REQUEST AND LOCATION
The applicant requests an amendment to the General Plan Land Use Plan to change the
designation from RL, Residential Low, to RS, Residential Suburban, on approximately 30.59
acres of land located at the southeast corner of on the south side of Irvington Avenue, between
Olive Avenue and Walnut Avenue, directly north of the Cable Creek Flood Control Channel (see
Attachment A.3 of the Staff Report to the Planning Commission). Staff proposes to increase the
amendment area by approximately 2.65 acres to include 16 parcels of record bordering the
western periphery of the subject property (see Attachment A.4 of the Staff Report to the
Planning Commission).
Concurrently, and contingent upon adoption of General Plan Amendment No. 92-06, the
applicant requests approval of Tentative Tract No. 15407, to establish a residential subdivision
consisting of 110 single-family lots and 3.2 acres of open space .
KEY POINTS
• The existing RL designation permits single-family detached residential development at
a maximum density of 3.1 dwelling units per gross acre.
• The proposed RS designation permits single-family detached residential development at
a maximum density of 4.5 dwelling units per gross acre.
• The subject property is contiguous to RS-designated properties to the east and north,
which have been subdivided and developed in general accordance with current RS
standards. Sixteen parcels adjacent to the western boundary of the subject property are
also subdivided in accordance with RS standards. Thus, if the subject property is
redesignated RS, the subsequent potential development would be consistent with the scale
and rhythm of existing subdivisions.
• Due to topographic constraints and Flood Control setback requirements, the actual
density proposed under Tentative Tract No. 15407 is 3.6 dwelling units per gross acre.
• Tentative Tract No. 15407 complies with all of the development standards of the
Development Code and will be consistent with the General Plan if the land use
designation is changed to RS.

ENVIRONMENTAL DETERMINATION
On June 18, 1992, the Environmental Review Committee reviewed two Initial Studies, separately
evaluating the proposed RS designation and the proposed subdivision and recommended Negative
Declarations for both requests.
MAYOR AND COMMON COUNCIL OPTIONS
1. The Mayor and Common Council may adopt the Resolution (Exhibit 2); adopt the
Negative Declaration for Tentative Tract No. 15407; and approve Tentative Tract No.
15407, based on the Findings of Fact, and Subject to the Conditions of Approval and
Standard Requirements contained in the Staff Report to the Planning Commission
(Exhibit 1).
2. The Mayor and Common Council may deny General Plan Amendment No. 92-06 and
Tentative Tract No. 15407.
PLANNING COMMISSION RECOMMENDATION
The amendment request was considered by the Planning Commission at a noticed public hearing
on November 4, 1992. No one was present to speak in opposition to the proposal. The Planning
Commission placed a motion on the consent calendar to approve General Plan Amendment and
Tentative Tract No. 15407. The Commission then voted to recommend adoption of the Negative
Declarations and approval of General Plan Amendment No. 92-06 and Tentative Tract No.
15407 (Commissioner Stone abstained from the vote due to conflict of interest concerns).
STAFF RECOMMENDATION
Staff recommends that the Mayor and Common Council:
1. Adopt the resolution, copy attached, which adopts the Negative Declaration and approves
General Plan Amendment No. 91-06 as presented.
2. Adopt the Negative Declaration for Tentative Tract No. 15407; and
3. Approve Tentative Tract No. 15407.

Subject: General plan amendment No. 92-06, Tentative Tract 15407
As a property owner on Irvington Ave, I received notice of the proposed amendment
and will be unable to attend the Mayor and Common Council meeting on 6 July 93, but
would like to express my views on this proposed change.
I support the change from RL to RS, as long as the developed homes maintain a high
construction and architectural quality standard that enhances and compliments the
surrounding areas. The density increase is of less concern to me than any compromise
in the quality of the resulting developed property.

REQUEST AND LOCATION
The applicant requests an amendment to the General Plan Land Use
Plan to change the designation from RL, Residential Low, to RS,
Residential Suburban, on approximately 30.59 acres of land (the
subject property) located on the south side of Irvington Avenue,
between Olive Avenue and Walnut Avenue, directly north of the Cable
Creek Flood Control Channel (see Proposed Amendment Area,
Attachment A. 3) . Staff proposes to increase the amendment area by
approximately 2. 65 acres to include 16 parcels of record bordering
the western periphery of the subject property (see Recommended
Amendment Area, Attachment A.4) .
Concurrently, and contingent upon adoption of General Plan
Amendment No. 92-06, the applicant requests approval of Tentative
Tract No. 15407, to establish a 110-lot, single-family residential
subdivision.
SITE AND AREA CHARACTERISTICS
The subject property is comprised of four contiguous, irregularly-
shaped parcels, and is currently undeveloped. The topography of
the subject property slopes in a southeasterly direction from an
elevation of approximately 1,710 feet m.s.l. to an elevation of
approximately 1, 660 feet near its southerly boundary. A knoll,
forming the southeasterly boundary of the subject property, rises
to an elevation of approximately 1,695 feet and adjoins the Cable
Creek Flood Control Channel (see proposed Tentative Tract Map,
Attachment B. 6) .
Approximately 39 mature trees are located within the boundaries of
the subject property, including a wind row of 29 trees along
Irvington Avenue. The flora is otherwise characterized by
chaparral, sage scrub and ruderal species in a highly disturbed and
degraded state due to human encroachment.
The balance of the recommended amendment area consists of 14
developed single-family residential lots and two vacant lots,
located on the east side of Olive Avenue, as recorded under Tract
Nos. 10183 and 10184. Pad elevations descend southerly, from
1,711.6 feet m.s.l. at the southeasterly corner of Irvington and
Olive Avenues (Lot 1, Tract 10184) , to 1,677 feet on lot 9 of Tract
10183 .
Tract 10181, a 50-lot subdivision, adjoins the subject property to
the east, which was developed under the R-1-7,200 standards in
place prior to the adoption of the 1989 General Plan. Facing the

amendment area to the north side of Irvington Avenue is Tract
10162 , also developed under R-1-7, 200 standards, as do four
contiguous large custom lots beginning at the northeast corner of
Irvington and Olive Avenues.
BACKGROUND
Prior to the 1989 adoption of the General Plan, the amendment area
was zoned R-1-7200 (4 . 5 du/ac) . City records indicate that a
tentative tract map (TT 10185) was previously approved at this
density, though never recorded, on parcels comprising the subject
property.
On June 6, 1989, Tentative Tract No. 14404 was approved to allow
recordation of a 77-lot subdivision under the newly adopted RL
designation, which requires a minimum lot size of 10,800 square
feet and allows a maximum density of 3. 1 units per acre. The most
recent one-year extension of time for Tentative Tract No. 14404 was
approved by the Planning Commission on August 4, 1992 .
On March 27, 1992 , the applications for General Plan Amendment No.
92-06 and General Plan Amendment No. 15407 were submitted to the
Planning Division. The applications were deemed complete on April
24 , 1992 . On July 16, 1992, the DRC/DRC formally cleared the
projects to the Planning Commission.
CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA) STATUS
Two Initial studies were prepared: one that generally addresses the
potential environmental impacts resulting from development of the
subject property at the maximum density permitted under the RS
designation; the other evaluates specific impacts that may result
from developing the property as proposed under Tentative Tract No.
15407. The Initial Studies were presented to the Environmental
Review Committee (ERC) On June 18, 1992. The ERC determined that
neither the proposed amendment nor the proposed subdivision would
have an adverse impact on the environment, and Negative
Declarations were recommended. The proposed Negative Declarations
were available for public review and comment from June 25, 1992 to
July 15, 1992. No comments were received during the public review
period.
While the expanded amendment area, as recommended by staff, was not
specifically mentioned in the GPA 92-06 Initial Study, the
inclusion of the additional 2 . 65 acres along Olive Avenue as part
of the map change will not result in additional or amplified
impacts. All but two of those parcels in question are fully

developed, and the size and shape of each parcel is already
consistent with the standards under the proposed RS designation.
The redesignation of those parcels from RL to RS, thus, will not
facilitate the development of more intensive uses of the
properties, nor will it encumber future improvements to those
properties; the result will only be to facilitate a more logical
mapping of land use boundaries should the applicant's request be
approved.
COMMENTS RECEIVED
Council Offices (Ward 5)
In comments submitted to staff, Councilman Minor stated that he
does not support any general plan amendment that will result in an
increase in density.
Verdemont Area Property Owners
The Planning Division has received six letters of support for the
proposed General Plan Amendment and Tentative Tract from owners of
several large, undeveloped parcels in the Verdemont area. All of
the properties identified under their ownership are located west of
Olive Avenue and are currently designated RE, Residential Estates,
or RL, Residential Low.
ANALYSIS
I. GENERAL PLAN AMENDMENT
Existing Land Use Designation
The General Plan states that an objective of the City shall be to
"promote the development of low-density, large lot, high quality
single-family detached residential units" within the RL,
Residential Low, land use designation (Objective 1. 10) .
The RL designation permits single-family detached residential
development at a maximum density of 3.1 dwelling units per gross
acre. Assuming no other constraints, the undeveloped 30.59 acres of
the amendment area could yield up to 95 lots (given the actual land
configuration, topographic limitations and Flood Control District
setbacks, however, Tentative Tract No. 14404 was approved for only
77 lots) .
General Plan Policies included in the Design and Development
Standards for RL require the use of extensive site landscaping and,

where applicable, linkages to master planned equestrian and/or
pedestrian trail systems.
Proposed Land Use Designation
General Plan Objective 1. 11 describes the intent of the RS,
Residential Suburban, land use designation as follows:
Promote the development of single-family detached units
in a high quality suburban setting.
The RS designation permits single-family detached residential
development at a maximum density of 4 .5 dwelling units per gross
acre. The maximum yield for the undeveloped portion of the
amendment area would then be 138 lots. Due to characteristics
specific to the subject property, the maximum actual yield would
increase from approximately 77 lots to approximately 110 lots, as
demonstrated by tentative tract maps drawn according to the
standards of each designation (TT 14404 and TT 15407,
respectively) .
Similar to the design and development policies for the RL
designation, General Plan Policy 1. 11. 31 encourages developers to
incorporate greenbelts, pedestrian paths and community amenities
within RS subdivisions.
Land Use Compatibility/General Plan Consistency
General Plan Policy 1.8. 31 states:
Establish zoning which encourages developers to design
residential projects which maintain the scale and rhythm
of the existing lot divisions of 7,200 square feet and
larger, or use other creative design and planning
solutions which establish and maintain a distinctive
character and environment
The subject property is contiguous to RS designated properties to
the east and north, which have been subdivided and developed in
general accordance with current RS standards. As previously
mentioned, the 16 parcels adjacent to the western boundary of the
subject property are also subdivided according to RS standards,
although they are currently designated RL. Therefore, if the
subject property is redesignated RS, the subsequent potential
development would be compatible with existing development and
"maintain the scale and rhythm of existing lot divisions. "

The proposed RS designation may also be more appropriate for the
site, given the proximity of the medium-to-high density apartment
complex to the west. Although the subject property is largely
buffered from the apartment complex by the existing lots along
Olive Avenue, the transition in density created by an RL
development may be so abrupt as to compromise the desirability of
a larger lot subdivision.
If the amendment area is redesignated RS, approximately 26 acres of
undeveloped RL-designated land east of the subject property will
remain, isolated from other RL-designated properties (Attachment
C) . Although a 65 to 80-lot RL subdivision could potentially be
created from these parcels, the likelihood of such a development
may be reduced without a proximal relationship to other properties
under the same designation. While staff may favorably consider a
redesignation of these parcels if an application is submitted, it
has not been the Planning Division's policy to initiate a
recommendation in such cases, except as a necessary condition to
supporting an applicant's request; staff has found no necessity to
do so in this case, as it has with the 16 parcels along the
westerly boundary of the subject property.
II. TENTATIVE TRACT
Subdivision May Act
Tentative Tract No. 15407 was submitted in compliance with Section
66426 of the Subdivision Map Act. The subdivider has agreed to
comply with the provisions imposed by the City under the authority
of Chapter 4 of the Map Act.
Density and Lot Design
The proposed 30.59 acre subdivision into 110 single-family
residential lots is a permitted use within the proposed RS,
Residential Suburban, General Plan land use designation, which
allows a maximum density of 4. 5 dwelling units per gross acre and
a minimum lot size of 7,200 square feet.
The proposed density is 3 . 6 dwelling units per gross acre. All lots
meet or exceed the required minimum 7,200 square-foot area as well
as the minimum 60-foot lot widths (66 feet for corner parcels) and
minimum 100 foot lot depths. Lot sizes are increased to a minimum
of 10, 055 square feet for the lots fronting Irvington Avenue, to
ensure greater compatibility with the larger lots facing them on
the north side of Irvington.

Open Space
The southern boundary of the subject property is located within the
Hillside Management Overlay and adjoins the Cable Creek Flood
Control Channel. The San Bernardino County Flood Control District
requires a 100-foot, non-buildable setback from the Cable Creek
right-of-way. To provide this setback, as well as comply with
Hillside Management Overlay District standards, a remainder area of
approximately 3 .2 acres along the southern portion of the subject
property shall be maintained as open space, and designated Lot "A" .
The lower portion will be landscaped as an open park area, while
the knoll will be retained in a natural, undisturbed state. The
formation of an assessment district among the property owners
within the tract shall be required for the continued maintenance of
the open space area.
Access and Circulation
Pursuant to Development Code Section 19 . 30. 200 (6) , all new
subdivisions shall have, or provide, at least two standard routes
of access, which are defined as public roads with a minimum paved
width of 24 feet. The proposed subdivision can be accessed from
either Palm Avenue, via Irvington Avenue, or Pine Avenue, via
Irvington or Washington Avenue. Both Palm and Pine exceed the
criteria for standard access routes.
The internal street, sewer and water systems of the proposed
project connect to those established by adjacent Tract 10181 to the
east. Stephanie Avenue and Melissa Street, which currently
terminate at the easterly boundary of the subject property, will be
continued through the proposed tract. Due to the design of Tract
10181, key lots are unavoidably created at lots 14 and 110 of
Tentative Tract 15407. Gregory Street, a cul-de-sac constructed by
Tract 10181 with lots fronting on its east side and bulb, will be
completed and improved as a result of new parcels created on its
west side.
The map proposes to vacate the southernmost portion of Olive
Street. Presently, Olive Street ends at the Cable Creek Channel.
The map proposes a knuckle at Brenda Drive, with ownership of the
vacated portion of Olive Street to be divided amongst the adjoining
parcels.
Traffic Impacts
The City Traffic Engineer has determined that additional trips from

the proposed project are not sufficient to cause a significant
impact on the adjacent street system. Total traffic volume will be
less than the street design capacity. However, a traffic systems
fee, estimated in the amount of $14, 564, shall be collected prior
to the final recordation of the map.
Drainage
Most of the runoff from the subject property presently drains into
the Stephanie Avenue storm drain. Based on the recommendations of
drainage studies prepared in 1989 and 1991, the runoff created by
the proposed development will primarily be directed to catch basins
in the southern portion of the tract, and outlet into Cable Creek
via drainage easements traversing Lot "A". Final construction plans
for the proposed drainage system will be reviewed and approved by
the Public Works Department and the County Flood Control District.
Biological Resources (excluding trees)
The site is located within the Biological Resources Management
Overlay (BRMO) , as identified in Section 10, Figure 41, of the
City's General Plan. A biological assessment was prepared by Joe
Gorman PhD Associates in April of 1992 . The consultants concluded
that no sensitive plant or wildlife species, as determined by the
criteria and listings of rare, threatened or endangered species,
were found, nor was evidence of such habitats found on the project
site. Plants identified on the site are representative of species
typically present within Southern California chaparral and related
inland sage scrub communities. Fauna was limited to common insect
groups, small invertebrates, reptiles and rodents typically found
within these areas. Generally, the site is in a degraded natural
state, due to repeated discing, off-road vehicle use and other
human-related factors.
Trees on Site
Currently, there are approximately 39 trees on the subject
property, primarily consisting of a wind row of 29 mature olive and
Blue Gum eucalyptus along Irvington Avenue. The trees are located
within the Irvington and Olive ultimate rights-of-way, and thus
must be either relocated or removed.
An arborist report was prepared on March 6, 1989 by Samuel L.
Knapp, ASCA during the review of Tentative Tract No. 14404. The
trees were identified and catalogued in the report and plotted on
a map, which is on file with the Planning Division.

The report concluded that only seven of the 39 trees, all olive
species, were sufficiently viable to be transplanted. The report
identified the remaining trees as diseased or severely damaged due
to "extensive pruning injuries. " It is the recommendation of staff
that the majority of the viable trees be relocated to Lot "A" as
part of the overall landscape/open space plan. Prior to the removal
or relocation of the trees, however, a Tree Removal Permit
application must be reviewed and approved by the Planning Division
and Parks and Recreation Department.
Cultural Resources
The subject property is located within an area of concern for
archaeological resources, as identified in the Historical Element
of the City's General Plan (Section 3.0, Figure 8) . Based on field
surveys and literature reviews conducted in 1988 by Victor C. de
Munck, SOPA and Eileen Garo, it was determined that the potential
for the presence of cultural resources within the project area is
low. Lester Ross, coordinator of the San Bernardino County Museum
Archaeological Information Center, concurred with the findings of
the cultural resources report, and did not recommend any further
review.
CONCLUSIONS
The proposed amendment is in conformance with the goals, objectives
and policies of the General Plan. The proposed amendment is
compatible with all contiguous and surrounding land uses. A change
in land use designation to RS, Residential Suburban, will not
create a significant negative impact on the environment.
Tentative Tract No. 15407 complies with all of the development
standards of the Development Code and will be consistent with the
General Plan if the land use designation is changed to RS.
Tentative Tract No. 15407 is in compliance with the Subdivision Map
Act. It is the conclusion of staff that, based upon the project

RECOMMENDATIONS
Staff recommends that the Planning Commission make a recommendation
to the Mayor and Common Council that:
1. A Negative Declaration be adopted for General Plan Amendment
No. 92-06;

General Plan Amendment Findings
1. The proposed RS, Residential Suburban land use designation is
internally consistent with the General Plan in that such a
designation is not in conflict with the goals, objectives and
policies of the General Plan, and will facilitate the
continued and orderly development of the area.
2. The proposed amendment will not be detrimental to the public
interest, health, safety, convenience or welfare of the City.
Factors related to the potentially higher density of
residential development, such as increases in traffic or
surface runoff, will not significantly impact existing or
future public services.
3. The proposed amendment would maintain the appropriate balance
of land uses within the City in that the proposed amendment
will not change the single-family residential designation of
the subject property, and is compatible with the suburban
residential character of development within the immediate
vicinity.
4. The amendment area is physically suitable for the requested
land use designation and anticipated development in that the
size, configuration, topography and access to improved public
roads and other public services are adequate to facilitate the
development of the uses permitted within the RS, Residential
Suburban, General Plan land use designation.

C. DISCUSSION OF ENVIRONMENTAL EVALUATION AND MITIGATION MEASURES

Amendment Site and Surrounding Area Characteristics: The site is
comprised of 4 adjoining, irregularly-shaped parcels,
which are all vacant and surrounded to the north, west
and east by previously approved and developed resident-
ial tracts and/or individual owner/builder residences.
A portion of the site to the west also abuts an
existing apartment complex. The adjoining properties
to the south are a Public Flood Control Channel and a
vacant, small knoll area. Under the present RL,
Residential Low, General Plan land use designation the
property was previously reviewed and approved for an 82
lot residential subdivision under Tentative Tract No.
14044. The General Plan Amendment applicant's request to
change the land use designation to RS, Residential
Suburban is in conjunction with a proposed Tentative
Tract No.15407 application for an 110 lot subdivision
for single-family residential development.

ENVIRONMENTAL EVALUATION AND MITIGATION MEASURES DISSCUSSION
1. EARTH RESOURCES - la. Earth Movement/Grading
If the proposed General Plan Amendment is approved, future
on-site grading will likely occur in conjunction with subsequent
residential development of the 30.59 acre site. The applicants
are processing concurrently a proposed 110 lot subdivision with
estimates involving approximately 115,510 cubic yards of cut and
65,306 cubic yards of fill, respectively. Any such future
grading activities and/or noise related impacts shall require a
a pre-approved soil erosion and dust control plan that would
include: sand bagging, continued use of water trucks, pre-
approved transport routes for any on or off-site soil transfer
as well regulating noise levels and hours of construction. By
following such procedures and techniques any potential impacts
to adjoining residential property owners resulting from these
grading and/or soil transport activities will be reduced to
acceptable levels of non-significance.
2. AIR RESOURCES - 2c. High Winds Area
The subject site is located in a City designated High Winds
Hazard Area. All proposed residences, including auxiliary
buildings shall meet and/or exceed Code requirments for
additional structural, roofing or other veneer exterior
wall treatments to withstand the hazards related to the
presence of these high winds. Following such construction
techniques and use of pre-approved materials will reduce
any potential impacts to within acceptable levels. The
approval or denial of the General Plan Amendment will not
affect or alter these High Wind Area constrution requirements.
3. WATER RESOURCES - 3a. , 3b. & 3e. Absorption Rates, Runoff &
Discharge and Potential Exposure to Flood Hazards
If the General Amendment proposal is approved, the site will
have the potential for future residential development that will
increase hardscapes areas and reduce permeable surface areas,
resulting in greater amounts of runoff during occasional periods
of heavy precipitation. All such runoff shall be directed
towards and into approved City storm drain facilities.
For the Verdemont subject site area additional on and off-site
infrastructure improvements and/or developer contributions
towards same for future development shall be required as
Conditions of Approval of subsequent tract proposals.
ENVIRONMENTAL EVALUATION AND MITIGATION MEASURES DISCUSSION (CONT) .
4 . BIOLOGICAL RESOURCES - 4a. , 4d. Biological Resource Management
Overlay District and Possible Mature Tree Removal/Replacment
The subject site is located within a City designated Biological
Management Overlay Disrict for which the applicant was required
to complete a Biological Resources Assessment Study. This study
was undertaken and a report submitted to the City for review,
which concluded that no sensitive plant nor wildlife species,
as determined by the criteria and listings of rare, threatened
or endangered species, were found or evidence existing for their
presence over the subject site. Typical Chaparral and Inland
Sage Scrub plant communities present on the site have been
degraded from repeated evidence of disking, motorcycle use
and related presence and use of surrounding residential
owners of the subject property.
Additionally, the presence of approximately 39 mature trees,
principally planted Blue Gum eucalyptus and Olive tree species
required the applicant's completion and submittal of an arborist
report. This study was conducted and each tree was identified on
the site, it's condition noted and recommendation for the
potential for transplanting and/or removal that will be part of
the Conditions of Approval of the proposed tract submitted in
conjunction with the General Plan Amendment.
By addressing these biological issues and concerns, potential
impacts will be addressed and mitigated to levels of non-
significance.
6. LAND USE - 6a. Proposed Land Use Designation Change -
General Plan Amendment No. 92-06 proposes to change the land
use designation of the four existing, legal parcels comprising
a total 30.59 acres from RL, Residential Low, to RS,
Residential Suburban. If approved the minimium sized lot area
would be reduced from 10,800 to 7,200 square feet and would
allow a dwelling unit density maximum of up to 4.5 units per
gross acre, subject to Planning Commission approval.
The applicant has concurrently submitted a proposed 110 lot
residential tract subdivision, with lots ranging in size from
7,202 to 14,353 square feet and a proposed density of 3.6
dwelling units per acre, which is within the permitted maximum
density referenced above for RS, Residential Suburban, General
Plan land use designations.

9. TRANSPORTATION/CIRCULATION - 9c. Alterations of Circulation
Patterns and related Traffic Volume Increases
The proposed General Plan Amendment, if approved, will not
alter the requirements for providing adequate ingress/egress or
internal circulation patterns for any subsequent residential
tract submittal. The only notable change would be the permitted
smaller lot size and resulting allowable greater density for
RS, Residential Suburban, General Plan land use designations.
The applicants have submitted concurrently a proposed 110 lot
residential tract subdivision that shall be reviewed for all
potential traffic and circulation issues to ensure adequate
site design, ingress/egress and good internal circulation
patterns.
The General Plan Amendments approval would not pose any
significant impacts to surrounding major arterials nor the
creation of any traffic related congestion problems beyond
those thresholds typically present in other similarily
designated Residential Suburban areas of the City. The subject
site was previously approved for an 82 lot single family
subdivison under Tentative Tract No. 14044 and the RL,
Residential Low land use designation.
10. UTILITIES - 10a. , 10b. , & 10c. Fire, Police and School Area
Infrastructure Developments
The proposed General Plan Amendment site is located in the
Verdemont Area which, if approved or denied, shall require
future residential tract developers to contribute towards the
construction or future development of needed public services
in this portion of the City.
The need for additional fire and police stations to lessen
response time as well as additional school construction at all
levels for better serving this portion of the City is a
recognized need and priority that City agency reviews have
stressed for all project proposals within this area, including
General Plan Amendment requests.
Additional Assessment Districts as well other infrastructure
fees and/or actual on and off-site improvement construction
requirements shall be determined at the specific project level
by all appropriate City agencies or other applicable governing
jurisdiction, such as the San Bernardino County Flood Control
District. Compliance with these Conditions of Approval and
Standard Requirements will reduce development and occupational
risks to within acceptable levels for the proposed subject
area.
ENVIRONMENTAL EVALUATION AND MITIGATION MEASURES DISCUSSION (CONT. )
13. CULTURAL RESOURCES - 13a. Archaeological Cultural Resources
The proposed General Plan Amnendment is located in a City
designated area of potential Archaeological and/or Historical
Cultural Resources. This required the applicant to complete an
archaeological site field study as well as an ethnohistorical
and records search on the subject property, as per requirements
of Dr. Ross of the San Bernardino County Archaeological Infor-
mation Center. The study and report were completed and the
subject property was determined to have a low potential for the
presence of cultural resources due to the site's low-lying
topography and periodic flooding, resulting in an area unlikely
for prehistoric aboriginal or more recent occupation. A
Condition of Approval shall be added that if, in the process of
grading and/or other construction activities, any artifiacts or
other potential cultural resources are uncovered, all work
shall cease immediately until a qualified archaeologist is
contacted for further site evaluation.
14. CUMULATIVE IMPACTS - 14c. Potential for Future Cumulative
Significance
The proposed General Plan Amendment, if approved, would allow
the potential for a greater density of home development then
previously permitted under the RL, Residential Low land use
designation.
The applicant has proposed, concurrently, a residential tract
of 110 lots if the RS, Residential Suburban land use change is
approved that would be 28 more than previously approved for
the subject site under the RL, Residential Low designation.
As previously described under the Utilities Section, there is
a recognized need for additional public services and infra-
structure upgrades in the Verdemont Area. While this specific
General Plan Amendment proposal's approval or denial will not,
of itself, represent a significant impact, continued future
development of the Verdemont area will require provisions to
ensure this and all portions of the City adequate public
services and levels of protection.

Tentative Tract Findings
1. The proposed map is consistent with the General Plan, in that
the purpose of the map is to provide for the development of
single-family homes at a density of 4 . 5 dwelling units per
acre, as permitted within the RS, Residential Suburban,
General Plan land use district.
2. The design of the proposed subdivision is consistent with the
General Plan in that the minimum proposed lot size is 7,200
square feet, as required in the RS land use district.
3 . The site is physically suitable for the type of development
proposed, in that the tentative map conforms to the
subdivision design standards of the Development Code, the
proposed streets comply with the minimum standards of the
Public Works Department, the two routes of access meet City
standards and water and sewer service can be accomplished
through connections to existing infrastructure.
4 . The site is physically suitable for the proposed density of
development in that the subdivision design complies with all
lot area and dimensional standards, as well as required public
improvements standards.
5. The design of the subdivision and proposed improvements are
not likely to cause substantial environmental damage or
substantially or avoidably injure fish or wildlife or their
habitat. A biological assessment report was prepared and found
not evidence for the presence of any rare, threatened or
endangered plant or animal species. Storm runoff from the
proposed project falls below the capacity of the Cable Creek
Flood Control Channel. Mitigation measures have been
incorporated into the project design and conditions of
approval to establish an open space area to preserve the area

6. The design of the subdivision or type of improvements is not
likely to cause serious public health problems in that
environmental health concerns are addressed and mitigated
through the design and construction standards of all public
services and public and private structures. Additionally, a
100-foot non-buildable setback from the Cable Creek Flood
Control Channel has been incorporated into the design of the
subdivision to protect future residents from potential storm
runoff overflows.
7. The design of the subdivision or type of improvements will not
conflict with easements, acquired by the public at large, for
access or use of, property within the proposed subdivision, in
that no development shall occur within the required San
Bernardino Flood Control setback.

1. No tree shall be removed, replaced or relocated prior to the
issuance of a Tree Removal Permit.
2 . The final map shall show easements or other mapped provisions
for the placement of centralized mail delivery units. Specific
locations for such units shall be to the satisfaction of the
U.S.P.S. , the Public Works Department and the Planning
Division.
3. Building permits and utility clearances shall be issued in
full compliance with Resolution No. 89-116, Resolution No. 90-
02 and Ordinance No. MC-690.
4. No home shall be constructed, or building permit issued,
without formal design review and approval of a Development
Permit by the review bodies empowered by the City to approve
or deny Development Permits for 110-unit single-family
residential developments.
5. Walls and Fences
a. Wherever block walls, or pilasters in conjunction with
wrought iron fences, are utilized which are visible to
the public, they shall be constructed of either slump
stone, split-faced block, river rock or
stuccoed/plastered block with decorative caps. The walls
shall have articulated planes, by providing at a minimum
of 100 feet of continuous wall, an 18-inch deep by 8-foot
long landscaped recession. Pilasters shall be provided at
every change in direction, every five-foot difference in
elevation and at a minimum of 25 feet of continuous wall.
b. All wood fences that are directly visible from public
view shall be treated with heavy body stains or paints.
C. A wrought iron fence or other Flood Control District
approved decorative barrier shall be constructed along
the Flood Control District's right-of-way adjacent to the
subject property. The use of chain link fencing shall be
prohibited.
6. Prior to the construction of drainage outlets or any other
activity within Flood Control District right-of-way, proper
permits shall be obtained through the District's Field
Engineering Division. At that time, the proposal (s) will be
reviewed with respect to specific requirements.

filed 30 days prior to the expiration date and for
good cause , grant one time extension not to exceed
12 months . The review authority shall ensure that

This permit or approval is subject to all the
applicable provisions of the Development Code in
effect at the time of approval . This includes
Chapter 19 . 20 - Property Development Standards , and
includes : dust and dirt control during construction
and grading activities ; emission control of fumes ,
vapors , gases and other forms of air pollution ;
glare control ; exterior lighting design and
control ; noise control ; odor control ; screening ;
signs , off-street parking and off-street loading ;
and , vibration control . Screening and sign
regulations compliance are important considerations
to the developer because they will delay the
issuance of a Certificate of Occupancy until they
are complied with . Any exterior structural
equipment , or utility transformers , boxes , ducts or
meter cabinets shall be architecturally screened by

Amendment Site and Surrounding Area Characteristics: The site is
comprised of 4 adjoining, irregularly-shaped parcels,
which are all vacant and surrounded to the north, west
and east by previously approved and developed resident-
ial tracts and/or individual owner/builder residences.
A portion of the site to the west also abuts an
existing apartment complex. The adjoining properties
to the south are a Public Flood Control Channel and a
vacant, small knoll area. Under the present RL,
Residential Low, General Plan land use designation the
property was previously reviewed and approved for an 82
lot residential subdivision under Tentative Tract No.
14044. The General Plan Amendment applicants request
to change the land use designation to RS, Residential
Suburban is in conjunction with a proposed Tentative
Tract No. 15407 application for an 110 lot subdivision
for single-family residential development.

ENVIRONMENTAL EVALUATION AND MITIGATION MEASURES DISSCUSSION
1. EARTH RESOURCES - la. Earth Movement/Grading
The proposed Tract, if approved, will result in on-site pad
grading which the applicant estimates will involve approximately
115,510 cubic yards of cut and 65,306 cubic yards of fill,
respectively. To reduce potential soil erosion, dust control and
related grading and noise impacts, a pre-approved soil erosion
and dust control plan shall be followed to include: sand
bagging, continued use of water trucks, pre-approved transport
routes for any on or off-site soil transfer as well regulating
noise levels and hours of construction. By following such
procedures and techniques any potential impacts to adjoining
residential property owners resulting from these grading
and/or soil transport activities will be reduced to acceptable
levels of non-significance.
2 . AIR RESOURCES - 2c. High Winds Area
The subject site is located in a City designated High Winds
Hazard Area. All proposed residences, including auxiliary
buildings shall meet and/or exceed Code requirments for
additional structural, roofing or other veneer exterior
wall treatments to withstand the hazards related to the
presence of these high winds. Following such construction
techniques and use of pre-approved materials will reduce
any potential impacts to within acceptable levels.
3. WATER RESOURCES - 3a. , 3b. & 3e. Absorption Rates, Runoff &
Discharge and Potential Exposure to Flood Hazards
If the Tentative Tract for the 110 lots is approved and the site
is improved with the proposed residental development, there will
be an increase in hardscapes areas and reduction in permeable
surfaces that will result in greater amounts of runoff during
occasional periods of heavy precipitation. All such runoff shall
be directed to and into approved City storm drain facilities
which will be developed on-site, including the construction
of several catch basins along the tracts lower southern
boundaries adjacent to Brenda Drive as well as any required
additional off-site infrastructure improvements and/or
developer contributions towards same for future developments.
Sewer and water line extensions to service the tract shall be
constructed per City Department requirements as well as
required upgrades of the Cable Creek Flood Control Channel along
those portions that abut the tract area per San Bernardino
County Flood Control District and Federal Insurance
Adminstration Standards. Additionally all habitable structures
to be built outside of the minimum 100 foot setback line.
Compliance of these regulations and provisions for the required
infrastructure improvements will lessen the risks from flooding
or related water runoff damage to within acceptable levels
for the proposed tract's future residents.
ENVIRONMENTAL EVALUATION AND MITIGATION MEASURES DISCUSSION (CONT) .
4. BIOLOGICAL RESOURCES - 4a. , 4d. Biological Resource Management
Overlay District and Possible Mature Tree Removal/Replacment
The subject site is located within a City designated Biological
Management Overlay Disrict for which the applicant was required
to complete a Biological Resources Assessment Study. This study
was undertaken and a report submitted to the City for review,
which concluded that no sensitive plant nor wildlife species,
as determined by the criteria and listings of rare, threatened
or endangered species, were found or evidence existing for their
presence over the subject site. Those plants that were ident-
ified on the subject site represented the speices typically
present within Southern California Chaparral Plant communities
and related Inland Sage Scrub Associations. Wildlife presence
was also limited to common insect groups, small vertebrates and
mammals typically found within these areas, despite the sites
degradation from repeated evidence of disking, motorcycle use
and related presence and use from residential owners whose
properties surround the site.
Additionally, the presence of approximately 39 mature trees,
principally planted Blue Gum eucalyptus and Olive tree species
required the applicant s completion and submittal of an arborist
report. This study was conducted and each tree was identified on
the site, it's condition noted and recommendation for the
potential for transplanting and/or removal that will be part of
the Conditions of Approval of the proposed tract. One probable
area for transplanting will be the lower areas of Lot "All,
the undeveloped parcel remainder or adjacent flood control set
back area located along the tract's southern property lines.
By addressing these biological issues and concerns, potential
impacts will be addressed and mitigated to levels of non-
significance.
6. LAND USE - 6a. Proposed Land Use Designation Change
General Plan Amendment No. 92-06, submitted in conjunction
with Tentative Tract NO. 15407, proposes to change the land
use designation of the four existing, legal parcels comprising
a total 30.59 acres from RL, Residential Low, to RS,
Residential Suburban. If approved the minimium sized lot area
would be reduced from 10,800 to 7,200 square feet and would
permit, subject to Planning Commission approval, the
applicants proposed 110 lot subdivision, with lots ranging in
size from 7,202 to 14,353 square feet. The applicants also
are proposing a density of 3. 6 dwelling units per acre, which
is within the permitted maximum density of 4 . 5 dwelling units
per acre, as allowed in the RS, Residential Suburban, General
Plan land use designation.

9 . TRANSPORTATION/CIRCULATION - 9c. Alterations of Circulation
Patterns and related Traffic Volume Increases
The proposed 110 lot residential tract will have two means
of primary access off Irvington Avenue either from the east via
Pine Avenue or from the west via Palm Avenue. Internal
circulation will be provided from extensions of Olive and
Walnut Avenues and the creation of several additional local
collector streets that will run both north and southerly as
well as east and westerly across the 30 .59 acre subject site.
This proposed arterial network will provide both ingress/
egress access and a good layout of internal circulation for the
proposed tract.
Traffic increases with a full development of the proposed 110
lot residential tract will not pose any significant impacts
to surrounding major arterials nor the creation of any traffic
related congestion problems beyond those thresholds typically
experienced and present in other similarily designated Resid-
ential Suburban areas of the City. General Plan Amendment No.
92-06, if approved, would not change access nor internal
circulation patterns to the proposed tract but would allow the
potential for development of a greater density of homes. If
approved as proposed the applicants would add an additional 28
single family homes over the site then the 82 lots previously
approved under old Tentative Tract No. 14044.
10. UTILITIES - 10a. , 10b. , & 10c. Fire, Police and School Area
Infrastructure Developments
The proposed tract site is located in the Verdemont Area
which shall require the developer to contribute towards the
construction or future development of needed public services
in this portion of the City. The need for additional fire and
police stations to lessen response time as well as additional
school construction at all levels to better serve this portion
of the City is a recognized need and priority that City agency
reviews of this and other proposed tracts have repeatedly
stressed. Additional Assessment Districts as well other infra-
structure fees and/or actual on and off-site improvement
construction shall be determined by appropriate City agency
review or other applicable jurisdiction, as the San Bernardino
County Flood Control District. Compliance with these
Conditions of Approval and Standard Requirements will reduce
levels of risk to within acceptble levels for the proposed
tract development.
ENVIRONMENTAL EVALUATION AND MITIGATION MEASURES DISCUSSION (CONT. )
13. CULTURAL RESOURCES - 13a. Archaeological Cultural Resources
The proposed tract site is located in a City designated area of
potential Archaeological and/or Historical Cultural Resources.
This required the applicant to complete an archaeological site
field study as well as an ethnohistorical and records search on
the subject property, as per requirements of Dr. Ross of the
San Bernardino County Archaeological Information Center. This
study and report were completed and the subject property was
determined to have a low potential for the presence of cultural
resources due to the sites low-lying topography and periodic
flooding, resulting in an area unlikely for prehistoric
aboriginal or more recent occupation. A Condition of Approval
shall be added, if, in the process of grading and/or other
construction activities any artifiacts or other potential
cultural resources are uncovered, all work shall be ceased
until a qualified archaeologist is contacted for further site
evaluation.
14. CUMULATIVE IMPACTS - 14c. Potential for Future Cumulative
Significance
The proposed tract, if approved, would allow development of an
additional 110 single family homes in a growing portion of the
City previously described under the utilities Section as in
need of additional infrastructure improvements and future
upgrades to provide Verdemont community property owners with
equivalent public services and utilities as presently exist in
other City areas.
While this specific tract proposals approval or denial will
not, by itself, represent a significant impact, continued
future residential development of the Verdemont area will
require provisions for upgrading of utility infrastructure and
public services to ensure all areas of the City adequate public
protection and levels of service.

1 RESOLUTION OF THE CITY OF SAN BERNARDINO ADOPTING THE NEGATIVE
DECLARATION OF ENVIRONMENTAL IMPACT AND ADOPTING GENERAL PLAN
2 AMENDMENT NO. 92-06 TO THE GENERAL PLAN OF THE CITY OF SAN
BERNARDINO.
3 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF
4 SAN BERNARDINO AS FOLLOWS:
5 SECTION 1. Recitals
6 (a) The General Plan for the City of San Bernardino was
7 adopted by the Mayor and Common Council by Resolution No. 89-159 on
8 June 2 , 1989.
9 (b) General Plan Amendment No. 92-06 to the General Plan of
10 the City of San Bernardino was considered by the Planning
11 Commission on November 4 , 1992 , after a noticed public hearing, and
12 the Planning Commission's recommendation of approval has been
13 considered by the Mayor and Common Council.
14 (c) An Initial Study was prepared on June 8, 1992 and
15 reviewed by the Environmental Review Committee and the Planning
16 Commission who both determined that General Plan Amendment No. 92-
17 06 would not have a significant effect on the environment and
18 therefore, recommended that a Negative Declaration be adopted.
19 (d) The proposed Negative Declaration received a 21 day
20 public review period from June 25, 1992 through July 15, 1992 and
21 all comments relative thereto have been reviewed by the Planning
22 Commission and the Mayor and Common Council in compliance with the
23 California Environmental Quality Act (CEQA) and local regulations.
24 e) The Mayor and Common Council held a noticed public
25 hearing and fully reviewed and considered proposed General Plan
26 Amendment No. 92-06 and the Planning Division Staff Report on
27 December 21, 1992.

I (f) The adoption of General Plan Amendment No. 92-06 is
2 deemed in the interest of the orderly development of the City and
3 is consistent with the goals, objectives and policies of the
4 existing General Plan.
5 SECTION 2 . Negative Declaration
6 NOW, THEREFORE BE IT RESOLVED, FOUND AND DETERMINED by the Mayor
7 and Common Council that the proposed amendment to the General Plan
8 of the City of San Bernardino will have no significant effect on
9 the environment, and the Negative Declaration heretofore prepared
10 by the Environmental Review Committee as to the effect of this
11 proposed amendment is hereby ratified, affirmed and adopted.
12 SECTION 3 . Findings
13 BE IT FURTHER RESOLVED by the Mayor and Common Council of the
14 City of San Bernardino that:
15 A. The proposed RS, Residential Suburban land use designation is
16 internally consistent with the General Plan in that such a
17 designation is not in conflict with the goals, objectives and
18 policies of the General Plan, and will facilitate the
19 continued and orderly development of the area.
20 B. The proposed amendment will not be detrimental to the public
21 interest, health, safety, convenience or welfare of the City.
22 Factors related to the potentially higher density of
23 residential development, such as increases in traffic or
24 surface runoff, will not significantly impact existing or
25 future public services.
26 C. The proposed amendment would maintain the appropriate balance
27 of land uses within the City in that the proposed amendment

1 will not change the single-family residential designation of
2 the subject property, and is compatible with the suburban
3 residential character of development within the immediate

5 D. The amendment area is physically suitable for the requested

9 development of the uses permitted within the RS, Residential
10 Suburban, General Plan land use designation.
11 SECTION 4 . Amendment
12 BE IT FURTHER RESOLVED by the Mayor and Common Council that:
13 A. The Land Use Plan of the General Plan of the City of San
14 Bernardino is amended by changing approximately 33 acres from
15 RL, Residential Low to RS, Residential Suburban. This
16 amendment is designated as General Plan Amendment No. 92-06
17 and its location is outlined on the map entitled Attachment A,
18 and is more specifically described in the legal description
19 entitled Attachment B, copies of which are attached and
20 incorporated herein be reference.
21 B. General Plan Amendment No. 92-06 shall become effective
22 immediately upon adoption of this resolution.
23 SECTION 5. Map Notation
24 This resolution and the amendment affected by it shall be
25 noted on such appropriate General Plan maps as have been previously
26 adopted and approved by the Mayor and Common Council and which are
27 on file in the office of the City Clerk.

Dear Valerie:
Thank you for taking the time to meet with me and discuss the
project noted above, hereafter referred as "the Project" .
As you know, the project was approved 5-0 with Mr. Bob Stone
abstaining.
The approval was a result of 18 months of studies, surveys
and public meetings held with the residents of the Verdemont
Community. Enclosed herewith is a sample (letters of
endorsement) of the support for this project which are of
public record.
We feel the significance of this item has never been
addressed sufficiently during a public hearing or staff
presentation.
There are several facts which need to be expressed to the
Mayor and Council, such as:
(1) There is local neighborhood support for this
project.
(2) There is a genuine interest from local area property
owners to see this project successful. This project
will help revitalize the value of real estate and
add an optimistic view for future developments.
(3) This project is a participant in Mello/Roos District
I/Verdemont Area.
(4) This project has agreed to pay $47, 970. 00 towards an
off-site drainage improvement. This condition is in
compliance with a prior Council action taken late
last year.

(5) The development of this project has set aside a
significant greenbelt area which will help preserve
the natural hillside features located adjacent to
Cable Creek.
(6) The development of this project will complete the
street and utilities system between Olive Avenue and
the subdivision east of the project area.
We truly believe that if the facts and circumstances outlined
herein are presented to the Mayor and Council, their
viewpoint for a decision may be made clearer.
