STAFF REPORT
In March of 1987 , after several months of investigation ,
Engineering staff prepared a memo recommending increasing fees
in several areas as they related to engineering development
fees .
During the budget review , the Mayor and Council again considered
the increase in fees as a means of cost recovery for services
provided and to assure that required and planned structures and
improvements were completed without assessing the General Fund .
In September of 1987 , staff provided the necessary information
for action on the implementation of the increased fees .
Engineering staff has prepared the following resolution for
consideration of the Mayor and Common Council to adopt the in-
creased fees in general accord with the recommendations of
March , 1987 .
At the January 25 , 1988 , meeting of the Ways and Means
Committee , the Committee reviewed the staff report and discussed "
the recommendation . On a unanimous vote , they recommended that
the Council set the public hearing and recommended that Council
consider the implementation of the new fee resolution .
A public notice has been posted in the Engineering Department ,
third floor of City Hall , beginning in February to serve as
public notice of the proposed action .
Authority for collection of drainage fees is contained in
Ordinance No . 3873 and the fees established by Resolution No .
79-425 in 1979 . In 1980 , Resolution No . 80-435 amended a
portion of the fee resolution to reduce the rate collected after
the first 3000 square feet on commercial , industrial and multi -
family developments . Fees have remained unchanged since that
time .
The proposed fee increases wi l l bring the City up to the middle
ground of all surrounding agencies that collect for such
improvements . The proposed fee is twice the existing fee , and
can be roughly translated to $4 , 350 per acre on residential
development . Examples of the current and proposed fees for five
" typical " developments are attached for reference .
The March 1987 , report on fees contains information on the total
costs for drainage fees as collected by surrounding agencies .
The attached chart uses the same basic projects for comparison ,
but the surrounding agencies have not been shown . It must be
remembered that the adjacent community survey of fees was
conducted in late 1986 and early 1987 , so even this comparison
is out of date . Such comparisons take several months to com-
plete , and it is reasonable to assume that the adjacent agencies
are making necessary adjustments to account for inflation .
Additionally , at least two of the agencies surveyed required

complete construction of the drainage facilities and did not
relate this to costs of development or fees .
In addition to the basic increase in the fees now collected. It
is suggested that the fees be adjusted each year for inflation .
It has been proposed that the fee be tied to the Construction
Cost Index as published by the Engineering News Record and
adjusted up and down depending on this figure . The Construction
Cost Index is a compilation of the construction cost for
specific areas of the United Stated and reflects the true costs
to be anticipated for work performed . By making annual
adjustments , ranging from 1 . 7% to 8% ( historically ) the City ' s
fees will maintain pace with inflation or deflation and repre-
sent a true value for development .
An increase in the fees is necessary to generate sufficient
funds to complete major portions of the master planned drainage
systems and to upgrade the current system where it is deficient . "
Staff , therefore , recommends that the Mayor and Common Council
adopt the resolution setting the new fees and the policy of
adjusting fees in accordance with the rise or fall in the
Construction Cost Index .

2 RESOLUTION OF THE CITY OF SAN BERNARDINO AMENDING
RESOLUTION NO. 79-425 ENTITLED IN PART, "RESOLUTION . . .
3 ESTABLISHING A SCHEDULE OF FEES FOR STORM WATER DRAINAGE
FACILITIES CONSTRUCTION . . ." , AND AMENDING THE DRAINAGE FEES FOR
4 LAND SUBDIVISION AND DEVELOPMENT WITHIN THE CITY OF SAN
BERNARDINO.
5 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
6 OF SAN BERNARDINO AS FOLLOWS:
7 SECTION 1. Resolution No. 79-425, Subsection 2 (a) is
8 amended to read as follows:
9 (a) Prior to final map approval for a mobile home
10 residential subdivision, a fee of $0.12 per square foot of gross
11 area shall be paid.
12 SECTION 2. Resolution No. 79-425, Subsection 2 (b) is
13 amended to read as follows:
14 (a) Prior to building permit approval, the following fees
15 shall be paid:
16 (1) For a Single Family Home, a fee of $0.10 per
17 square foot of the lot, excluding dedicated streets. The fee for
18 a Single Family Home shall not exceed $2000.
19 (2) For a mobile home park , a fee of $0 .12 per
20 square foot of gross area.
21 (3) For all other construction or land development,
22 including, but not limited to, commercial, industrial and
23 multiple residential, and including additions or extensions in
24 excess of 1, 000 square feet to existing buildings, paving or
25 other impervious areas, a fee of $0. 30 per square foot for the
26 first 3, 000 square feet of building area, paving or other
27 impervious area; and $0 . 10 per square foot in excess of 3, 000
28 square feet.

(4) Said fees shall be adjusted annually each July

based on the increase or decrease in the yearly Construction Cost

Index as published in the Engineering News Record as of July 7 of

each year.
