Superintendent of Public Buildings relative to the repair work that is needed.
The Redevelopment Committee reviewed this request at their January 21, 1988, meeting
and their minutes will reflect that the matter should be referred to the City Council
for further review and action.

3 CITY OF SAN BERNARDINO AUTHORIZING AND DIRECTING THE EXECUTION OF
A CONTRACT FOR THE REPAIR OF LEAKS IN CONVENTION CENTER ROOF .
4 BE IT RESOLVED BY THE COMMUNITY DEVELOPMENT COMMISSION OF
5 THE CITY OF SAN BERNARDINO AS FOLLOWS:
6 SECTION 1. The Chairman and Secretary of the Community
7 Development Commission of the City of San Bernardino are hereby
8 authorized and directed to execute for and on behalf of the
9 Redevelopment Agency of the City of San Bernardino a contract
10 between the Redevelopment Agency of the City of San BermL&rdino
11 and B.R.S. Construction , Inc . , with such non-substantive changes
12 to said contract as may be approved by the Chairman and Agency
13 Counsel . A copy of said contract is attached hereto as Exhibit
14 ply and incorporated herein by this as though fully set forth at
15 length.

2 RESOLUTION OF THE CITY OF SAN BERNARDINO AWARDING A
3 CONTRACT FOR THE REPAIR OF LEAKS IN CONVENTION CENTER ROOF .
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
4 OF SAN BERNARDINO AS FOLLOWS:

6 SECTION 1 . B.R.S. Construction , Inc . , is the lowest and
7 best bidder for the work to repair the leaks in the Convention
8 Center roof for the following reasons:
9 1. The aforesaid company is the only one available which
10 will guarantee the work for three (3) years.
11 2 . Since the aforesaid company is the only one available
12 which will do both the required work and guarantee the work.,
13 competitive bidding would work an incongruity, be unavailing,
14 produce no advantage and serve no legitimate purpose.
15 SECTION 2 . The facts upon which the foregoing reasons and
16 conclusions are based are:
17 1. The Public Works Department has tried for five (5)
18 months to locate a firm to provide the needed repairs and
19 guarantee the work and has been unsuccessful until now.
20 2 . Although other firms have been willing to perform the
21 work they have not been willing to provide the necessary
22 guarantee .
23 3. Since remodeling of the Convention Center will begin
24 shortly, a guarantee is essential to protect the City against
25 damages due to possible future leaks .
26 SECTION 3 . The contract , attached hereto as Exhibit "A" ,
27 is hereby awarded to said bidder in the amount of $36 ,198 .75 , and
28 the Mayor of the City of San Bernardino is directed to execute
said contract on behalf of said City.

STAFF REPORT
The City, Redevelopment Agency (RDA) , and Maruko Corp. entered into
an owner participation and development agreement on July 20, 1987 for
the purchase of the Hotel and lease of the Convention Center. This
agreement required the lessor, City of San Bernardino, to maintain
and repair, at its own expense, the Convention Center structural
roof, exterior walls, and interior load bearing walls in first class
condition, and to repair any and all known leaks to the structure
upon notification of the lessee.
ROAR Inc. , Maruko Inc. , and Mitsubishi Corp. have notified the city
of several major leaks in the Convention Center roof areas (9-22-87) .
During the negotiations, this problem was identified and referenced
agreement required the city to repair these known leaks. Also, to
sign, re-stripe and paint the 5 level parking structure.
The RDA at that time made a commitment to provide the funds that we
estimated to be approximately $100, 000 to meet this financial obli-
gation at a June 16, 1987 meeting.
The city staff, Public Buildings, has been attempting to obtain a
contract to perform the necessary work on the repair of the leaks at
the Convention Center roof that would provide a warranty for such
expensive repairs.
We have only been able to obtain proposals and estimates from one
company who would guarantee such repairs for a three year period
which was B. R.S Construction Inc. This contractor has proposed such
repair, under certain conditions, in three phases, at a cost of:

The City would be obligated through coordination with KOAR, Muruko
and Mitsubishi for removing and replacing ceiling tile, dry wall,
etc. if it were necessary to inject certain areas from below the deck
area KOAR and Sacon construction has notified the City that they plan
to do major renovation in the Convention Center area floors, walls,
ceiling etc. that could be severely damaged if this work is not
completed prior to February 20, 1988 and could subject the City to
severe liability.
Based upon the, limited time to accommodate this repair, it is recom-
mended that.
1. The Council approve the attached resolution for a sole
source contract since there is only one source available
for such work and competitive biding would work an incon-
gruity, by unavailing, produce no advantage and service no
legitimate purpose, and the contract hereby awarded to said
bidder and the Mayor of the City of San Bernardino be
authorized to execute said contract on behalf of the city.
2. That the allocation of funds for contract be authorized
from RDA funding sources.
