That the Director of Public Works/City Engineer and the City Clerk are authorized to proceed with the proposed vacation of those portions of Marshall Boulevard between Rockford and Victoria, and that portion of Piedmont Drive lying 430 feet East of Belvedere and Marshall Boulevard; and that Plan No. 9158, showing the proposed vacation of portions of Marshall Boulevard and Piedmont Drive, is approved. AND 2. Description) Street vacation proceedings Finance: Council Notes: 75-0262 Benda Item No 36 CITY OF SAN BERN.+RDINO - REQUEST FAR COUNCIL ACTION STAFF REPORT A request was received from Hunsaker and Associates, Consulting Engineers, repre- senting the San Manuel Band of Mission Indians, to vacate that portion of Marshall Boulevard lying between Rockford Avenue and Victoria Avenue, and that portion of Piedmont Drive lying 430 feet East of the center line of Belvedere Avenue and Marshall Boulevard. The petitioner has deposited the required $500.00, which represents one-half of the total fee of $1,000.00. The remaining $500.00 will be due after the investigative proceedings. The San Manuel Band of Mission Indians owns 9+ pieces of property on the: West side of Victoria Avenue. They are trying to create one large parcel in the process of "federalizing" this property. As both Piedmont Drive and Marshall Boulevard are "paper streets" in the area of proposed vacation (they have been dedicated for public use, but they have not been constructed) - The San Manuel Band of Mission Indians would like to utilize these areas. At the Council Meeting of 08-01-94, the request for authorization to proceed was continued to 09-19-94 in order to allow the City to meet with the applicant to discuss their plans for development of their property. On September 1, 1994, a meeting was held with Councilman Oberhelman, City staff, representatives from Levine and Associates, and Ms. Lynn LeRoy, chairperson for the San Manuel Band of Mission Indians. It was agreed that Councilman Oberhelman, Ms. LeRoy, representatives from Levine and Associates, City Staff from Planning, Parks and Recreation, and Public Works, along with the Consulting Engineer, would meet on September 22, 1994 to discuss various development plans or concepts for the area. It was also agreed that the Consulting Engineer would present several sets of drawings showing these concepts. After initial agreement from this group, a neighborhood meeting(s) will be held to present the different concepts to adjacent residents and landowners and to address their specific concerns regarding the eventual development of the property, and receive their input. It is recommended that this Authorization to Proceed be granted, with the contin- gency that final action will not be taken on the proposed vacation until input has been received from the residents and landowners in the area. They have plans to construct one or more ball fields and would like to construct "green belt" areas along the portion of Marshall Boulevard they are trying to vacate. Representatives will meet with the property owners of parcels 8 and 9 on the North- easterly side of Piedmont Drive and will also meet with the homeowners (parcels 10 through 14) on the South side of Marshall Boulevard.
