2 RESOLUTION OF THE CITY OF SAN BERNARDINO PROPOSING AN
AMENDMENT OF THE CHARTER OF SAID CITY RELATING TO THE FILLING OF
3 VACANCIES IN THE OFFICE OF THE MAYOR AND CITY ATTORNEY
4 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO AS FOLLOWS:

SECTION 1. Recitals.

( a) In accordance with the Constitution of the State of
7
California, the City of San Bernardino, a municipal corporation,
8
has adopted a Charter.
9
(b) The Mayor and Common Council of the City of San
10 Bernardino desire to submit to the electors the Charter Amendment
11 set forth in this resolution.

SECTION 2. Submittal to Electors.

The following proposed amendment to the Charter of the City
14
of San Bernardino is submitted to the qualified electors of the
15 City of San Bernardino for their approval or rejection at the
16 consolidated municipal election to be held on Tuesday, March ,
17 1995.
18 PROPOSED CHARTER AMENDMENT NO.
19 It is proposed that Section 51 of the Charter of the City of
20 San Bernardino be amended to read as follows:
21 "Section 51. Appointments and Vacancies.
22 The Mayor, with the consent and approval of the Common
23 Council, shall appoint all officers, and fill all vacancies in an
24 elective office not otherwise provided for in this Charter;
25 provided that in no case where a vacancy has occurred and an

4 appointment been made to an elective office, shall the officer
5 hold office beyond the next general municipal election at which
6 time an election shall be held for that office so vacated to fill
the unexpired term. In case of a vacancy in the office of the
8 Mayor, or City Attorney, the unexpired term shall be filled by
9 election of the electors of the City at a special election held
10 not less than 88 days nor more than 100 days following the date of
11 teh vacancy. In the interim the Mayor shall appoint an Acting
12 City Attorney from within the office without need for Council
13 approval . "

4 I HEREBY CERTIFY that the foregoing Resolution was duly
5 adopted by the Mayor and Common Council of the City of
6 San Bernardino at a meeting thereof, held on the
day of 1994, by the following vote, to-wit:
