2 RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF
SAN BERNARDINO PROPOSING AN AMENDMENT OF THE CHARTER OF SAID CITY
3 RELATING TO THE TRANSFER OF FUNDS FROM THE WATER FUND TO THE
CITY'S GENERAL FUND

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
5 OF SAN BERNARDINO AS FOLLOWS:
6 SECTION 1. Recitals.
7 ( a) In accordance with the Constitution of the State of
8 Califonria, the City of San Bernardino, a municipal corporation,
9 has adopted a Charter.
10 (b) The Mayor and Common Council of the City of San
11 Bernardino desire to submit to the electors the Charter Amendment
12 set forth in this resolution.
13 SECTION 2. Submittal to Electors.
14 The following proposed amendmen-"-- to the Charter of the City
15 of San Bernardino is submitted to the qualified electors of the
16 City of San Bernardino for their approval or rejection at the
17 consolidated municipal election to be held on Tuesday, November 8,
18 1994.
19 PROPOSED CHARTER AMENDMENT NO.
20 It is proposed that Section 164 of the Charter of the City
21 of San Bernardino be amended to read as follows:
22 "Section 164. Sale and Use of Water.
23 The Board shall have power to control and order the
24 expenditure of all money received from sale or use of water, for
25 the defraying of expenses or maintenance and repairs and operation
26 of the water system, and for any expenses for additions to the
27 same; and for supplying the City with water for any and all
28 purposes; provided that all such money shall be deposited in the

5 treasury of the City to the credit of a fund to be known as the
6 Water Fund, and shall be kept separate and apart from other moneys
7 of the City, and shall only be drawn from said fund upon demands
g authenticated by the signature of the President and Secretary of
9 the Board, or in the absence of the President, by the signatures
10 of two members and the Secretary of the Board, except that the
Common Council may, in its discretion, monthly transfer from the
11
12 Water Fund to the General Fund not more than fifteen percent (15%
13 of the revenues of the Water Department during the preceding
14 month, and except that the Department during the preceding month,
15 and except that the Mayor and Common Council may, in its
discretion, monthly transfer from the Water Fund to the proper
16
Bond Fund an amount of money equal to one-twelfth ( 1/12) of the
17
amount which will become due and payable during the current year
18 for interest or principal, or for interest and
p p principal, upon any
19 or all outstanding Water Works Bond.
