AN URGENCY NOTICE AMENDING CHAPTER 2.02 AND CHAPTER 2.10 OF THE SAN BERNARDINO MUNICIPAL CODE TO ESTABLISH THE DIVISION OF FINANCE IN THE DEPARTMENT OF THE CITY TREASURER. THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO ORDAIN AS FOLLOWS: SECTION 1 . Chapter 2.10 of the San Bernardino Municipal Code is hereby amended to read as follows: "Chapter 2 .10 .010. Created. A division of finance. is created within the Department of the City Treasurer . Chapter 2 .10 .020 . Established bond. A. The position of Director of Finance of the City is established. This position shall be in the unclassified service of the Civil Service; B. Pursuant to Section 242 of the Charter of the City of San Bernardino he shall be appointed by the City Treasurer with the approval of the Mayor and Common Council' C. The Director of Finance shall execute and deposit a fidelity bond in the amount of $10, 000.00 prior to taking office. Chapter 2 .10.030. Powers and Duties. The Director of Finance, under the supervision and direction of the City Treasurer, shall have charge of the administration of the financial affairs of the City. The Director of Finance shall have the following powers and duties: A. He shall supervise all disbursements and expenditures to assure that payment has been legally authorized and appropriated, and that sufficient unencumbered appropriations exist for the payment of all claims and expenditures; 1 DAB:ms 'A-1A-AA B. He shall develop, supervise and maintain the general accounting system for the city government; C. He shall procure materials, supplies and general services for the City and establish appropriate standards and specifications with respect to the purchase of supplies, materials and equipment; D. He shall regularly, at least once a month, and at the end of each fiscal year, submit to the City Treasurer, the City Clerk, the City Administrator and the Mayor and Common Council, a statement and report indicating the financial condition of the City, including, but not limited to, receipts, disbursements, appropriations and reserves; E. He shall establish, supervise and maintain a system of data processing for the handling of accounting information and other reports and tabulations required by the City; F. He shall establish and supervise City storerooms, and warehouses and maintain perpetual inventories pertaining thereto; G. He shall establish a system for transfer of unused supplies or materials, between offices, departments or agencies and, with the prior approval of the Council, dispose of materials, supplies or equipment found to be obsolete or surplus; H. He shall maintain and operate the central duplicating, printing, and mail service serving City departments; I . He shall compile the preliminary budget data, including capital and operating expenditure projections, and revenue projections for the City Treasurer and the City Clerk for forwarding to the City Administrator and the Mayor and Common Council; 2 DAB:ms 3-14-88 J. He shall prepare and maintain current inventory of all materials, supplies, and equipment of the City; R. He, or his designated representative, shall audit all purchase orders before they become effective and audit and approve, before payment, all bills, invoices, payrolls, demands or charges against the City Government and determine the regularity, correctness, and, with the advice of the City Attorney, the legality of such claims, demands and charges; and he, or his designated representative, shall attach to the register of audited demands before submission to the Mayor and Common Council, his affidavit certifying as to the accuracy of the demand for the availability of funds for payment thereof pursuant to Government Code Section 37202; and he, or his designated representative, in lieu of the City Clerk, shall certify or approve demands as conforming to a budget approved by resolution pursuant to Government Code Section 37208, provided that the provisions of Section 37208 shall, in other particulars, be applicable to the City; L. He shall prescribe the forms of receipts, vouchers, bills, or claims to be used by all of the agencies of the City; M. He shall supervise the work of preparing the City payroll and maintaining records of all payroll data; and he shall supervise the work for the state employees retirement system in accordance with the law and administrative directions of the retirement system; N. He shall perform such other duties as may be imposed by ordinance or resolution of the Mayor and Common Council , or as the City Treasurer may direct. 3 DAB:ms 3-14-88 2. 10.040 . Divisions of department. A. The Division of Finance shall be under the supervision of the Director of Finance and shall consist of the following further divisions: 1) Purchasing Division; 2) Accounting Division; 3) Payroll Division; 4) Such other division as may be authorized by the Mayor and Common Council . B. The heads of each of these subdivisions shall be in the unclassified Civil Service. SECTION 2 . Section 2 .02.060 of the San Bernardino Municipal Code is hereby amended to read as follows: "2.02.060 Duties - Report to Mayor and Common Council . Under the supervision of the Mayor and Common Council, and subject to the approval, direction and control thereof, the Administrative Officer shall be responsible for the performance of such duties and ministerial functions as may be placed in his charge by the Mayor and Common Council, and in connection therewith, shall report to the Mayor and Common Council from time to time of the status and enforcement o;�t e Mayor and Common Councils ' policies, rules and regula AA )tions. &J&1 6"j is St�� � C,Z C� �L,-,C:. •-c . s.c.-! 4..�.. j�.�4/1-sd-•tn..E.�. The administratilve officer shall: J / ✓✓ A. Attend all meetings of the Mayor and Common Council except when excused therefrom, and advise and make recommendations to the Mayor and Common Council upon matters which are brought before them and which are within his administrative authority; 4 DAB:ms 3-14-88 B. Coordinate the work of departments and agencies which are under the direction, jurisdiction or fiscal control of the Mayor and Common Council; in this connection, the Administrative Officer may require submission of organizational charts and departmental activity reports; inform departments on actions, decisions and policies of the Mayor and Common Council affecting department operations; C. Subject to rules, regulations and ordinances of the Mayor and Common Council, cause to be prepared and submitted requests for the creation of new positions and capital outlay items; he may request such information, charts and statistics as may be necessary for his recommendations; D. T e Administrati a Officer shall review all departmental and agency requests and all items in the proposed budget, including revenues, expenditures and reserves; he shall submit his recommendation on the proposed budget to the Mayor and Common Council; E. Review all departmental and agency requests for adjustments and transfers of budget funds and make recommendations concerning them to the Mayor and Common Council; F. On behalf of the Mayor and Common Council, recommend adjustments between the accounts of the maintenance and operation and capital outlay and appropriations of individual City departments and agencies, provided that such adjustments do not increase the totals of the amounts budgeted for such categories of expenditures; 5 G. Exercise general supervision over the public buildings of the City except those under the jurisdiction of the Municipal Water Department and the free Public Library Board; A. Maintain continuous research into administrative practices, study, and make recommendations to the Mayor and Common Council concerning such changes or modifications as will improve the efficiency and economy of City governmental operations; I. Be responsible for the City insurance policies and supervise their recovery of any claims against such policies; J. In cooperation with city departments and agencies, develop work measurement, process organization, procedures programs and operating manuals; R. Promote the proper preparation and dissemination of periodic reports and information pamphlets or brochures; L. Recommend to the Mayor and Common Council the adoption of new and revised orders and resolutions when, in his judgment, such action will promote improved city services and operations and are in the public interest; M. Make such other investigations, studies and surveys and perform such other duties as may be ordered by the Mayor and Common Council or as deemed necessary." SECTION 3. This ordinance shall be in effect for one hundred and twenty (120) calendar days following its adoption, unless this expiration provision is extended or repealed by another ordinance adopted by the Mayor and Common Council . Upon the expiration of this ordinance the portions of the San 6 DAB:ms 3-14-88 Bernardino Municipal Code amended hereby shall once again be as they existed prior to the adoption of this ordinance and shall, thereafter, be in full force and effect. dot SECTION 4. This ordinance is an urgency ordinance and shall take effect immediately upon its adoption for the immediate preservation of the public peace, health or safety. The reasons for its agency are that the combination of the financial matters of the City under one department will promote substantial cost savings and efficiency to the benefit of the taxpayers of the City and such combination must be done without delay due to the pending preparation and approval of the 1988-89 city budget.
