STAFF REPORT
Adopt a Resolution abandoning proceedings for proposed Assessment District
No. 1000 for the installation and maintenance of landscaping in Waterman
Avenue between the I-10 Freeway and Baseline Street.
On May 7, 1990, the City Clerk and City Engineer were authorized to proceed
with Assessment District No. 1000 for the improvement of Waterman Avenue
between the I-10 Freeway and Baseline Street by the installation and
maintenance of landscaping.
On March 2, 1992, Resolution of Intention No. 92-81 was adopted which set a
public hearing for April 6, 1992. Assessment District Boundary Map No. 1000
was filed in the office of the County Recorder on March 10, 1992 in Book 64
I of Assessments, page(s) 93 and the Resolution of Intention was published on
March 10, 1992.
On April 6, 1992, the hearing was held and protests were received. The
hearing was continued to May 4, 1992 and again protests were received. It
was then determined by motion to terminate the proposed Assessment District.
Subsequent attempts were made to reduce the size and scope of the District
at the direction of the Mayor in the hopes of getting Waterman Avenue
landscaped but the responses from the affected property owners were still
negative. Later, the Economic Development Department was involved and they
have taken over the project and a contract has been awarded to install the
landscaping so there is no further need for the proposed assessment
district.
As the Resolution of Intention has been adopted, it is necessary to adopt a
Resolution abandoning the proceedings and attached is the pertinent
Resolution for adoption.

5 A RESOLUTION OF THE CITY OF SAN BERNARDINO ABANDONING PROCEEDINGS
UNDER CHAPTER 12.90 OF THE MUNICIPAL CODE IN PORTIONS OF WATERMAN AVENUE
6 BETWEEN INTERSTATE HIGHWAY 10 AND BASELINE STREET FOR THE INSTALLATION AND
MAINTENANCE OF LANDSCAPING IN THE CITY OF SAN BERNARDINO, CALIFORNIA

WHEREAS, the Mayor and Common Council of the City of San Bernardino

on the 2nd day of March, 1992 , passed and adopted its Resolution of
9
Intention, being Resolution No. 92-81, to order the work described therein to
10
be done, and
11
WHEREAS, Assessment District Boundary Map No. 1000 was filed in the
12
office of the County Recorder of San Bernardino County, California, on the
13
10th day of February, 1992, in Book 64 of Assessments, page(s) 93, said date
14
being 25 days prior to the hearing date in the manner required by law, and
15
which said Resolution of Intention was duly published as required by law; and
16
17 notice of improvement having been given in the manner required by law, and
written objections and protests to the proposed work or the extent of the
18
district to be assessed were heard and considered.

20 NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF
21 THE CITY OF SAN BERNARDINO AS FOLLOWS:

23 SECTION 1. That pursuant to a motion made at their meeting of May
24 4, 1992, the Mayor and Common Council of the City of San Bernardino hereby
order that proceedings described in said Resolution of Intention be abandoned
25
and the proceedings terminated.

RESOLUTION ABANDONING PROCEEDINGS AD 1000
1 SECTION 2 . The City Clerk hereby is directed to present a
2 certified copy of this Resolution Abandoning Proceedings to the County
3 Recorder's Office for recording and for indexing in the Book of Assessments.
4 I HEREBY CERTIFY that the foregoing resolution was duly adopted by the
5 Mayor and Common Council of the City of San Bernardino at a
6 meeting thereof, held on the day of 1993, by the
7 following vote, to wit:
