation assistance to low and moderate homeowner occupants that demonstrate extreme economic hardship which would prevent their participation in the Agency's amortized property assistance programs. The deferred payment home improvement loan is a three percent (3%) simple interest loan up to $40,000 which may be deferred until transfer of title based upon the demonstrated need of the client. In some instances very substandard properties may result in loan amounts that exceed the maximum. Fourteen (14) single unit properties were completed. 2. AMORTIZED HOME IMPROVEMENT LOAN PROGRAM I The Home Improvement Loan Program is designed to provide both interior and exterior home improvements to low and moderate income homeowners. Loans are available at five percent (5%) interest up to a maximum of $40,000. In some instances very substandard properties may result in loan amounts that exceed the maximum and interest rates may be lowered to 3%. Fourteen (14) single unit properties were completed. 3. EXTERIOR IMPROVEMENT LOAN PROGRAM The Exterior Improvement Loan Program is designed to provide exterior improvement loans to improve the physical appearance of residential properties located within selected focus neighborhoods. The United States Department of Housing and Urban Development (HUD) mandates that Community Development Block Grant (CDBG) entitlement entities spend grant allocations in a timely manner. Previously, the City was in a position in which its Letter of Credit exceeded a HUD regulation which stipulates that cities may not retain more than 1.5 times the annual grant allocation. At that time, Development Department staff was advised to quickly expend CDBG funds or risk losing a portion of the grant. Staff cured the situation by cancelling projects and reprogramming the resulting funds into new projects. Staff realizes the most prudent method to ensure the timely implementation of activities and expenditures is to monitor the projects on a more regular basis and cancel those projects which have little or no expenditure activity at the end of the agreement term. Currently, several projects have been completed under budget, and surplus funds are available for reprogramming. Although the City is not in a situation in which funds must be spent immediately, staff is taking this action to avoid any such situations. The attached table entitled "Proposed CDBG Projects to be Cancelled" identifies those capital improvement and public service projects which staff recommends be cancelled due to one of the following reasons: 1. Project is completed and surplus funds remain, and therefore require reprogramming; 2. Project is incomplete due to no substantial activity because either project cost exceeded funds available or funds were never spent by organization. Staff has sent correspondence to the City departments and organizations which have projects identified on the attached table. The correspondence details staffs recommendation that the projects be cancelled and funds reprogrammed. Capital Improvement Projects Recommended for Cancellation The total of recommended capital improvement projects to be cancelled is $520,635. Within the CDBG budget, staff has identified a shortfall of $301,720, which is attributed to project cost overruns on several Parks, Recreation and Community Services projects. Staff recommends that the identified budget shortfall be addressed by applying funds from the capital improvement project cancellation list to the budget shortfall as follows: Total of Capital Improvement Projects to be Cancelled: $520,635 Less Funds Applied to Budget Shortfall: $301,720 Remaining Funds Available for Reprogramming: $218,915 The majority of the capital improvement projects listed on Table I have been completed and the remaining funds represent a costs savings due to projects being completed for less than thy! engineer's estimate. Five (5) projects were unable to be completed due to insufficient funding amounts. The Easter Seal Society Heating and Air Conditioning (HVAC) replacement project was unable to be completed due to the lack of sufficient funding. Public Service Projects Recommended for Cancellation The total of recommended public services projects to be cancelled is $86,993. There is no budget shortfall within the CDBG public service budget. As such, the entire amount of 586,993 can be reprogrammed into other public service programs. r The public service projects listed on Table III have surplus funds remaining after the program year ended and the agreements have officially terminated. Table IV identifies the projects with no substantial activity. These organizations have never requested any reimbursement for their respective programs. It should be noted that $60,000 of the $70,000 listed on this particular portion of the table is associated with one (1) organization, Children's Fund. Capital Improvement Projects Recommended for Funding During the 1994-1995 CDBG funding cycle, the CDCAC and the Mayor and Common Council approved a Contingency List of three (3) capital improvement projects to be funded in the event that any of the approved 1994-1995 CDBG projects does not result in an executed agreement. All approved 1994-1995 CDBG projects have resulted in an executed agreement and the work associated with these projects is progressing. With the availability of CDBG capital improvement funds, staff recommends the CDCAC reconsider the Contingency List projects along with an additional project being submitted for consideration. Mary's Mercy Center Kitchen, Bathroom and Dining Room Renovations Amount Requested: $15,555 Project includes the renovation of the dining room to add molding around the walls, renovation of the kitchen to add tile on the wall behind the stoves, replacement of tile in the bathrooms and kitchen including molding. Staffs analysis indicates requested amount may be insufficient to complete the requested scope of work. 2. City of San Bernardino - City Administrator's Office Community Revitalization Code Enforcement Project Amount Requested: $75,000 Project was partially funded in the amount of$100,000 as part of the 1994-1995 CDBG funding cycle. Project funds will be used for salaries and supplies to administer the program. 3. City of San Bernardino - Planning and Building Services Department Seismic Hazards Reduction Program Amount Requested: $84,722 Project includes the implementation and enforcement of a mandatory seismic retrofit ordinance, development, and implementation of a voluntary residential retrofit program, and implementation of a public information program. 4. Economic Development Agency of the City of San Bernardino Baseline Street Revitalization (Street Lighting/Irrigation from I-215 to Waterman) Amount Requested: $218,915 Requested funds will be used for improving and upgrading the street lighting along Baseline Street from Interstate 215 to Waterman Avenue. Funds would also be used to provide trees, tree wells and decorative tree grates, and other streetscape improvements along Baseline Street from Interstate 215 to Waterman Avenue. The Baseline Area Business Association (BABA) is working with Agency staff to develop a revitalization plan for Baseline Street. Baseline businesses have committed to doing major facade improvem:- rrs with City support. City support for this project can be demonstrated by providing funding for this project. BABA is beginning this effort with a demonstration block which is Baseline Street from "D" Street to Stoddard. Additionally, the Mayor and Common Council placed three (3) additional organizations on the Contingency List. Although the first three (3) organizations are listed in order of priority, the last three (3) organizations were added by the Council and given no particular ranking order. Therefore, it is necessary and appropriate for the CDCAC to recommend to the Mayor and Common Council a funding priority for all six (6) projects and to recommend the level of funding. The organizations to be considered by the CDCAC for funding are as follows: 1_ Bethlehem House Program Administration Amount Requested: $20,000 Bethlehem House has closed its shelter facility due to significant cash flow problems. It is anticipated that a new shelter facility will open under a different name and will be operated by a different organization. 2_ Cornerstone Christian Preschool Subsidized Child Care Program Amount Requested: $13,000 Requested funds will be used for salaries, supplies, utilities and lease payments for the child care facility. Additionally, it is necessary to reprogram $86,993 in public service funds to those programs selected for funding by the CDCAC.
