STAFF REPORT
This request for an easement by Southern California Edison comes as a result of
the installation of a new electrical transformer for the Perris Hill Park swim-
ming pool .
Individual acceptance is necessary as the Easement contains certain conditions
and covenants. The document, however, does not contain any unduly adverse re-
strictions or reservations, and no appropriation of money is required. Upon
execution of the Easement by the Mayor and City Clerk, the document will be sent
to Southern California Edison for recordation. A copy of the recorded, fully
executed document will then be returned to the City of San Bernardino for our
files.
It is therefore Staff's recommendation that the Resolution be adopted and the
document be executed.

2 RESOLUTION OF THE CITY OF SAN BERNARDINO GRANTING AN EASEMENT TO
SOUTHERN CALIFORNIA EDISON COMPANY, A CORPORATION, OVER CITY-OWNED PROPERTY
3 LOCATED ON THE SOUTH SIDE OF HIGHLAND AVENUE, EAST OF VALENCIA AVENUE,
FOR NEW ELECTRICAL TRANSFORMER FOR PERRIS HILL PARK SWIMMING POOL.

5 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL. OF THE CITY OF SAN
BERNARDINO AS FOLLOWS:

7 SECTION 1. That the City of San Bernardino hereby execute a
8 Grant of Easement to Southern California Edison Company, a corporation, for
9 transmission of electrical energy and appurtenant facilities.
10 SECTION 2. That said Grant of Easement referred to herein, a
11 copy of which is attached hereto, marked Exhibit "A" , and is hereby referred
12 to and made a part hereof as fully as though set out at length herein, is
13 hereby approved.
14 SECTION 3. That the Mayor and the City Clerk of the City of San
15 Bernardino are hereby authorized and directed to execute said Grant of
16 Easement on behalf of the City of San Bernardino.

CITY OF SAN BERNARDINO, a Municipal Corporation (hereinafter referred to as "Grantor"), hereby
grants to SOUTHERN CALIFORNIA EDISON COMPANY, a corporation, its successors and assigns (hereinafter
referred to as "Grantee"), an easement and right of way to construct, use, maintain, operate, alter, add to,
repair, replace, reconstruct, inspect and remove at any time and from time to time underground electrical
supply systems and communication systems (hereinafter referred to as "systems"), consisting of wires,
underground conduits, cables, vaults, manholes, handholes, and including above-ground enclosures, markers
and concrete pads and other appurtenant fixtures and equipment necessary or useful for distributing
electrical energy and for transmitting intelligence by electrical means, in, on, over, under, across and along
that certain real property in the County of San Bernardino, State of California, described as follows:
A strip of land 8 feet in width lying within Lot 6, Block 40, Rancho San Bernardino, as shown on Map
on file in Book 7, page 2 of Maps in the Office of the Recorder of said County. The centerline of said strip
being described as follows:
M COMMENCING at the intersection of centerlines of Highland Avenue, as now established and Cedar
Street, as now established; thence West along the said centerline of Highland Avenue a distance of 166 feet;
` thence South parallel with the Southerly prolongation of said centerline of Cedar Street a distance of 146 feet
it to a TRUE POINT OF BEGINNING;thence West parallel with the said centerline of Highland Avenue a distance of
14 feet; thence South parallel with the prolongation of said centerline of Cedar Street a distance of 30 feet.
This legal description was prepared pursuant to Sec. 8730(c) of the Business & Professions Code.

The Grantor agrees for itself, its successors and assigns, not to erect, place or maintain, nor to permit
the erection, placement or maintenance of any building, planter boxes, earth fill or other structures except
walls and fences on the above described real property. The Grantee,and its contractors, agents and employees,
shall have the right to trim or cut tree roots as may endanger or interfere with said systems and shall have
free access to said systems and every part thereof, at all times, for the purpose of exercising the rights
herein granted; provided, however, that in making any excavation on said property of the Grantor, the Grantee
shall make the same in such manner as will cause the least injury to the surface of the ground around such
excavation, and shall replace the earth so removed by it and restore the surface of the ground to as near the
same condition as it was prior to such excavation as is practicable.
