Description) Finance: Council Notes: S.. 75-0262 Agenda Item No.— � 0 0 1 RESOLUTION NO. 2 RESOLUTION OF THE CITY OF SAN BERNARDINO PROPOSING AN AMENDMENT OF THE CHARTER OF SAID CITY RELATING TO THE APPOINTMENT 3 OF A MAYOR PRO TEMPORE 4 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: 5 SECTION 1. Recitals. 6 ( a) In accordance with the Constitution of the State of 7 California, the City of San Bernardino, a municipal corporation, 8 has adopted a Charter. 9 (b) The Mayor and Common Council of the City of San 10 Bernardino desire to submit to the electors the Charter Amendment 11 set forth in this resolution. 12 SECTION 2. Submittal to Electors. 13 The following proposed amendment to the Charter of the City 14 of San Bernardino is submitted to the qualified electors of the 15 City of San Bernardino for their approval or rejection at the 16 consolidated municipal election to be held on Tuesday, March , 17 1995. 18 PROPOSED CHARTER AMENDMENT NO. 19 It is proposed that Section 36 of the Charter of the City of 20 San Bernardino be amended to read as follows: 21 "Section 36. Mayor to Preside - Absence of Mayor 22 The Mayor shall preside at all meetings of the Common 23 Council, but shall not be entitled to vote. The Mayor may appoint 24 one member of the Common Council to serve as Mayor pro tempore. 25 Such appointment shall not be subject to approval or consent of 26 the Council . Such Mayor pro tempore shall serve at the pleasure 27 28 1 1 RESOLUTION OF THE CITY OF SAN BERNARDINO PROPOSING AN AMENDMENT OF THE C:"NRTER OF SAID CITY RELATING TO THE APPOINTMENT OF A MAYOR 2 PRO TEMPORE 3 4 of the Mayor but only so long as he or she shall hold the office 5 of Council member. 6 In the absence of the Mayor, the Mayor pro tempore shall 7 preside at meetings of the Common Council, but shall retain the 8 right to vote upon all questions under consideration, and shall 9 have the same power to disapprove any order made by the Common 10 Council, and with like effect as the Mayor would have had if 11 present at this meeting. 12 In case of vacancy, or if by reason of absence from the 13 City, or sickness, or from any other cause, the Mayor is unable to 14 perform the duties of his office, the Mayor pro tempore shall have 15 all powers and authority which the Mayor would have possessed if 16 personally present and attending to such duties, but the Mayor pro 17 tempore shall not lose his or her vote as Council member.
