Because the alleged complaint pertains to compliance with prevailing building codes, I request that a code compliance in- spection be performed to identify any deficiencies that may have been constructed. If discrepencies are discov- ered, I ask that the City take appropriate and immediate action to gain full compliance. Box 66118 Washington,D.C. 20035-6118 Re: ADA Complaint for no access to new construction at Perris Hill Park in San Bernardino, California To Whom This May Concern: I, Robert J. Neves of 3771 North Aspen Drive in the City of San Bernardino, California, and the nine indivdu- als on the list below, wish to initiate an investigation of a complaint that we have. The actual complaint is re- garding the new construction of a water park at Perris Hill Park in San Bernardino. Perris Hill Park is generally located on the south side of Highland Avenue between Elks Drive and Valencia Avenue. The pool, at this park, has undergone a major remodel/renovation and some additions, funded (in part) by a Special Purpose Project Grant from the Department of Housing and Urban Development (HUD). The pool and changing facilities have been completely remodeled. Next to the pool, a water slide and wading pool has been built where none existed in the past. Neither the wading pool, nor the water slide is accessible to people who cannot, use steps to get to the top of their respective slides, or once finished sliding, exit the pool by using an assistive device to help them into a wheelchair. This type of construction brings many questions to mind. Is this new construction, built by the City required to comply with the ADA ? If so, would compliance require an accessible means of verticle access (lift or eleva- tor) ? Again, if so, can your office take any action to make this City built public accommodation comply (Court injunction halting construction, or delaying use, until a suitable plan is adopted and implemented) ? If the answers to these questions are "yes", then I would like to lodge a complaint and persue the legal remedies through your office. If another office is more appropriate, then please refer this letter and let us know of any action taken. Please expedite this complaint as the pool/slide/wading pool is due to open and begin operations on July 26, 1993. Respectfully Submitted, Robert J.
