Synopsis of Previous Council action:
10/05/87 --- Finding of need for Health and safety reasons was made, Plan No. 7252 was
approved. Negative Declaration was adopted and finding of consistency with
the general plan was made.
Recommended motion:
1. That the City Clerk and the Director of Public Works be authorized to proceed with
the vacation of a portion of that certain alley located East of "I" Street, South of
Jefferson Street.
2. Adopt Resolution

STAFF REPORT
A request was received by this office to vacate portion of the alley East of
"I" Street, South of Jefferson Street, from an adjoining owner, relative to a
development. This request represents 25% of those owners who adjoin the
street.
On October 5, 1987, the Findings of need for health and safety as to why a
portion of the alley located East of "I" Street, South of Jefferson Street
should be vacated, was made; Plan No. 7252 was approved; the Negative
Declaration was adopted and a finding of consistency with the general plan
was made.
All of the interested City Department Heads and Utility Companies were
notified of the proposal on May 14, 1987 with a reply due by June 12, 1987.
The Utility companies have responded and a reservation for pulic utility
easements , and easement for sanitary sewer and appurtenant facilities was
requested.
The proponents have been notified by letter on October 12, 1987, of the
requested reservation for easments and have responded with notification for
us to proceed. The remaining fee of $200.00 has been paid and it is
therefore recommended that favorable consideration be given to the requested
vacation.
The Resolution of Intention, which sets a protest date of April 18, 1988 has
been attached hereto for your action

2 A RESOLUTION Or THE CITY OF SAN BERNARDINO DECLARING ITS INTENTION
TO ORDER THE VACATION OF A PORTION OF THE ALLEY EAST OF "I" STREET, SOUTH OF
3 �EFFERSON STREET AND RESERVING AN EASEMENT FOR PUBLIC UTILITY EASEMENTS AND
AN EASEMENT FOR SANITARY SEWER AND APPURTENANT FACILITIES THEREON.
4 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
5 BERNARDINO AS FOLLOWS:
SECTION 1. that the Mayor and Common Council of the City of San

7 Bernardino hereby declares its intention to order the vacation of a portion
8 of the alley East of "I" Street and South of Jefferson Street, and reserving
9 public utility easements and an easement for sanitary sewer and appurtenant
facilities thereon, described as follows:

That portion of the alley located East of "I" Street and
11 South of Jefferson Street, as delineated on the map of
Urbita, recorded in Book 3 of Maps, page 54, records of
12 the County Recorder of San Bernardino County, State of
California, described as follows:

Beginning at the most Southerly corner of Lot 13 of
14 Block 10, of said Urbita, said point also being the East
line of "I" Street, 66 feet wide; thence Northeasterly,
15 along the Southeasterly lines of Lots 13, 14, 15 and 16
of said Block 10, to the Northeast corner of said Lot
16 16; thence East, along the prolongation of the North
line of said Lot 16, to the Northwesterly line of Lot 4
17 of said Block 10; thence Southwesterly along the
Northwesterly lines of Lots 4, 5, 6, 7 , 8, 9, 10 and 11 ,
18 to the East line of said "I" Street; thence North, along
the Northerly prolongation of said East line, to the
19 Point of Beginning.
20 SECTION 2. That the Mayor and Common Council of the City of San
21 Bernardino, in vacating the above described portion of said street, elects
22 to proceed under and in accordance with the provisions of the "Public
23 Streets, Highways and Services Vacation Law" , being Division 9, Part 3, of
24 the Streets and Highways Code of the State of California.
25 SECTION 3. That the hour of 10:00 A.M. , on the 18th day of April ,
26 1988, in the Council Chamber of the City Hall , San Bernardino, California,
27 be, and the same hereby is fixed as the time and place when and where all
28 persons interested in or objecting to the proposed vacation may appear

I before the said Mayor and Common Council and offer evidence in relation
2 thereto. For further particulars as to the proposed vacation of the
3 hereinbefore described portion of said street, reference is made to that
4 certain map marked "Plan No. 7252" approved October 5, 1987, on file in
J 5 the office of the City Clerk of said City.
6 SECTION 4. Nothing in this Resolution shall in any way affect or
disturb any existing easements for sanitary sewer and appurtenant facilities

8 and for public utility purposes belonging either to the City of San
0 Bernardino or to any public utility and there is hereby reserved for future
10 general public utility purposes and for this City an easement reasonably
11 necessary to locate such sanitary sewer and public utility facilities over,
12 in, under or across the real property hereinabove described and to use,
13 maintain, repair, replace or renew such facilities.
14 SECTION 5. That the City Engineer of the City of San Bernardino
15 hereby is directed to cause Notices of Street Vacation to be posted as
16 1 required by the Public Streets, Highways and Services Vacation Law.
17 SECTION 6. That the City Clerk shall certify to the adoption of
18 this Resolution of Intention and shall cause the same to be published once a
19 week for two successive weeks in The Sun, a newspaper published and
20 circulated in the City of San Bernardino, prior to the date of the above
21 public hearing.
