STAFF REPORT
RESOLUTION AUTHORIZING AN AGREEMENT
BETWEEN THE CITY AND THE NATIONAL
INDIAN COUNCIL ON AGING, INC. TO
PROVIDE TRAINEE SITES FOR THE SENIOR
COMMUNITY SERVICE EMPLOYMENT PROGRAM.
The City has been invited to participate in a training program for Seniors 55 years of age and
above which is provided through a special fund set up under the provisions of Title V of the
Older Americans Act. The program provides for a Senior Community Service Program in
which participants are paid while they train.
The National Indian Council on Aging, Inc. gives oversight to this program, however,
participants do not have to be Native Americans as long as they meet the age, income and
residency requirements established by the Department of Health and Human Services.
Initially, this department will have three (3) trainee positions at the Westside Community
Services Center. These positions will work with our programs which currently deal with health
and human services, employment counseling, food distribution and emergency services for
homeless and other disadvantaged individuals and families. Other trainee positions may be
developed in the administration office and in the social programs areas as funding becomes
available.
The cost of this program will be borne by the National Indian Council on Aging, Inc. with the
City providing in-kind support by providing the training site, supervision and administration of
the program. The in-kind support will approximate $450 annually per trainee for a 20 hour
work week. Trainees are paid by the federal agency at the prevailing federal minimum wage
or the State's minimum wage, whichever is greater.
This program will provide some needed assistance for our community and human services and
at the same time provide training for senior citizens who need to learn skills for acquiring
meaningful employment. It is recommended that this resolution and agreement be adopted so
that this department may participate in this worthwhile program.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
6 OF SAN BERNARDINO AS FOLLOWS:

SECTION 1. The Director of Parks, Recreation and Community Services is
8
9 hereby authorized and directed to execute on behalf of said City an agreement with the
10 National Indian Council on Aging Inc., Senior Community Service Employment Program,
11 relating to the placement of senior trainees at City work sites. A copy of said agreement is
12 attached hereto, marked Exhibit "A" and incorporated herein by reference as fully as though
13 set forth at length.

SECTION 2. The authorization granted hereunder shall expire and be void and
15
16 of no further effect if the agreement is not executed by both parties and returned to the office
17 of the City Clerk within 60 days following effective date of the resolution.

19 and Common Council of the City of San Bernardino at a meeting thereof,

HOST AGENCY AGREEMENT

hereinafter referred to as the HOST AGENCY and the National Indian Council on Aging.Inc.,hereinafter referred to as the SPONSOR
AGENCY.*
The period of agreement shall be from(date) September 15, 1994 through(date) September 14, 1995

The Host Agency certifies that it is a[ ]501 (c)(3)organization under IRS code and that a copy of 501 (c)(3)certification is attached or
has been previously provided to NICOA/SCSEP.
In order to promote the growth and development of the trainee, and to provide an opportunity for significant community service,the
HOST AGENCY will:
Provide NICOA/SCSEP trainee(s) with health and safe worksite(s); adequate supervision; orientation to agency policies and
procedures;necessary training to perform assigned duties and fair and equitable treatment as extended to regular employees.
Agrees not to displace any current employee or volunteer with a TRAINEE, nor assign a TRAINEE to perform the tasks of an
employee on layoff,nor to replace a Federally funded position(other than SCSEP)with another SCSEP TRAINEE.Not discriminate
on the basis of race,color,religion,sex,national origin,handicap,age,political affiliation,opinion,or ancestry.
Not use a TRAINEE in any activity that could be construed as an activity related to or involved with the maintenance,operation or
construction of any facility to be used as a place for sectarian religious instruction or worship.
Not allow trainee to engage in any activity of a political nature,either, local, state, national or tribal,during the trainee's SCSEP
working hours.
Actively support a TRAINEE'S Individual Service Strategy and to consider any TRAINEE for all job openings for which that
TRAINEE qualifies on an equal basis with any other applicant.
Assure that the direct supervisor(s) will adhere to conditions of this agreement and to all SCSEP administrative requirements as
outlined in the training site agreement.
Will provide adequate documentation of in-kind contributions(approximately$450 per participant annually).
The Sponsor Agency will:
Provide wages,FICA and worker's compensation coverage to each TRAINEE for the authorized number of hours per week.
Provide supervisors with orientation and periodic update on the goals and objectives of the SCSEP.
Agrees to recruit,enroll and assign trainee(s)to the Host Agency's designated training site(s)for the purpose of engaging in productive
community service employment subject to interview and approval of the trainee by the HOST AGENCY.
Remove TRAINEE(s)for HOST AGENCY's worksite upon written request of the HOST AGENCY.
Reserve the right,following reasonable notice to reassign any trainee(s) at any time that re-assignment will increase the trainee's
opportunity for training or unsubsidized employment;or will otherwise serve the best interests of the trainee;or will better support
the goals and objectives of NICOA's Title V program.
TERMINATION CLAUSE:
Failure of the HOST AGENCY to assure that the stipulations of this agreement are followed may result in termination of this
agreement.
This agreement may be terminated by either party upon 30 days written notice to the other party.
This agreement is subject to the continuation of funding from Department of Labor to the National Indian Council on Aging to operate
the Senior Community Service Employment Program.
