Financial Impact:
Impacted Departments will absorb the proposed salary increases in their 2015-16
budgets.
Motion: Adopt the Resolution.
Synopsis of Previous Council Action:
On June 16, 2014 the Mayor and Common Council adopted Resolution No. 2014-161, a
Resolution of the City of San Bernardino amending Resolution NO. 6413, section
thirteen, temporary/part-time employees, entitled in part "A Resolution...establishing a
basic compensation plan..." by updating and codifying prior Council actions.
Background:
On or about September 25, 2013, the California Legislature enacted legislation signed
by the Governor of California, raising the minimum wage for all industries. Pursuant to
its authority under Labor Code section 1182.13, the Department of Industrial Relations
amends and republishes certain provisions of the General Minimum Wage order, MW-
2007. Consistent with this enactment, amendments are made to the minimum wage,
and the meals and lodging credits sections of all the Industrial Welfare Commission's
industry and occupation orders. Section 2 of the California Minimum Wage MW-2014
states, "Every employer shall pay to each employee wages not less than ten dollars
($10.00) per hour for all hours worked, effective January 1, 2016.
The amendment to Section Thirteen of Resolution No. 6413 will incorporate the
mandated minimum wage increase effective January 1, 2016 and codify prior Council
actions. Additionally, increases are proposed for positions that will be affected by
compaction due to the implementation of the minimum wage increase. Part-time
positions with full- time equivalent classifications will receive the same hourly rate.
