Obtain an agreement between Law Enforcement Medical Services, Inc. , for the collection of
Psychological evidence in order to successfully prosecute arrestees for certain crimes. This
collection includes blood draws, collection of evidence from both rape victims as well as
rape suspects, the removal of taser darts, urine sample collections, the processing of sex
kits by the San Bernardino County Crime Lab, and court time associated with the collection
of said evidence.
RECOMMENDATION:
The adoption of the attached agreement between the City of San Bernardino and Law Enforcement
Medical Services, Incorporated.
COSTS, SAVINGS AND TERMS:
At the request of the department, appropriate specifications were prepared and furnished to
area suppliers. Specifications, as bid, have been reviewed and Law Enforcement Medical Services,
Inc. meets those specifications and requirements as set forth in bid Q6A009. Based on the
average usage of these services during FY 94/95, Law Enforcement Medical Services was determined
to be low bidder, which may result in potential cost savings of approximately $14,000 to $16,000.
The amount of cost savings will be determined on the usage of these services. If usage remains
the same during FY 95/96 the department is anticipating $14,000 in cost savings, if the usage
ins 'ses the cost savings for these services will decrease.

The Police Department requests an extension in the terms of this agreement, to include an
additional automatic two year renewal, making this agreement a total of three years, providing
there are no price increases, except for possible increases in laboratory fees or supply fees.
PROPOSAL:
Law Enforcement Medical Services, Inc. has met all requirements as stated in quote Q6A009.
The department urges your support and endorsement of this agreement with Law Enforcement Medical
Services for the collection of psychological evidence.

2 RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING THE
EXECUTION OF AN AGREEMENT WITH LAW ENFORCEMENT SERVICES, INC. TO
3 PROVIDE EVIDENCE COLLECTION FOR THE SAN BERNARDINO POLICE
DEPARTMENT.
4 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF
5 SAN BERNARDINO AS FOLLOWS :

7 SECTION 1 . The Mayor is hereby authorized and directed to
8 execute on behalf of said City an Agreement with Law Enforcement
9 Services, Inc. to provide evidence collection for the San
10 Bernardino Police Department . A copy of said Agreement is attached
11 hereto, marked Exhibit "A" , and incorporated herein by reference as
12 fully as though set forth at length.
13 SECTION 2 . The authorization to execute the above-
14 referenced agreement is rescinded if the parties to the agreement
15 fail to execute it within sixty (60) days of the passage of this
16 resolution.

SERVICES AGREEMENT
THIS AGREEMENT is entered into between tI 1Z 1 R

tr ("CONTRACTOR") and the CITY OF SAN
BERNARDINO ("CITY") .
WITNESSETH:
A. WHEREAS, CITY has need for collection of physiological
evidence and sexual assult response teams within the CITY and,
B. WHEREAS, CONTRACTOR is competent, experienced and able
to perform said services: and,
C. WHEREAS, CONTRACTOR has provided the lowest responsible
bid for the providing of such services;
NOW THEREFORE, the parties hereto agree as follows:
1. CONTRACTOR shall furnish collection of physiological
evidence and sexual assult response teams to CITY in accordance
with Bid Specifications Q6A009.
2 . Over the term of this Agreement, CONTRACTOR shall be paid
for such services an amount in accordance with Bid Specification
Q6A009 Bidder's Proposal and Statement.
3. CONTRACTOR shall provide the Police Department with a
monthly invoice in arrears and shall be provided payment within
thirty (30) days therefrom. CITY retains the right to challenge
all or any part of an invoice.
4. The term of this Agreement shall be one (1) year from the
date first above shown.
5. CONTRACTOR agrees to defend, indemnify, save and hold
CITY, its officer, agents and employees harmless form any claims or
suits that may be brought by third persons on account of personal
injury, death or damage to property or a property or business or

personal interest, arising from any negligent act or omission by
-4mr, contractor while performing services under this Agreement.
6. While not restricting or limiting the foregoing, during
the term of this Agreement, contractor shall maintain in effect
policies of comprehensive public, general and automobile liability
insurance, in the amount of $1, 000, 000. 00 combined single limit,
and statutory worker's compensation coverage, and shall file copies
of said policies with the CITY'S Risk Manager prior to undertaking
any work under this Agreement.
7. CONTRACTOR shall perform work tasks as directed by the
Police Department, but for all intents and purposes contractor
shall be an independent contractor and not an agent or employee of
the CITY.
S. In the performance of this Agreement and in the hiring and
recruitment of employees, contractor shall not discriminate on the
basis of race, creed, color, religion, sex, physical handicap,
ethnic background or country of origin.
9. Any notice to be given pursuant to this Agreement shall be
deposited with the United States Postal Service, postage prepaid
and addressed as follows:
