PENMAN City Attorney Re: Urgency Provisions of Mobile Home Rent Control Ordinance ISSUE The question has been raised whether or not the urgency provisions attached to the mobile home rent control ordinance are sufficient . ANALYSIS Section 7 attached to the proposed mobile home rent control ordinance outlines a number of findings reportedly to support the urgency adoption of the mobile home rent control ordinance. Such urgency provisions allow the adoption and immediate effect of the ordinance without the usual five-day period in between readings and the delay in the effective date (see San Bernardino Charter Section 31) . The question stated is whether or not these findings are sufficient to support the urgency enactment . There is no provision in the Charter to outline what findings are required , only the statement that it must be an urgency ordinance . General law, however , provides in Government Code Section 36937 'Chat an ordinance takes effect immediately if it is "for the immediate preservation of the public peace , health or safety, containing a declaration of the facts constituting urgency, and is passed by four-fifths vote of the City Council . Penman February 1 , 1988 Page Two The courts have concluded that urgency clauses designed to render the ordinance effective immediately must state relevant and persuasive facts necessitating legislative action (see Parr v. Municipal Court (1971) 3 Cal . 3d 861 , cert . den . ; 92 Supreme Court 46 , 404 U.S . 869 , 30 L.Ed .2d 113) . Although such determinations of the legislative body are persuasive and entitled to great deference they are not conclusive (Los Angeles County y. City Council of the City of Lawndale (1962) 202 Cal .App.2d 20) . However , in the current situation it appears that the urgency determinations have factual support cited therein and certainly relate to the public health and safety in regards to the availability and affordability of homes for a great segment of the community. Such being the case it would appear that a court would uphold the determination that this was a legitimate urgency enactment . CONCLUSION It is my conclusion that the urgency determinations attached to the proposed mobile home rent control ordinance would be supported by a court . Respectfully submitted , i DENNIS A.
