07-20-92 - Resolution No. 92-277 adopted approving the Five-Year

04-05-93 - Resolution No. 93-100 adopted approving the 1992/93 to
1996/97 Capital Improvement Program.

STAFF REPORT
In November of 1989 , voters approved Measure
authorizing San Bernardino Associated Governments, acting as the
Transportation Authority, to impose a one-half of one percent
retail transactions and use tax applicable throughout the county.
This tax can only be used for transportation improvement and
traffic management programs authorized in the expenditure plans
set forth in Ordinance No. 89-1 of the authority.
The referenced ordinance requires each local agency to
expend funds based on a 5-year Capital Improvement Program and
twenty-year transportation plan adopted by resolution for these
funds. Additionally, it is mandatory that each agency update the
plan and program each year.
The proposed Five-Year Program for Measure "I" Local Funds
is based upon the City' s approved Five-Year Capital Improvement
Program.
Measure "I" Arterial Funds are not included in the Five-
Year Plan, since SANBAG will prepare the plan for expenditure of
these funds.
SANBAG is recommending over programming of the projects to
insure projects are eligible and to allow for slippage. Amend-
ments to the plan can be made throughout the year by action of the
Mayor and Common Council, which may minimize the need to amend the
program.
Adoption of an updated Twenty-Year Transportation Plan is
not necessary, since it has not been amended.
We recommend the Five-Year Program for Measure "I" Local
Funds be adopted.

2 RESOLUTION OF THE CITY OF SAN BERNARDINO ADOPTING THE
FIVE-YEAR CAPITAL IMPROVEMENT PROGRAM FOR MEASURE "I" LOCAL
3 EXPENDITURES.
4 WHEREAS, San Bernardino County voters approved passage of
5 Measure "I" in November, 1989 , authorizing San Bernardino
6 Associated Governments, acting as the San Bernardino County
7 Transportation Authority, to impose a one-half of one percent
8 retail transactions and use tax applicable in the incorporated
9 and unincorporated territory of the County of San Bernardino;
10 and,
11 WHEREAS, revenue from the tax can only be used for
12 transportation improvement and traffic management programs
13 authorized in the Expenditure Plans set forth in Ordinance No.
14 89-1 of the Authority; and,
15 WHEREAS, Expenditure Plans of the ordinance require each
16 local jurisdiction receiving revenue from the tax to expend those
17 funds pursuant to a Five-Year Capital Improvement Program and a
18 Twenty-Year Transportation Plan adopted by resolution of the
19 local jurisdiction; and,
20 WHEREAS, Expenditure Plans of the ordinance also require
21 that each local jurisdiction annually adopt and update the Five
22 and Twenty-Year plans.
23 NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON
COUNCIL OF THE CITY OF SAN BERNARDINO, AS FOLLOWS:
24 SECTION 1 . The "FIVE-YEAR CAPITAL IMPROVEMENT PROGRAM, "
25 for Measure "I" Program of Local Expenditures, a copy of which is
26 attached hereto, marked Exhibit "A" and incorporated herein by
27 reference as fully as through set forth at length, is hereby
28 adopted.

1 SECTION 2 . The "TWENTY-YEAR TRANSPORTATION PLAN, " for
2 Measure "I" Program of Local Expenditures, adopted by Resolution
3 No. 92-277 , on July 20 , 1992 , is still in effect.
4 I HEREBY CERTIFY that the foregoing resolution was duly
5 adopted by the Mayor and Common Council of the City of San
6 Bernardino at a meeting thereof, held on the
7 day of 1993, by the following vote, to-wit:
