Synopsis of Previous Council action:
12/21/92 -- The Community Development Commission/City Council authorized staff to
proceed in developing a work program and consultant contracts and
authorized funding of $30,000 to complete revisions to the Development
Code.
Recommended motion:
That the Mayor and Common Council hold a workshop on August 9, 1993 at
9:00 a.m. to discuss the Development Code and the revision program.

STAFF REPORT
Subject: Council Workshop - Proposed Development Code Revisions
BACKGROUND
Last December, staff was authorized to proceed with a revision program to address
areas of concern with the Development Code, as outlined on the attached memo. Staff
developed a phased work program for completing the revisions. The draft of the
first phase has been completed and the environmental review is being prepared. The
next step in the process will be scheduling the revisions for a public hearing by
the Planning Commission, followed by a public hearing by the Mayor and Common Council .
However, we have new Councilmembers, and Planning Commissioners, since the Development
Code was adopted and since the revision program was initiated. I would like to take
the opportunity to go over the Development Code, and the revision program with the
Mayor and Common Council prior to scheduling the formal review process.
RECOMMENDATION
I recommend that the Mayor and Common Council hold a workshop on August 9, 1993 to
review the Development Code, the revision program work program and the draft
changes to the Code itself. Also, that the PlanningiCommission and representatives
from the development community be invited to attend and participate.
No formal action will be required at the workshop.

SUBJECT: Revisions to Title 19 of the Municipal (Development) Code

BACKGROUND
The City's Development Code became effective on June 3 , 1991 and
staff has been using it for about a year and a half now. It was a
complete, and comprehensive, overhaul of the old Title 18
(Subdivisions) and Title 19 (Zoning) portions of the Municipal
Code. Several glitches have been identified which is normal after
a major Code rewrite, but other concerns go beyond that. The main
areas of concern are summarized as follows:
1. Reliance on the SIC Code (Federal Standard Industrial
Classification) for determining permitted uses. This
does not work from a land use standpoint and it is often
difficult to permit uses that are clearly consistent with
the intent of the land use designation/district. We have
received many complaints from property owners/applicants
related to the inconsistencies resulting from the use of
the SIC. A more traditional land use classification
system is recommended.
2 . The permitted uses in each land use district need to be
reviewed in terms of whether a sufficiently broad range
of uses are included. Staff and members of the
development community have found that the permitted uses
are too limited in certain cases.
3 . The requirement for a conditional use permit vs. a
development permit is not consistent. Many uses that now
require a CUP could probably be processed through a DP.
4 . The development standards are geared toward new
construction and it is often difficult to impossible for
existing buildings to be reused or expanded.
5. The signage requirements may be overly restrictive in how
they apply to legal nonconforming signs.

CONCLUSION
Revisions to address these key areas of concern are critical.
Development/redevelopment throughout the City has been impacted and
it has been difficult, in many cases, for development to occur.
The Code has the net effect of discouraging development and
redevelopment.
In addition to the issues identified by staff, we have been
soliciting input from the development community. Staff has
received many complaints about the development process in general
and these revisions will go a long way toward easing those concerns
and allowing staff to work on the process itself.
Staff is working with Jacobson and Wack to define a phased work
program to revise the Development Code to include these key areas
and other, lesser areas of concern. Based on preliminary
discussions, staff has determined that the revision program for
Phases 1 and 2 , including environmental review, will cost about
$30, 000. (Phase 3 is being considered as an undefined option to
include items that may be identified while going through Phases 1
and 2 . )
RECOMMENDATION
Staff requests authorization to proceed in developing the work
program and consultant contracts, and funding for $30, 000.
