ORDINANCE NO.
ORDINANCE OF THE CITY OF SAN BERNARDINO, ADDING CHAPTER 5.72 TO TITLE 5 OF
THE SAN BERNARDINO MUNICIPAL CODE WHEREBY THE CITY ELECTS TO RECEIVE ITS
ALLOCATED SHARE OF SATELLITE WAGERS AT THE NATIONAL ORANGE SHOWGROUNDS.
THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO ORDAIN
AS FOLLOWS:
SECTION 1. Chapter 5.72 is added to Title 5 of the San Bernardino
Municipal code to read as follows:
Chapter 5.72. Satellite Horse Race Wagering
Sec. 5.72.010 City receipt of allocated share.
Pursuant to the authority of Business and Professions Code Section
19610.4 the City of San Bernardino hereby elects to receive any allocated
share of the total parimutuel satellite wagers made at the National
Orange Show.
Sec. 5.72.020. Tax and Fee Exemption of Racing Association
Any racing association and/or National Orange Show conducting

racing meets at';National Orange Show shall be, with respect to any
racing event conducted shall be exempt from levy or payment of any City
license or excise tax or fee, including, but not limited to, any
admission, parking or business tax, or any tax or fee levied upon
National Orange Show or racing association or other applicable
licensee of National Orange Show conducting a racing meet or satellite
. wagering or any patron.

STAFF REPORT
Under current horseracing law, cities may choose to receive
an amount equal to 0. 33 of 1% of the pari-mutuel wagers
(defined as the total betting pool) placed at live horse-
racing events within city boundaries. Assembly Bill 195,
which was recently signed by the Governor, and became
effective January 1, 1988, extended this revenue source to
include satellite wagering in addition to live horseracing
events. Cities and counties which have satellite wagering at
County Fairs or District Agricultural Association Fairs, were
authorized through this bill to receive . 33 of 1% of the
total pari-mutuel wagering conducted on the fairgrounds.
This proposed ordinance authorizes the City to immediately
receive its allocated share of pari-mutuel wagering at the
National Orange Show Fairgrounds.
The California Horseracing Board has estimated that approxi-
mately $250,000 to $300, 000 per day in pari-mutuel wagering
results at the Orange Show Fairgrounds. Assuming these
figures will remain constant for the duration of the
horseracing season, which runs about 250 days per year at the
Santa Anita, Hollywood Park and Del Mar Race Tracks, the City
can expect to generate anywhere from $206, 000 to $247, 000 per
year in revenues.
In order to begin collecting these revenues, it is recom-
nded that the Council adopt the proposed ordinanace.

at 0 . 33 of 1 percent but shall be adjusted

17 automatically as the percentage is changed by the
18 State law or regulation.
19 Sec. 5.72.020. Tax and Fee Exemption of Racing
Association.

21 Any racing association which conducts the
22 racing meeting at the National Orange Show County
23 Fairgrounds shall be, with respect to any racing
24 event conducted by that racing association, exempt
25 from levy or payment of any City license or excise
26 tax or fee, including, but not limited to, any
27 admission, parking or business tax, or any tax or

1 fee levied solely upon the racing association
2 conducting a racing meeting or satellite wagering
3 or any patron.
