The Planning Commission is targeted to have a recommended alternative by April 5. Council should adopt an alternative prior to June, 1988 , when the City will request an extension from the Office of Planning and Research. RECOMMENDATION Staff is requesting that the Council adopt the following hearing schedule and set dates for special meetings of the Mayor and Common Council for the purpose of adopting a preferred General Plan Land Use Alternative. The appeal is based on special privileges being granted to Mitsubishi , the company which owns the hotel (Attachment A) , in the form of an oversized sign. BACKGROUND Conditional Use Permit No. 87-71 was continued from the Planning Commission meeting of January 5 , 1988 to the meeting of January 26 , 1988 to enable the Planning Commission to further evaluate the signage proposal for the hotel. During the public hearing , the applicant , Young Electric Sign Company, presented a color rendering of the proposed signage and spoke in favor of the Conditional Use Permit. The item, on January 26, 1988 , was supported during public testimony by Ann Harris , Project Director of the Main Street Program; John Hoeger , Project Manager for the Redevelopment Agency; and the applicant, Young Electric Sign Company. In addition, a letter in support of the request was received from the San Bernardino Economic Development Council , Bruce Varner , Chairman (Attachment D) . No one spoke in opposition to the request. After brief discussion by the Planning Commission, which evaluated the size and height of the building and the relationship and scale of the sign, the item was approved with only one dissenting vote (Attachment B) . MAYOR AND COUNCIL ACTION The Mayor and Council may 1) Uphold the appeal and deny Conditional Use Permit No. 87-71 , or 2) Deny the appeal , approve the Negative Declaration and approve Conditional Use Permit No. 87-71 , subject to the Findings of Fact and Conditions of Approval in Attachment B . RECOMMENDATION Staff and the Planning Commission recommend that the Council uphold the decision of the Planning Commission approving Conditional use Permit No. 87-71, and deny the appeal. Sign Variance Request , is as follows : What you have here is a (Bridge Over River Qui) scene . This was a movie , with Australian Japanese prisoners . The Australian executive commander , the man in charge of his men , had become friendly with the Japanese commander . contruction engineer , who was aware that the AJapanese ncommander wanted a bridge built , so they could get their trains with supplies across the river . The Australian had never built a large bridge and it was his once in a lifetime challenge . He and his men built the bridge, they were proud of their work . Near the end of the movie, the Americans invaded and blew up the bridge with a Japanese train with supplies crossing it , thus leaving the Australian commander saying , My God , What have I done?" Practically every appliance in your household , over half of the automobiles on the highway in the USA come from Japan. As if this was not enough , two years ago, Japan took our American fender guitars and have gone co-opt with fender , with made in Japan on them. The Japanese have reduced our country to a thrift market . Our people can not afford suits , clothing; they have to go to thrift stores . Our car industry are going bankrupt because of too much import and etcetera from Japan, with a very much unfair trade difference . After World War II , the cars were a little high , but within time , the volume and and American only competion , brought..-prices down now, with all the Japanese cars flooding our ; . There is no chance of our car companies having volume sales , so they are closing down and have to keep high prices . Thus putting them out of business , all of our excess money is going back to Japan. I remember seeing the Japanese on TV years ago, what appeared to be a war machine , work , work , work . At first glance , you would have thought they were at war , but you couldn' t figure it out , what they were doing . Well now, I have and it was a war machine , only it was money , not bullets that was going to take this country . The Japanese are second to Canada who are the best investors in the USA , so The Sun Newspaper , stock pages says , and progressing rapidly . The Sun also stated , the stock market analist , were very concerned about it . You may have thought you gave the Japanese a building that could not be sold , what you did you gave them the heart of our town. They will use this building for a foothold and bring in more industry . Until they drain all excess money back to Japan. We have made the Japanese so wealthy that they can pay babysitters $70 .00 a night for sitting children , so our stock market pages says , in The Sun. The Sun also says the Japanese are trying to build a three level metal island ; out in the ocean , to hold a million Japanese . Where did they get all of this money? Of couse , USA . (Unfair trade) The Sun shows a picture of a toy, Japanese motorcycle; miniture size , made out of gold , platinum, with a large diamond headlight , costing $1 ,000 . 000 .00 . The Sun featuring a picture , of sunflower painting , the Japanese paid $40 ,000 ,000 .00 for it . The Japanese save 22C out of every dollar , so The Sun stockmarket page say, "What do you think they are doing with this money?" "Of course , buying us out" . I believe the Japanese will hire a lot of our people in the beginning and slowly replace them over the years with Japanese. They will get the proceeds anyway you look at it . We have been had . The Japanese practically own us . Last month on Channel 24 , 100 Japanese and 100 Americans were talking across the continent to each other . The Americans saying to them, "How would you like it , if we cut you off for your unfair trade deficit?" I suggest the city buy the hotel from the Japanese , own and operate it , the same as Long Beach owns Queen Mary and Spruce Goose . Talk to Washington, it can be done . If I become mayor , Japan will wish they didn' t own the hotel , I will have the people of San Bernardino behind me making sure of it . Japan gave one of our best military secrets to the Russians for silent operation of submarines , so the Sun newspaper quoted , "And we trust them" . Sincerely , Bud Ammons P. S . The proposed use conforms to the objectives of the City ' s General Plan Elements in that approval of the proposed Conditional Use Permit is consistent with the letters dated June 11 , 1987 , July 3 , 1987 and August 18 , 1987 from the State Office of Planning and Research to the City of San Bernardino which stipulate that " . . land uses proposed during the period of the extension will be consistent with the purpose of the updated General Plan provisions . No other signage shall be permitted at the hotel/convention center site. 2. In the event that this approval is legally challenged, the City will promptly notify the applicant of any claim or action and will cooperate fully in the defense of the matter. Once notified, the applicant agrees to defend, indemnify, and hold harmless the City, its officers, agents and employees from nay claim, action, or proceeding against the City of San Bernardino. The applicant further agrees to reimburse the City for any court costs and attorneys' feet which the City may be required by a court to pay as a result of such action, but such participation shall not relieve applicant of his obligation under this condition. 3. Minor amendments to the plans shall be subject to approval by the Director of Planning. An increase of more than 10 percent of the square footage or a significant change in the approved concept shall be subject to Planning Commission review and approval . AT PACHMEN'r CITY OF SAN BERNARDINO CASE Conditional Use Permit No. 87-71 AGENDA STANDARD REQUIREMENTS HEAR IN I DATE PAGE 10 COMMERCIAL, INDUSTRIAL 1 CUP No. 87-71 shall be in effect for a period of 12 months -- from the date of approval . However, if no development has been initiated at the end of the 12-month period, the application shall expire. Additional time may be approved upon request of the applicant prior to expiration of the 12-month period. Expiration Date: December 15, 1988. PARKING: a. This development shall be required to maintain a minimum of stan- dard off-street parking spaces. b. All parking and driving aisles shall be surfaced with two inches of AC over a suitable base or equivalent as approved by the City Engineer. Parking spaces shall be striped and have wheel stops installed at least three feet from any building, wall , fence, property line, or walkway. Whenever an off-street parking area is adjacent to or across an alley from property zoned residential , a solid decorative wall six feet in height shall be erected and maintained along the property line so as to separate the parking area physically from the residentially zoned pro- perty provided such wall shall be three feet in height when located within the required front or street side yard setback. Where no front or street side yard is required, such wall shall be three feet in height when located within ten feet of the street line. d. Whenever an off-street parking area is located across the street from property zoned for residential uses, a solid decorative wall or equiva- lent landscape berry not less than three feet in height shall be erected and maintained along the street side of the lot not closer to the street than the required depth of the yard in the adjoining residential area. REFUSE ENCLOSURES: Whenever refuse bins are located within or adjacent to a parking area used by the public, they shall be enclosed by a decorative wall six feet in height along the rear and sides and screened gate(s) six feet in height along the front. The enclosure shall not be placed within the required front or street side yard setback area. REQUEST The request is to establish a sign program for an existing hotel under authority of San Bernardino Municipal Code Section 19.78.025, as defined by the City Attorney' s Office, and to permit signages exceeding the area allowed in San Bernardino Municipal Code Section 19.60.240. The request is for 613 square feet of wall signs on two building elevations. In addi - tion, two freestanding signs and three directional signs are proposed. Total signage is 728.15 square feet. 2. SITE LOCATION The subject property is approximately a .5 acre parcel located on the east side of "E" Street between 2nd Street and Court Street, and further described as 295 North "E" Street. 3. MUNICIPAL CODE AND GENERAL PLAN CONFORMANCE The proposed sign program is inconsistent with the municipal code as shown in Attachment "A" in that a maximum of 150 square feet per frontage on 2 frontages for a total of 300 square feet of wall sign area is allowed. The General Plan does not address signage. 4. C.E.Q.A. STATUS A variance for signage is exempt from the requirements of C.E.Q.A. (Section 15305, Class 5) 5. BACKGROUND On June 8, 1982, the Planning Commission approved Conditional Use Permit No. 82-28 to allow construction of a 244 room, 12-story hotel at the sub- ject site. During the course of discussion at the Commission meeting, 2 free standing signs were proposed and approved by the Planning Commission for the project. Construction permits were issued in 1983 and construction was initiated. During the course of construction, the applicant (Ramada Inn) requested a variance of San Bernardino Municipal Code Section 19.60.220.B to permit wall signs in excess of the maximum square footage permitted by Code. The request was for 412 square feet of signage. On November 20, 1984, the request was denied by the Planning Commission by a vote of 4 to 3. The applicant appealed the decision to the City Council . On December 17, 1984, the Mayor and Common Council rejected the decision of the CITY OF SAN BERNARDINO PLANNING DEPARTMENT CASE Conditional Use Permit No. 87-71 OBSERVATIONS AGENDA ITEM HEARING DATE l PAGE 3 Planning Commission and approved the variance request. On January 10, 1985, a sign permit for 412 square feet of signage was issued by the Department of Building & Safety for the hotel . In 1985, the developer encountered financial difficulties. Construction stopped and the hotel was listed for sale. In 1987, the hotel was sold by the San Bernardino Redevelopment Agency to Mitsubishi Corporation of Japan, and plans to open the hotel early in 1988 are progressing. After purchase of the hotel by the Maruko Corporation, a request for signage in excess of allowable area prompted the Redevelopment Agency to initiate an amendment to text which would allow signage on a hotel having a height greater than six stories or 72 feet in the C-4 zone to be calcu- lated at a ratio of 4 square feet of sign area per linear foot of building frontage up to a maximum of 650 square feet per structure. An amendment was prepared and presented to the Planning Commission September 22, 1987. The unanimous decision of the Planning Commission was to recommend denial for the proposed text amendment to the Council . At the October 19, 1987 meeting of the Mayor and Common Council , the pro- posed text amendment was discussed. The decision was to approve the recommendation of the Planning Commission and deny the text amendment; and to direct the Maruko Corporation to apply for a conditional use permit to allow the signage requested. When placed on a building of such bulk, the signs do not appear excessive. Signage, however, is based on the C-3 standard of 150 square feet per building frontage up to two fronts. This is a reasonable standard for a building in the C-3 zone where maximum building height is limited to 45 feet. However, in applying the standard to a building 127 feet high, the standard is restrictive. The signage is necessary in order to provide freeway visibility as well as to provide direction to the facility. A structure of 127 feet in height may attain that visibility through large signage without creating a negative visual impact from the street viewshed. COMMENTS RECEIVED An official notice of Public Hearing for this application was published in The Sun Telegram newspaper on December 4, 1987. No comments were received. CONCLUSION The proposed signage is necessary for public exposure to the hotel/ convention center. The height of the building makes signage of excessve area a necessity. Signage meeting code standards for the C-3 zone would appear disproportionately small . The two largest signs are located at the top of the building. Other wall signs proposed are located at eye level from the street and are scaled down appropriately. They will be com- patible with other signage in the vicinity. However, if no development has been initiated at the end of the 12-month period, the application shall expire. Additional time may be approved upon request of the applicant prior to expiration of the 12-month period. Expiration Date: December 15, 1988. PARKING: a. This development shall be required to maintain a minimum of stan- dard off-street parking spaces. b. All parking and driving aisles shall be surfaced with two inches of AC over a suitable base or equivalent as approved by the City Engineer. Parking spaces shall be striped and have wheel stops installed at least three feet from any building, wall , fence, property line, or walkway. c. Whenever an off-street parking area is adjacent to or across an alley from property zoned residential , a solid decorative wall six feet in height shall be erected and maintained along the property line so as to separate the parking area physically from the residentially zoned pro- perty provided such wall shall be three feet in height when located within the required front or street side yard setback. The site consists of approxi- mately 0 .5 acre and is located at the northerly terminus of State Street , adjacent to the intersection of University Parkway and Kendall Drive . 2 . The site is presently zoned R-3-3000 , Multiple Family Residential . The request is to change the zoning to that of C- 1 , Neighborhood Commercial. 3 . The purpose for the zone change is to change its classification so that it will be integrated into the proposed Neighborhood Commercial Center district , which abuts the subject parcel to the east. The site for the proposed center had a zone change approved (except for the subject parcel) from R-3-3000 to C-1 as Change of Zone No. 86-29 on March 9 , 1987 . The subject site to remain as R-3-3000 would make no sense since it would be an isolated residential lot bound on two sides by commercial land use and the remaining sides would be street frontages and a high voltage Edison easement. By approving the subject site to a C- 1 zone it would be functionally integrated as landscaping and parking for the proposed shopping center . 4 . State College Area General Plan allows small neighborhood commercial centers which are under 2 .0 acres in area to be permitted within residentially designated areas of the Plan. 5 . At their regularly scheduled meeting of May 7 , 1987 , the City' s Environmental Review Committee recommended adoption of a negative declaration for the proposed zone change .
