The vacant property would be leased for $200 per month and allow the contractor for Main Street Phase II improvements to have a construction yard in close proximity to his work. BACKGROUND: The Pussy Cat Theater site was acquired as part of the Super Block Development. Earlier this year, demolition of the theater was completed and the site fenced for future improvements (See Exhibit "A"). Recently, with the start of Main Street Phase II streetscape improvements, the contractor, Marina Landscape, Inc., approached the agency with the possibility of using the vacant lot as a construction yard during their construction of the streetscape improvements. The contractor has experienced great difficulty obtaining a yard in close proximity to the Downtown. In addition to being of benefit to the contractor, the location of a yard at this site is of benefit to the Agency and city for the following reasons: 1. The yard is centrally located to the contractor's work. This convenient location avoids the transporting of heavy equipment on more city streets than necessary, and makes the contractor more accessible to agency and city staff.. 2. This otherwise vacant lot will be put to a beneficial interim use awaiting development plans for the Super Block. The key elements of this agreement are as follows (See Exhibit "B"): 1. The lot will be leased for $200 per month. 2. The contractor will supply the agency with $1,000,000 general liability insurance and evidence of workers compensation. 3. The contractor will pay for all damaged fencing and all damaged concrete and landscaping as determined by the agency. The contractor will also restore the ground to its previous condition. 4. This agreement is a month to month lease and in no case will the agreement extend beyond the termination of the contractors contract for the completion of Main Street Phase H improvements. Since the contractor has only a sixty (60) working day contract for the completion of Main Street Phase H streetscape improvements, the lot would be vacated near the beginning of September. The interim use of the lot does not conflict with any immediate activities on the site. RECOMMENDATION: It is therefore staffs recommendation that the Community Development Commission authorize the Agency Administrator to execute a letter of agreement with Marina Landscaping, Inc. for the month to month lease of 423 North "E" Street for $200 per month. Henderson 1, DEVELOPA. _NT DEPARTMENT Executive Director £,VT DO'P June 15, 1993 Mr. Bob Cowan MARINA LANDSCAPE INC. 1702 Armstrong Avenue Irvine, California 92714 Dr. Mr. Cowan: The Economic Development Agency of the City of San Bernardino agrees to lease Marina Landscape Inc. a fenced lot on "E" Street between 4th and 5th Streets in San Bernardino on a month to month basis. This lot is to be used as a construction yard during construction of Main Street Phase II improvements. Our understanding is as such: 1. The lot will be leased for $200 a month, the first month pro-rated from 6/15/93 ($100). 2. Marina is to supply the Agency with one million dollars general liability insurance and evidence of worker's compensation. The Agency is to be named as additional insured and we must receive a certificate and an endorsement for our status as additional insured prior to occupancy. 3. Marina will pay for all damaged fencing and all damaged concrete and landscaping as determined by the Agency. The Marina will also restore the ground to the same condition in which Marina found the site prior to it's occupancy. 4. Marina will be responsible for any and all permits or approvals required by the City of San Bernardino as they may affect the use of the subject property. 5. This agreement shall be terminated upon seven (7) days notice by either party. If Marina fails to remove all material within seven (7) days, Agency shall remove and store material at Marina's expense. 6. This agreement is a month-to month lease to be terminated by either party as above; however, in no case shall this agreement extend beyond the termination of Marina's contract for the completion of Main Street Phase II improvements.
