Bids for this project were opened at 2 : 00 p.m. , Tuesday,
6-15-93 .
A total of 7 bids were received, ranging from $695, 878 . 00
to $847 , 606 . 75 . The low bid of $695 , 878 . 00 is 2 . 60 over the
Engineer' s Estimate of $678 , 055 . 00 .
Below is the total estimated project cost, based upon the
actual low bid price.

Construction Engineering (W.O. #1994) 32 , 000 . 00
Consultant' s Fee- Prepare Time Space Diagram 29 , 000 . 00
Sub-Total $ 756 , 878 . 00
Contingencies (5%) ± 37 , 122 . 00
TOTAL ESTIMATED PROJECT COST $ 794,000.00
I An amount of $778 , 000 Federal-Aid Congestion Management -
Air Quality (CMAQ) Fund, has been approved to finance 100% of the
total project cost. However, this amount can be increased by
10 - 15% to cover any project cost overrun. These funds have
been allocated under Account No. 242--362-57306 .
The Consultant' s fee of $60 , 000 , for preliminary engi-
neering design services , and $5 , 000 for checking these plans by
I City Forces , was financed from the Traffic Systems Fee Fund,
under Account No. 250-670-57477 .
We recommend that a contract be awarded for the low bid
price .
URGENCY CLAUSE:
The contract must be awarded on 6-21-93 , in order for the
completion date to be prior to Thanksgiving (the start of the
Christmas Shopping season) .

1 RESOLUTION NO.
2 RESOLUTION OF THE CITY OF SAN BERNARDINO AWARDING A
CONTRACT TO THE SUPERIOR SIGNAL SERVICE CORPORATION FOR TRAFFIC
3 SIGNAL MODIFICATIONS AND INTERCONNECT IN THE CENTRAL BUSINESS
DISTRICT.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
5 CITY OF SAN BERNARDINO AS FOLLOWS:
6 SECTION 1 . Superior Signal Service Corporation is the
7 lowest responsible bidder for: Traffic Signal Modifications and
8 Interconnect in the Central Business District, per Plan No. 8805 .
9 A contract is awarded accordingly to said bidder for the total
10 amount of $695 , 878 . 00 , but such award shall be effective only
11 upon the contract being fully executed by both parties. All
12 other bids , therefore, are hereby rejected. The Mayor is hereby
13 authorized and directed to execute said contract on behalf of the
14 City; a copy of the contract is on file in the office of the City
15 Clerk and incorporated herein by reference as fully as though set
16 forth at length.
17 SECTION 2 . This contract and any amendment or modifica-
18 tions thereto shall not take effect or become operative until
19 fully signed and executed by the parties and no party shall be
20 obligated hereunder until the time of such full execution. No
21 oral agreements , amendments , modifications or waivers are
22 intended or authorized and shall not be implied from any act or
23 course of conduct of any party.
24 SECTION 3 . This resolution is rescinded if the parties
25 to the contract fail to execute it within sixty (60) days of the
26 passage of this resolution.

FEDERAL AID .PROJECT NO. CMAQLG-5033(6) TRAFFIC SIGNAL

As you can see from the date on the front cover , bids will be
opened on JUNE 15 , 1993. In the event you find errors in the
documents or wish us to make changes , please advise our office a
minimum of 7 working days before the bid opening so we can

SUBJECT: Contract Documents for Traffic Signal Interconnect Project in
the Central Business District

In response to our submittal of contract documents for the subject project
on May 24, 1993, you have indicated that an addendum needs to be issued to
delete the mandatory arbitration provision.
Since this project is Federal-Aid funded the Plans and Specifications are
subject to review and approval of the California Department of
Transportation (Caltrans) prior to bidding. To revise the arbitration
clause would require additional Caltrans' review.
The question of whether staff should pursue a revision to the arbitration
clause has been before the Mayor and Common Council on several occasions
and was referred to Legislative Review Committee. No definitive direction
has been received regarding the matter.
To avoid disruption of downtown traffic during the Christmas shopping
season, we have planned to complete construction before Thanksgiving. In
order to meet that timetable, we must receive bids by June 15, 1993. Any
significant changes to the Contract Plans and Specifications will have to
go back to Caltrans for review and could result in slippage of the bid
date. We are unable to estimate how long Caltrans would take to process
our request for change.
The provisions for mandatory arbitration has been in our Federal-Aid
Specifications for many years and has not caused significant problems. We
feel the presence of this provision will not affect the outcome of the
bidding process or settlement of any claims submitted by the Contractor.

As we previously advised your department, the binding arbitration
provision of the Cal Trans Specs have not been deleted ( see
attached). As you know, this office cannot support binding
arbitration due to the increased liability inherent in a procedure
which does not allow judicial review. We are, therefore, returning
the contract documents to you .
