Synopsis of Previous Council action:
10/11/83 --- Resolution No. 83-334 was adopted, noticing a public hearing
for the formation of and undergound utility district in the
downtown area, and setting the date of November 7, 1983 for said
hearing.
11/07/83 --- Resolution No. 83-362 was approved, creating Underground Utility
District No. 10, between Sixth Street and Fifth Street and between
Sierra Way and Belle Street.
03/07/88 --- Engineer' s Report of costs for a portion of Underground Utility
District No. 10 was approved and a public hearing date of
March 21, 1988 was set to hear any protests on proposed assessments.
Recommended motion:
1. That the public hearing, to hear protests on the proposed assessments for conversion
of electrical services within the Seccombe Lake Underground Utility District No. 10,
as set forth in the Engineer's Report dated 2-10-88, be closed.

STAFF REPORT
Rule 20 -A of the Public Utilities Commission requires Southern California
Edison to set aside a certain percentage of their receipts to be used to
cover the costs of undergrounding their facilities, within districts
established by local agencies.
The downtown Underground Utility District No. 10, was established by
Resolution No. 83-362 adopted on 11-07-83, as authorized by Chapter 13.36,
"Underground Utilities," of the San Bernardino Municipal Code. This
resolution stated that the undergrounding was to be completed by 12-31-86.
Edison had conduits and vaults installed to replace their aerial facilities.
This work included stubbing out a conduit to each parcel. Each property owner
is responsible for conversion of the electrical service from aerial to
underground, and extending a conduit to join the one stubbed out by Edison.
The property owners within the district were notified by the following
transmittals, as provided in Sub-section 13.36.090, of the need to convert
their services:
1. Letter dated Otober 18, 1983 with copy of Resolution No.83-362,
Chapter 13.36.
2. Letter of March 26, 1985.
Copies of these letters are attached for reference. Property owners were
notified by these letters of the necessity to convert their services; also,
that if such work is not completed within 30 days, the City will proceed to
convert their services and assess the costs on their parcels.
The majority of property owners had the necessary work done. However, it was
necessary for the City to have the work accomplished for those parcels which
owners had failed to do. The conversion work was done by Contract.
An Engineer's Report was prepared to show costs incurred by the City. This
report was approved at the Council Meeting of 03-07-88, and a hearing fixed
for 10:00 a.m., 03-21-88. Notice was given in writing to the property owners
of all parcels to be assessed, as provided in Paragraph E, Sub-section
13.36.090. These notices specified the time and place of the hearing to
consider the Engineer' s report and hear protests against such assessments.
We recommend that the hearing be closed and assessments confirmed.

A public hearing has been scheduled by the Mayor and Common Council to determine
whether the public necessity, health, safety or welfare requires the formation of
Underground Utility District No. 10. This public hearing will be held before the
Mayor and Common Council on November 7, 1983, at 9:00 a.m. , in the Council Chambers
of City Hall at 300 North "D" Street. All persons that so desire will be afforded
an opportunity at this hearing to express their views on the proposed Underground
Utility District.
The boundaries of the proposed Underground Utility District No. 10 are:
Fifth Street and Sixth Street, and between Sierra Way and Belle Street.
The Mayor and Common Council will determine at this public hearing if Underground
Utility District No. 10 is required. If it is determined that the district is
required, a resolution will be adopted to declare the designated area Underground
Utility District No. 10.
Enclosed is a copy of Resolution 83-334 (giving notice of the public hearing) and a
map showing the boundaries of Underground Utility District No. 10. If you desire
any further information on the proposed district, please contact the City Engineering
Division at 383-5111.

Notice is hereby given that pursuant to San Bernardino
Municipal Code, Section 13.36.090 , and action of the Mayor
and Common Council of the City of San Bernardino , you are
hereby notified that you must construct or cause to be
constructed certain improvements to that portion of your
property known as Assessor' s Parcel No. which
fronts on in the following manner,
to-wit:
A11 overhead utility facilities within Underground
Utility District No. 10 (electrical , telephone, TV
cable) will be taken out of service by April 26 ,
1985. Each property owner will be responsible for
placing these utility facilities underground, from.
the property line to the service point for all
existing structures.
The construction shall be in compliance with existing City
Standard Drawings , a copy of which is enclosed, and must be
installed utilizing the materials as stated thereon. The
construction must be completed before April 26, 1935, which
is 30 days from the date of this notice. Necessary permits
may be obtained at the office of the City Engineer , City
Hall , San Bernardino.
If the construction is not completed by you or your con-
tractor by the above date, the Director of Public Works/City
Engineer, by order of the Mayor , may cause the construction
to be done and the cost therefor , together with incidental
costs , will be assessed against the property and such
assessment wi l l become a lien on the property. You wi 11 be
notified of when the costs will be confirmed by the Mayor and
Common Council and you will have 5 days thereafter in which
to pay the costs to the City, otherwise the costs will be
collected .
An opportunity to be heard on such assessments will be
afforded you after completion of the work.

1 RESOLUTION NO.
2 A RESOLUTION OF THE CITY OF SAN BERNARDINO CONFIRMING THE
3 ASSESSMENT ROLL FOR UNDERGROUND UTILITY DISTRICT NO. 10 GENERALLY
LOCATED BETWEEN FIFTH STREET AND SIXTH STREET AND SIERRA WAY AND BELLE
4 STREET.
5 WHEREAS, pursuant to the provisions of Chapter 13.36 of the San
6 Bernardino Municipal Code, the Mayor and Common Council of the City of
7 San Bernardino did adopt Resolution No. 83-362 on the 7th day of
8 November, 1983, creating Underground Utility District No. 10, generally
0 located between Fifth and Sixth Streets, and between Sierra Way and
10 Belle Street, and ordered the construction of underground facilitites
11 by owners of certair- properties within said Underground Utility
12 District No.10, which said construction was to be completed by May 1,
13 1984, and which date was extended to July 21, 1986.
14 WHEREAS, the said construction was not completed by said date and
15 the Director of Public Works/City Engineer caused said work to be done,
16 and
17 WHEREAS, according to the provisions of said Chapter 13.36, a
18 report was filed by said Director of Public Works/City Engineer
19 specifying that the required underground utilities have been provided,
20 the cost thereof, and a description of the property against which cost
21 is to be assessed; and
22 WHEREAS, by motion made on the 7th day of March, 1988, the Mayor
23 and Common Council of the City of San Bernardino, approved said
24 Engineer's Report and set the hour and date of 10:00 a.m., March 21,
25 1988 , for hearing of protests against the assessment of the cost of
26 such work; and
27 WHEREAS, and assessment roll has been prepared, totalling
28 $3,505.00, which sets forth the individual assessments to be levied on

1 each of the parcels of land within said Underground Utility District
2 No.1O.
3 NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF
4 THE CITY OF SAN BERNARDINO AS FOLLOWS:
5 SECTION 1. That the Mayor and Common Council do hereby find and
6 determine that the costs to be levied against the parcels of land lying
7 within Underground Utility District No.1O, designated as Exhibit "A"
8 and incorporated herein by reference, are correctly set forth and do
9 hereby confirm said assessments.
10 SECTION 2. That the City of San Bernardino, acting through its
11 Director of Public Works/City Engineer, does hereby claim a lien on all
12 of the properties listed in said assessment roll in the amounts so
13 listed which are not paid within five (5) days from the date of this
14 Resolution and the same shall be a lien upon said real property and
15 collected with the property taxes. The assessment shall be due and
16 payable at the same time as the property taxes are due and payable, and
17 if not paid when due and payable, shall bear interest at the rate of
18 six (6) percent per year.
19 SECTION 3. That pursuant to Chapter 13.36 of the San Bernardino
20 Municipal Code, the Director of Public Works/City Engineer is directed
21 to cause a copy of this Resolution and a list of the unpaid assessments
22 to be transmitted to the office of the Auditor-Controller for the
23 County of San Bernardino with the request that the individual
24 assessments be placed on the subject property tax bills for collection
25I together with all other property taxes.
