Synopsis of Previous Council action:
11/17/87 --- Resolution No. 87-404, vacating that portion of State Street
North of Sheridan Road, was adopted.
Recommended motion:
That the quitclaiming of the West side of State Street, now vacated, to
University Square, a Joint Venture, is approved in principal, and that the
real property section is authorized to proceed with the preparation of the
necessary documents.

STAFF REPORT
On November 17, 1987, Resolution No. 87-404 was approved, ordering the
vacation of State Street, North of Sheridan Road. That portion of State
Street, East of it's centerline, was aqui red by University Square, a Joint
Venture, the property owner adjoining the vacated portion of State Street to
the East. University Square has plans to develop the area East of State
Street.
The City owns the remaining West 20 feet of State Street. The property to the
West of State Street is owned by Southern California Edision Co. This
property is landscaped and maintained by the City through an agreement with
Edison. Once the area East of this 20 foot strip is developed, what would
remain would be a 20 foot by 400 foot paved strip with curbs on either side,
and even though vacated, would appear to be a public right of way, creating a
potential liability for the City. University Square would like to acquire
this strip of land from the City, and has indicated that they plan to
landcape and maintain this area in their development. They have also stated
that they do not need this land for their development, but are only
interested in acquiring this area for aethetics.
The cost to the City for the removal of the curb and asphalt, filling in with
dirt and installation of a sprinkling system and the planting of grass, which
would be needed to aesthetically blend in with the surrounding area, would be
a minimum of $13,000.00. The annual cost of maintenance would be
approximately $1,760.00.
Since the City has no practical use for a 20 foot by 400 foot strip of land,
and the high cost of planting and maintaining such an area, it is recommended
that the Real Property Section be authorized to proceed with the preparation
of a Quitclaim Deed to University Square, which will be presented to you for
your approval.
