finance costs of improvements on Highland Avenue.
09-08-92 - Resolution adopted authorizing execution of Design Reim-

Recommended Motion:
1 . Adopt resolution.
OR
2 . That the bids received on 7-13-93 for the improvement of
Highland Avenue, from Denair Avenue to Boulder Avenue, in
accordance with Plans Nos . 8801 , 8918 and 8919 , be rejected,
and the Director of Public Works/City Engineer be authorized to
re-advertise for bids after Highland Avenue has been relin-
quished to the City by the California De me t of Transporta-
tion.

Award of Contract
Improvement of Highland Avenue,
from Denair Avenue to Boulder Avenue
Bids for this project were opened at 2 : 00 p.m. , Tuesday, 7- 13•-93 .
A total of two (2) bids were received, in the amounts of
$552 , 832 . 00 and $605 , 800 . 00 . The low bid of $552 , 832 . 00 is 17 . 9%
over the Engineer' s Estimate of $468 , 793 . 00 .
Below is an estimate of the, total project cost, based upon the
actual low bid price.

Engineering & Inspection (W.O. #1401) 18 , 500 . 00
Sub-Total $ 671 , 332 . 00

All costs incurred for this project will be financed from the
$800 , 000 allocated from Tax Allocation Bond Proceeds, under
Account No. 650-0170 .
A Notice to Proceed must be issued by 8-2-93 , in order for the
completion date to be set prior to Thanksgiving. However, we
have been unable to obtain assurance from Caltrans that the
necessary Encroachment Permit can be issued by this date.
Since only two bids were received, both of which were consider-
ably in excess of the Engineer' s Estimate, it appears that the
low bid is not competitive with current pricing levels . However,
it may be necessary to proceed with this low bid, in order to
meet the schedule for development of the Wal-Mart complex.
Highland Avenue is in the process of being relinquished to the
City of San Bernardino and City of Highland. Caltrans antici-
pates that this relinquishment will be completed no later than
12-1-93 .
Another option is to reject these two bids , modify the contract
documents to eliminate Caltran ' s permit and inspection require-
ments, and re-advertise for bids . The contract documents would
be prepared to direct the Contractor to submit orders for the

traffic signal equipment and storm drain pipe as the first item
of work, with on-site work to be started on 1-3-•94 . Under this
process, the completion date would be about 3-1-94 .
However, a permit may have to be acquired from the City of
Highland, for the traffic signal and curbed median, since some of
these improvements will be within the south half of Highland
Avenue, which is under their jurisdiction.

2 RESOLUTION OF THE COMMUNITY DEVELOPMENT COMMISSION OF THE
CITY OF SAN BERNARDINO AWARDING A CONTRACT TO BEAR VALLEY PAVING
3 FOR THE IMPROVEMENT OF HIGHLAND AVENUE, FROM DENAIR AVENUE TO
BOULDER AVENUE.

BE IT RESOLVED BY THE COMMUNITY DEVELOPMENT COMMISSION,
5 ACTING ON BEHALF OF THE ECONOMIC DEVELOPMENT AGENCY OF THE CITY
OF SAN BERNARDINO AS FOLT,OWS:

7 SECTION 1 . Bear Valley Paving is the lowest responsible
bidder for: Improvement of Highland Avenue, from Denair Avenue
8
to Boulder Avenue, per Plans Nos . 8801 , 8918 , & 8919 . A contract
9
is awarded accordingly to said bidder for the total amount of
10
11 $552 , 832 . 00, but such award shall be effective only upon the
12 contract being fully executed by both parties. All other bids,
therefore, are hereby rejected. The Chairman is hereby
13
authorized and directed to execute said contract on behalf of the
14
Commission; a copy of the contract is on file in the office of
15
16
the Director of Public Works and incorporated herein by reference_
17
as fully as though set forth at length.

SECTION 2 . This contract and any amendment or modifica-
19 tions thereto shall not take effect or become operative until
20 fully signed and executed by the parties and no party shall be
21 obligated hereunder until the time of such full execution. No
22 oral agreements, amendments , modifications or waivers are
23 intended or authorized and shall not be implied from any act or
course of conduct of anv, part,,-.

25 SECTION 3 . This resolution is rescinded if the parties
to the contract fail to execute it within sixty (60) days of the
26
passage of this resolution.
